HomeMy WebLinkAbout1977-26 CRA , . . . . . ~ RESOLUTION NO. 77-26 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA APPROVING THE SANTA ANA PARK-AND-RIDE STRUCTURE PROJECT AND CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE SAID PROJECT WHEREAS, the Redevelopment Agency of the City of Santa Ana and the Orange County Transit District have proposed to jointly carry out a certain project, to wit: the acquisition and clearance of the site for, and the construction, maintenance, and operation of, a 700-space parking structure, designated as the Santa Ana Park-and-Ride Structure, to be located on the southerly portion of that certain block in the City of Santa Ana bounded by Santa Ana Boulevard on the north, Broadway on the east, and Fifth Street on the south, and extending over a portion of Birch Street on the west; tiHEREAS, the Redevelopment Agency of the City of Santa Ana has been designated as the lead agency for purposes of en- vironmental review of the said project by agreement between the said Redevelopment Agency and the Orange County Transit District; and WHEREAS, the said Redevelopment Agency did submit for a public review and comment a draft environmental impact report for the said project and did, on October 25,1977, hold a public hearing for the purpose of receiving public comment on the said draft environmental impact report; and WHEREAS, a final environmental impact report has been prepared on the basis of the public review and comment upon the said draft environmental impact report and submitted to the governing body of the Redevelopment Agency of the City of Santa Ana for its review and consideration; NOW, THEREFORE, BE IT RESOLVED that the governing body of the Redevelopment Agency of the City of Santa Ana does hereby certify that the said final environmental impact report has been completed in accordance with the requir,~~nts of CEQA and the State EIR Guidelines and that, prior to taking any action to approve or disapprove the project, it has reviewed and considered the information contained in the said final environmental impact report and that it approves the said final environmental impact report, including the responses to public comments set forth therein. BE IT FURTHER RESOLVED that the Redevelopment Agency of the City of Santa Ana does hereby approve and determine to carry out the said project in the manner agreed upon between the said Redevelopment Agency and the Orange County Transit District, sub- ject to such measures designed to avoid or mitigate the signifi- cant environmental effects thereof as hereinafter set forth. BE IT FURTHER RESOLVED that the executive director of the Redevelopment Agency of the City of Santa Ana is hereby directed to file a Notice of Determination for the said project ~B . . , . . , .... RESOLUTION NO. 77- PAGE TWO in accordance with the California Environmental Quality Act. BE IT FURTHER RESOLVED that the Community Redevelopment Agency of the City of Santa Ana hereby finds that the final en- vironmental impact report for the proposed Park-and-Ride Facility identifies significant environmental effects as sununarized on Exhibit A, attached hereto and incorporated herein as though fully set forth; that,except as otherwise stated therein, the measures set forth following each such significant effect miti- gate or avoid such significant effects; and that such mitigation measures are incorporated into the Park-and-Ride facility project. The facts in support of such finding are as follows: 1. On May 24,1977, the City of Santa Ana and the Orange County Transit District entered into an Agreement providing for the construction and operation of the Park-and-Ride facility, conditional upon subsequent approval of said project after review and consideration of a final environmental impact report. 2. On May 24,1977, the City of Santa Ana assigned its interests in the said Agreement to the Community Redevelopment Agency of the City of Santa Ana. 3. Thereafter, the Redevelopment Agency and the Orange County Transit District agreed that the Redevelopment AGency would be the lead agency for purposes of environmental review of the project, which agreement was formalized by written agreement dated November 7,1977. 4. The said agreement of November 7,1977, further provided that any and all mitigation measures set forth in this resolution of approval of the project would be incorporated into the agreement for construction and operation of the Park-and-Ride facility, subject only to the subsequent right of OCTD to approve or disapprove the project as thus modified. BE IT FURTHER RESOLVED that the project alternatives identified in the final Environmental Impact Report are found to be unfeasible for the following considerations: 1. The alternative of no project is infeasible due to social and environmental considerations. It would not promote greater utilization of public transit as an alternative to pri- vate automobile transportation. It would not provide for relocation of the central transit waiting area from the inadequate location at Sixth and Flower Streets. It would not provide any means of alleviating parking needs in the downtown area. It would have no beneficial effect on the goals of redevelopment of the central business district as established by the Redevelopment Plan of the City of Santa Ana. 2. The alternative of change in intensity of develop- ment is infeasible due to social and economic considerations. A greater capacity than 700 spaces would add additional cost to the project without satisfying any corresponding public need for such additional parking. A lesser capacity than 700 spaces would transfer parking demand to nearby sites in the project area. 3. The alternative design schemes for the project area are infeasible due to economic and environmental considerations. Such alternatives would add to the cost of the structure without corresponding benefits in efficiency or in mitigation of adverse environmental impacts. Furthermore, such alternatives would pro- duce greater adverse environmental impacts on the aesthetic and historical qualities of the mortuary property. " -2- 3B RESOLUTION NO. 77- PAGE THREE , 4. Alternative land uses for the project site are in- feasible due to social and economic considerations, in that the proposed parking structure is the use of the site which is most compatible with the redevelopment goals of the provision of needed public parking in the downtown area and promotion of retail trade in such area. . 