MINUTES REGULAR MEETING COMMUNITY REDEVELOPMENT AGENCY SANTA ANA, CALIFORNIA AUGUST 16, 1983 The Regular Meeting of the Community Redevelopment Agency of the City of Santa Ana was called to order by Chairman Luxembourger at 5:43 P.M., in the City Council Chambers, 22 Civic Center Plaza, Santa Ana, California. After the Pledge to the Flag and the Invocation given by Chairman Luxembourger, roll was called: PRESENT ABSENT John Acosta Daniel Griset, Vice Chairman P. Lee Johnson Patricia McGuigan Robert Luxembourger, Chairman Dan Young Gordon Bricken Others in Attendance: A. J. Wilson, City Manager Rex Swanson, Executive Director Edward J. Cooper, City Attorney David N. Ream, Community Development Director Thomas E. Hammill, Assistant Director Redevelopment & Real Estate Laura Juarez, Secretary CONSENT CALENDAR ITEM REMOVED Chairman Luxembourger requested that item 3.A. (Extension of Exclusive Right to Negotiate for the A-5 site, northeast corner of First and Main Streets) be taken off the consent calendar. CONSENT CALENDAR STAFF RECOMMENDATIONS APPROVED On the unanimously approved 6:0 motion of Vice Chairman Griset, seconded by Mrs. McGuigan, the Agency approved the recommendations of Staff on the following consent calendar items: . . . MINUTES Approved the Minutes of the Special Meeting held on July 18, 1983, the Regular Meeting held on July 19, 1983, and the Special Meeting held on August 1,1983. DEVELOPER SELECTION FOR THE A-6 SITE (FORMER GUILD THEATRE) Granted a 90 day exclusive right to negotiate to the Trust Development Company for development of the A-6 site. LEASE AGREEMENT FOR PROPERTY LOCATED SOUTHWEST CORNER OF MAIN AND CHESTNUT AT THE Authorized the Chairman to execute an agreement to lease the real property located at the southwest corner of Main and Chestnut for off-street parking purposes from Edward and Norma Miner for a lease term of ten (10) years at $500.00 per month. * * * * * * * * * CONSENT CALENDAR FINIS * * * * * * * * * * .. EXTENSION OF EXCLUSIVE RIGHT TO NEGOTIATE FOR THE A-5 SITE, NORTHEAST CORNER OF FIRST AND MAIN STREETS The City Manager stated that Staff had spent some time with Urbatec and that Urbatec has completed the necessary market studies. The 120 day extension to their exclusive right to negotiate is to work out a development plan feasible for the Agency that would be brought to the Agency at the end of the 120 days. Business and property owners within the affected area were to be notified of specific plan development for the A-5 site and that it had been at least five months since they had been in touch with Mr. MacLaurin¡ -2- it .. . 2. Seismic Ordinance should be postponed until Urbatec decides what they're really going to do; 3. Business and property owners within the affected area did not wish to rehabilitate their buildings if they were going to be demolished; and 4. 120 days was a long time and they would like to see the time reduced. In response to a question raised by Chairman Luxembourger, the City Manager stated that any property owner who rehabilitates his or her property will be exempted from eminent domain. Mr. MacLaurin stated that he had made every effort to communicate with staff. He also stated that Urbatec was devoting a lot of time so that a careful analysis would be done. In response to a question raised by Mrs. McGuigan, the Community Development Director responded that the majority of the buildings, 70 to 75%, had been mailed the seismic letters. Mr. Young stated that 120 days was not acceptable to him. He also stated that he would like to support a motion of a 90 day period with the requirement that the developer, within thirty (30) days, give adequate notice to affected parties within the development site and meet with them and that he would not support consideration of extensions for seismic ordinance compliance. Mr. MacLaurin stated that four months was barely enough time to do the task. In response to several questions raised by Mr. Acosta, the City Manager stated that Urbatec was the one that was requesting the 120 day extension and that normally we do not submit their work to the Agency. In response to a question raised by Mr. Acosta, Mr. MacLaurin stated that Urbatec had worked with staff and did get involved in discussions at all levels. In response to several questions raised by Chairman Luxembourger, the City Manager stated that a request from the property owners had been made to set up a meeting so that they could understand what was going on. He also stated that the seismic letters did not require the rehabilitation of the buildings within the first year. -)- .. . .. After a brief discussion, a motion was made by Mr. Young, seconded by Vice Chairman Griset and carried by the following roll call vote to: 1. Grant a 90 day extension to the exclusive right to negotiate with Urbatec for development of the A-5 site with the stipulation that staff make a progress report to the Agency on October 18,1983; 2. That Urbatec contact the property owners within thirty (30) days to let them know what was going on; and 3. If buildings are brought up to seismic code, that they be exempt from eminent domain. AYES: NOES: ABSENT: Acosta, Griset, Luxembourger, McGuigan, Young Johnson Bricken Mr. Young left at 6:45 P.M. REQUEST FOR FUNDING FOR PROPOSED SANTA ANA DOWNTOWN SHUTTLE - TRANSPORTATION SERVICES After a brief discussion, a motion was made by Vice Chairman Griset, seconded by Mr. Johnson and carried unanimously to authorize the expenditure of funds, not to exceed $50,000, to fund the City's share of the Santa Ana Shuttle Bus subsidy. WRITTEN NOTIFICATION FURNITURE, INC. GREEN'S OF DENIAL OF CLAIM OF A motion was made by Vice Chairman Griset, seconded by Mr. Johnson and carried unanimously to adopt Resolution 83-26: A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA DENYING THE CLAIM OF GREEN'S FURNITURE, INC. FOR RELOCATION ASSISTANCE PAYMENTS. EXECUTIVE SESSION At 6:55 P.M., the Redevelopment Agency adjourned to an Executive Session. The meeting was reconvened at 7:15 P.M., with the same members present.
