Evans called to order the Regular ~eting of the City Council, the Special Meeting of the Housing Authority and the Special Meeting of Conmmmity Redevelopment Age~cy at 7:35 p.m. in the City Council Chambers, 22 Civic Center Plaza. ROLL CALL PRESENT: ABSENT: OTHERS PRESENT: Brandt, Bricken, Evans, Garthe, Ortiz, W~rd, Yamamoto None Clerk of the Council Diedre' Lingenfelter PLEDGE OF ALLEGIANCE INVOCATION of the First Congregational Church. Following the Pledge of Allegiance to the Flag, the invocation was given by Reverend Lester Smith CERTIFICATION OF CANVASS Clerk of the Council, Diedre' OF ELECTION Lingenfelter, presented to the Council her Certificate of Canvass completed April 9, 1979, confirming the election results as follows: Robert Luxembourger elected to represent Ward 2 by a total of 3,768 votes for the term ending April 12, 1983. A1 Serrato elected to represent Ward 4 by a total of 4,434 votes for the term ending April 12, 1983. Daniel E. Griset elected to represent Ward 5 by a total of 4,283 votes for the remainder of the term endingApril 14, 1981. J. Ogden Markel elected to represent Ward 6 by a total of 6,590 votes for the term ending April 12, 1983. The Charter amendment to revise the budget adoption procedure by prohibiting yearly operating and capital budget growth greater than five percent (5%) and salary, wages and fringe benefits greater than seventy percent (70%) of said budgets, without a vote of the electorate, failed with 5,221 votes in favor and 6,192 votes against the measure. The total number of ballots cast was 11,909, representing 19% of the total number of registered voters, 62,621. RESOLUTION NO. 79-59 ELECTION RESULTS ADOPTED MOTION was made by Brandt, seconded by Garthe, to adopt the following resolution: RESOLUTION NO. 79-59 - A resolution of the City Council of the City of Santa Ana stating and declaring the results of the canvass of the consolidated general and special municipal elections held in the City of Santa Ana, California, on April 3, 1979. AYES: NOES: ABSENT: BRANDT, BRICKBN, EVANS, GARTHE, ORTIZ, WARD, YAMAMOTO NONE NONE REFLECTIONS OF MAYOR EVANS Mayor Evans invited each Councilman to conment on his term of service, after which he made his final remarks. CITY CO~qCIL MINUTES 12i APRIL 10, 1979 INSTALLATION OF NEWLY Clerk of the Council, Diedre' ELECTED COUNCIL MEMBERS Lingenfelter, adminstgred the oath of office and presented certificates of election to Councilmen Griset, Luxembourger, Serrato and Markel. ADJOUR~FANT The Mayor announced adjournment SINE DIE sine die, and requested the Clerk of the Council to preside during the initial proceedings for the reorganization of the Council. REORGANIZATION OF COUNCIL The Clerk of the Council called for nomination for the office of Mayor. Councilman James E. ~rd was nominated by Bricken, seconded by Griset. Councilman Harry K. Yamamoto was nominated by Markel; no second to the nomination. Councilman J. Ogden B~rkel was nominated by Yamamoto; no second to the nomination. MOTION was made by Bricken, seconded by Griset, to close the nominations for the office of Mayor. AYES: NOES: BRICKEN, GRISET, LUXBMBOURGER, bi~RKEL, SERRATO WARD, YA~I~4OTO NONE Councilman Markel r~quested the vote be taken by secret ballot. The Clerk of the Council anno~mced that Councilman James E. Ward had been elected Mayor. At the request of Councilman Markel, she stated the vote was S to 2 in favor of Councilman Ward. The Clerk returned the chair to ~yorWard. Mayor Ward thanked the Council for its confidence in electing him to the office of Mayor and stated he was pleased to assume those duties for the coming year. ELECTION OF VICE MAYOR Mayor Ward called for nomination for the office of Vice }~yor. Councilman Bricken was nominated by Griset, seconded by Ward. Councilman Yamamoto was nominated by Markel, seconded by Serrato. MOTION was made by Griset, seconded by Markel, to close the nominations for the office of Vice Mayor. AYES: NOES: BRICI<BN, GRISET, LUXEMBOURGER, MARKBL, SERRATO WARD, YAMAMOTO NONE The vote was taken by secret ballot. The Clerk of the Council announced that Councilman Gordon Bricken had been elected Vice Mayor. RECESS Mayor Ward recessed the meeting for COMITY DEVELOPMENT AGENCY; special meetings of the Con~mnity HOUSING AUTHORITY Redevelopment Agency and the Housing Authority for the purpose of elections for Chairman and Vice Chairman; the meeting was reconvened. INTRODUCT IONS Mayor Ward invited each Councilman to introduce his family and special guests. CITY COUNCIL MINUTES 122 APRIL 10, 1979 SPECIAL PRESENTATIONS Mayor Ward presented former Mayor Evans and Councilmen Brandt, Garthe and Ortiz with special plaques and the portraits of each that had been displayed in the Council Chamber lobby. Kathy Hudson, representing Senator Paul Carpenter, presented a special resolution to Mayor Evans; Bill Mack, Administrative Assistant to Assemblyman Richard Robinson, congratulated the outgoing Councilmen on their successful terms of office; Dan Young, representing U.S. Congressman Jerry Patterson, extended congratulations; and Supervisor Philip Anthony, Chairm~m of the Orange County Board of Supervisors, remarked on the cooperation received from Santa Ana in the past, and conveyed best wishes to the new Council members. Mayor Ward extended birthday congratulations to former Councilman David Ortiz. ORANGE COUNTY SANITATION ;©TION was made by Bricken, seconded DISTRICTS - APPOINTMENTS