RESOLUTION NO. 74-10
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA ADOPTING
A POLICY FOR THE EXERCISE OF THE POWER OF
EMINENT DOMAIN BY THE AGENCY WITHIN THE CITY
OF SANTA ANA REDEVELOPMENT PROJECT AREA

The Community Redevelopment Agency of the City of Santa
Ana DOES HEREBY RESOLVE AS FOLLOWS:
1. Eminent Domain Limitations. Except for public improvements,
facilities, and utilities, and for a period of seven (7) years,
the Agency shall use eminent domain only if the property to be con-
demned in the subject of an OWner Participation Agreement or Dis-
position and Development Agreement between the proposed participant
or developer and the Agency. After seven (7) years, it shall be
the, policy of the Redevelopment Agency not to use eminent domain
except for specific properties considered necessary to carry out
a successful financially economic plan productive for the taxpayers
of the City of Santa Ana, and then only after a noticed public hearing
held prior to the filing of any eminent domain action.
2. This resolution shall become effective upon the
dismissal with prejudice as to all parties defendant of
that action now pending in Orange County Superior Court entitled
Joseph L. Gilmaker vs. Community Redevelopment Agency of the City
of Santa Ana, et al., Case No. 206 253.
