RESOLUTION NO. 75- ~ A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA FINDING AND DETERMINING THE GENERAL PREVAILING RATES OF PER DIEM WAGES, AND THE GENERAL PREVAILING RATES OF PAY FOR HOLIDAY AND OVER-TIME WORK IN SANTA ANA, CALIFORNIA, FOR WORKMEN NEEDED TO EXECUTE THE AGENCY'S CONTRACTS EXECUTED IN CONFORMITY WITH THE PROVISIONS OF DIVISION 24, PART 1, CHAPTER 4, ARTICLE X OF THE HEALTH AND SAFETY CODE WHEREAS, the Executive Director has obtained from the Public Works Director of the City of Sànta Ana evidence of, and this Agency has ascertained, in conformity with Section 33423 of the Health and Safety Code and the standards set forth in Division 2, Part 7, Chapter 1, Article II of the Labor Code, the general prevailing rates of per diem wages and the general prevailing rate of pay for holiday and over- time work, in Santa Ana, California, for each craft classifi- cation and type of workmen needed to execute this Agency's contracts executed in conformity with the provisions of Division 24, Part 1, Chapter 4, Article X of the Health and Safety Code; NOW, THEREFORE, BE IT RESOLVED by the Community Redevelopment Agency of the City of Santa Ana as follows: Section 1. That in compliance with the requirements of Section 33423 of the Health and Safety Code, this Agency hereby finds and determines, in conformity with the standards set forth in Division 2, Part 7, Chapter 2, Article I of the Labor Code, that the prevailing rate of per diem wages, and the general prevailing rate of pay for holiday and over-time work, in Santa Ana, California, for each craft, classification, and type of workmen needed to execute this Agency's contracts executed in conformity with the provisions of Division 24, Part I, Chapter 4, Article X, of the Health and Safety Code are as set forth in the hereto attached Schedule of General Pre- vailing Rates of Per Diem Wages, and General Prevailing Rates of Pay for Holiday and Over-time Work in Santa Ana, California, marked Exhibit "A", and by this reference made a part hereof. Section 2. That this Agency's determination of such prevailing rates of wages shall be published in a newspaper of general circulation, such publication to constitute the annual publication provided for by Section 1773 of the Labor Code. The rates of per diem wages for each of the various classifications of work shall be the hereinbefore set forth prevailing rates of hourly wages multiplied by eight, Eight hours shall constitute a day's work, it being understood that in the event that workmen are employed less than eight hours per day, the per diem wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours. The overtime rule establishing the rates of overtime and holiday work shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week, Whcre work is required in excess of eight hours in anyone day or during the interval of time from 5:00 o'clock p,m. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays, such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the 1974 revision of the AGC, BCA, HBI, EGCA, AFL-CIO Southern California Master Labor Agreement, Holidays as herein referred to shall be deemed to be New Year's 'Day, Decoration Day, Independence Day, Labor Day, Veterans' Day, Thanksgiving Day and Christmas Day. If any of the above-mentioned holidays, other than Labor Day and Thanksgiving Day, falls on a Sunday, the following Monday shall be considered a legal holiday, It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the said specified rates of wages to all laborers, workmen, and mechanics employed by them in the execution of the contract.