by Griset, to appoint Councilman Yamamoto as Director of Orange County Sanitation Districts 2 and 3 and as Alternate Director to Districts land 7. AYES: NOES: BRICKEN, GRISET, LUXEMBOURGER, MARKEL, SERRATO W~uRD, YAMAMOTO NONE MOTION was made by Bricken, seconded by Griset, to appoint Mayor Ward as Director of Orange County SanitatiOn Districts 1 and 7 and as Alternate Director to Districts 2 and 3. AYES: NOES: BRICKEN, GRISET, LUXEMBOURGER, MARKEL, SERRATO WARD, YAMAb©TO NONE RESIGNATION FROM PLANNING MOTION was made by Bricken, seconded COb~ISSION & TRANSPORTATION by Luxembourger, to accept the ADVISORY COMMITTEE - ACCEPTED resignations submitted byR.W. Luxembourger on the Planning Commission and Transportation Advisory Committee due to his election to the City Council. AYES: NOES: BRICI<EN, GRISET, LUXI~OURGER, MARKEL, SERRATO, WARD, YAMAMOTO NONE ADJOI~NT MOTION was made by Bricken, seconded by Luxembourger, and unanimously carried to adjourn the meeting to Monday, April 16, 1979, at 2:00 p.m. The meeting was adjourned at 8:50 p.m. Respectfully submitted: CLERK OF THE COUNCIL CITY COI~CIL MINUTES 123 APRIL 10, 1979 EJC:adg 4/10/79 RESOLUTION NO. 79-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA STATING AND DECLARING THE RESULTS OF THE CANVASS OF THE CONSOLIDATED GENERAL AND SPECIAL MUNICIPAL ELECTIONS HELD IN THE cITY OF SANTA ANA, CALIFORNIA, ON APRIL 3, 1979. WHEREAS, the City Council of the City of Santa Ana, by Ordinance NS-1468, duly called for and provided for the holding of a general municipal election on April 3, 1979, to fill vacancies in public office; and WHEREAS, the City Council of the City of Santa Ana, by Ordinance NS-1471, duly called for and provided for the holding of a special municipal election on April 3, 1979, to fill a vacancy for an unexpired term in public office; and WHEREAS, the City Council of the City of Santa Ana, by Ordinance NS-1473, duly called for and provided for the holding of a special municipal election on April 3, 1979, for the submission of a charter amendment relating to revenue and taxation; and WHEREAS, notices of said elections, notices of' nominees for public office, and notices of the election officers and polling places were regularly given in time, form and manner as provided by law; the sample ballots, the statements submitted by the candidates for public office, and the arguments submitted for and against the proposed charter amendment which is set out in "Exhibit B" attached hereto and made a part hereof, were regularly mailed to all electors within the City; and said elections on said date were duly held at the polling places designated and the votes cast thereat were canvassed and the returns thereof made in the time, manner, and form provided by law; and WHEREAS, on the 10th day of April, 1979, the City Council of the City of Santa Ana has duly assembled at its usual place of meeting, the returns of said elections having been canvassed by the Clerk of the Council pursuant to Resolution No. 79-4. NOW, THEREFORE, the City Council of the City of Santa Ana does hereby resolve, determine, and order as follows: That the general and special municipal elections were duly held on April 3, 1979, and the votes cast thereat were duly and regularly canvassed and the returns thereof made in the time, form, and manner required; that all things were regularly done as required by law; that the absent voter ballots were duly canvassed and counted as required by law, and the results of such countare hereinafter set forth on "Exhibit A", attached hereto and made a part hereof$ that the Clerk of the Council has duly canvassed the returns of said election and from the said returns, it appears, and the City Council finds, that the total number of votes cast in each precinct for each person and the proposed charter amendment, the number of votes cast in the City to each person and the charter amendment, the whole number of votes cast in the City, and the total number of absentee votes cast in the City, are as set forth on "Exhibit A," attached hereto and made a part hereof. RESOLUTION NO. 79- 59 PAGE TWO BE IT FURTHER RESOLVED, that at said general municipal election, Robert Luxembourger residing in Ward 2, A1 Serrato residing in Ward 4, and J. Ogden Markel residing in Ward 6, were elected to offices of Member of the City Council for terms of four (4) years. BE IT FURTHER RESOLVED, that at said special election Daniel Griset residing in Ward 5, was elected to the office of Member of the City Council for the two (2) years remaining of the unexpired term. BE IT FURTHER RESOLVED: 1. That at said special municipal election, the following proposition was submitted to the qualified voters of said City, to wit: PROPOSITION A - REVENUE AND TAXATION: shall the charter be amended to revise the budget adoption procedure by prohibiting yearly operating and capital budget growth greater than five percent (5%) and salary, wages and fringe benefits greater than seventy percent (70%) of said budget, without a vote of the electorate? 2. That the voters of less than a majority of all of the voters voting at said election upon Proposition A were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. 3. That the Clerk of the Council is hereby directed to enter this resolution in full in the minutes of this City Council, which entry shall constitute the statement of the Clerk of the Council of the results of said election.