5. An alternative location for the Park-and-Ride faci- lity is unfeasible due to social and environmental considerations. The subject site is the best available location providing parking which is convenient to the civic center, to the downtown retail area, and to the proposed transit plaza. It provides an optimal location for the routing of buses to a central downtown waiting area. Construction of the Parking Structure on the block to the east of the project site would eliminate the possibility of future construction of an open space plaza area in an attractive setting opposite the old County Courthouse. Possible increased economic pressure for conversion of the mortuary property for more intensive use. If economically feasible, the Santa Ana Redevelopment Agency plans to acquire the entire mortuary property and to con- vey that portion not required by the parking facility to a pri- vate user subject to restrictions on use and alternations designed to preserve the building and trees. Economic feasibility is de- pendent upon availability of a purchaser and reasonableness of purchase price offered at the time of land acquisition and cannot be determined with certainty prior to such time. Loss of pedestrian access between Santa Ana Boulevard and Fifth Street west of the parking structure. The Santa Ana Redevelopment Agency shall recommend to the City Council that the City Center Land Use, Arterial Streets and Public Facilities Plan be reviewed and considered for amend- ment to reflect the loss of pedestrian access caused by the clos- ing of Birch Street and to consider provision of future pedestrian access west of the parking structure between Santa Ana Boulevard and Fifth Street. 2. 3. possible loss of trees on the mortuary site due to City build- ing set-back requirements. The Santa Ana Redevelopment Agency, upon its acquisition of the subject site, shall apply for such zoning variances as may be necessary for the parking structure under the City's building set-back requirements, in order to preserve as many trees on the mortuary site as possible. 4. possible adverse visual and aesthetic effects. The Parking Structure shall be designed in accordance with the following goals: a. Compatability with the design of the proposed transportation terminal. b. Inward direction of exterior lighting. c. Use of building materials, color, and landscaping to reduce glare. d. The small increase in shadow length that may be produced by roof-top stairhouses and elevator penthouses is found not to be a significant environmental effect, and designing such facilities for the purpose of reducing shadow length is found to be infeasible due to economic and social considerations, in that considerations of construction costs and public convenience outweigh any possible benefits of a minor decrease in shadow length. 5. possible geological hazards. A soils report and seismology study shall be conducted prior to construction of the parking structure. In the event any significant geological hazard is disclosed, the design of the structure shall be reevaluated and modified as necessary to avoid or mitigate such hazard. EXHIBIT A 3B a . . . . , ~ 6. Effect on storm water run-off. The project will not have any significant environmental effect on storm water run-off, due to the fact that the site as currently developed does not provide any collection and infiltration of storm water. 7. possible loss of trees. The Parking Structure shall be designed to preserve the Deodar Cedar tree and two Queen Palm trees located on the southerly portion of the mortuary property if at all feasible. In the event that removal of the trees is required, the feasi- bility of transplanting them shall be considered prior to their removal. 8. Possible archeological resources. Within 30 days after clearance of the site of the Parking Structure, any persons or groups expressing an interest in inspecting such site for evidence of archeo10gical1y valuable resources shall be given a reasonable opportunity to do so. In the event such an examination discloses any such evidence, con- struction shall be delayed for a reasonable period to allow for its evaluation. 9. Possible adverse effects on traffic circulation. The Parking Structure shall be designed to provide access from both Santa Ana Boulevard and Fifth Street. Additional signal heads shall be installed at affected intersections as necessary to control contra-flow bus movement. 10. Increased noise levels. During construction of the Parking Structure, construc- tion work shall take place only between the hours of 7:00 a.m. and 6:00 p.m. and a pedestrian barrier shall be erected around the con- struction site. The Parking Structure shall be designed to miti- gate adverse noise effects by (a) provision of acoustical treat- ment for the bus waiting area, and (b) provision of a non-slick concrete surface in the areas of vehicle movement. 11. Increased air pollutants in the project area. The Parking Structure shall be designed to mitigate adverse effects of vehicle air pollutants by (a) provision of an enclosed bus waiting area, and (b) provision of landscaped areas including tall trees. 12. Increased demand for police services. The following measures shall be incorporated into the Parking Structure to mitigate increased demand for police services: (a) Good lighting, both interior and exterior, pro- tected with vandal-resistant covers. (b) Good lighting for stairwells and elevators, with vandal-resistant covers. (c) Installation of adequate phone booths. (d) Adequate signs and signals to direct traffic egress to and from the streets. EXHIBß' J 3ß a . . . . . . .. (e) Vehicle route design allowing police patrol units to move through the facility from entry to exit, unless controlled entry is to be maintained. (f) Capability for installation of an overhead walkway across Broadway. (g) Design of landscaping to allow visibility into the ground floor of the Parking Structure. (h) provision of breaks in the first level wall to allow visibility into the ground floor of the Parking Structure. (i) Design of the parking Structure with an emphasis on visibility between each level and the streets. 13. Possible increased energy consumption. Prior to completion of construction of the Parking Struc- ture, Southern California Edison shall be consulted with regard to possible energy conservation measures. 14. possible building safety and fire hazards. The parking Structure shall be designed and constructed in conformity with the Building Code and Fire Code of the City of Santa Ana. 15. Adverse effects on Presbyterian Church and Masonic Lodge. Bus routes to and from the Parking Facility during its use as a central downtown bus waiting area shall be designed to avoid use of Sycamore Street for bus layover and primary routing. Prior to operation of the Parking Facility a specific lighting plan shall be developed for the purpose of insuring adequate light- ing for the protection of the public safety. In addition, the Santa Ana Redevelopment Agency will conduct a study to determine the need and feasibility of providing assistance to the Presby- terian Church and Masonic Lodge to further reduce adverse noise and air pollutant effects. £XHIB1T A ~B
