OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA, CALIFORNIA
August 27, 1981
The meeting was called to order by Mayor Gordon Bricken at 7:42 p.m., in
the City Council Chambers, 22 Civic Center Plaza. Councilmembers present
were John Acosta, Daniel E. Griset, R. W. Luxembourger, J. Ogden Markel,
Patricia A. McGuigan, Alfred C. Serrato, and Mayor Gordon Bricken. Also
present were City Manager A. J. Wilson, City Attorney Edward J. Cooper,
and Clerk of the Council Janice C. Guy.

Following the Pledge of Allegiance
to the Flag, the Invocation was given
by Councilmember Serrato.
ASSESSMENT DISTRICT NO. 246

CONTINUED FOR 30 DAYS
The Mayor announced that this was the
time and place for the public hearing
of appeals of the assessment in the
matter of Assessment District No. 246.
The Clerk of the Council reported that
notices had been published, posted and mailed as prescribed by law, and that
affidavits were on file in the office of the Clerk of the Council.
The City Manager presented a detailed report which included the background
of the Assessment District, funding methods, the formula for making the
assessments, the bond payment schedule, and other related information.
The Council recessed at 8:27 p.m., and reconvened at 8:41 p.m., with the
same members present.
The Council then asked questions of the staff and consultants, Steven
Spickard of Economic Research Associates, Richard Botti of Keyser Marston,
and Robert Powell of Stone and Youngberg, who responded in their respec-
tive areas of expertise.
The Clerk of the Council reported written communications protesting the
Assessment District from the following:

E. Walter Scott on behalf of Ranchaire Corporation
Dorothy D. Smith

Written communications in support of the District were received from the

Barbara Mathewson
William Bruce Voss
Harry Gabriel
A written communication was received from Raymond J. Cully protesting the
rejection of his bid on the project as "non-responsive."

MOTION was made by Luxembourger, seconded by Acosta, to receive and file
all communications reported by the Clerk of the Council.
Motion passed on the following vote:

The Mayor requested that persons who had filed a written protest come
forward to address the Council.
The following persons spoke in opposition to the Assessment District:

Sheldon Satnick, 784 San Lorenzo St., Santa Monica
The Council recessed at 9:50 p.m., and reconvened at lO:O1 p.m., with the
same members present.
Speakers in opposition continued to address the Council as follows:

Samuel H. Lasry, 1455 Rising Glen Road, Los Angeles
E. Walter Scott, 206 W. Fourth St°

The following persons spoke, stating their qualified support of the
District:
Harry Gabriel, 901N. Bay Front, Balboa Island
Richard Beem, W. Fourth St.
Robert C. Theel, 31878 Camino Capistrano, Ste 278, San Juan Capistrano
Mr. Hal Butts informed the Council of estimated costs to the business
owners as a result of the Assessment District and the Seismic Ordinance.
The Council recessed at 10:44 p.m., and reconvened at 10:57 p.m., with the
same members present.
Speakers in favor of the District continued as follows:

Barbara Mathewson, 202 N. Main St.
Following testimony from the audience, the Council asked a few more tech-
nical questions of staff and of Start Wolcott, representative of Rutan and
Tucker, the bond counsel firm.
The Mayor closed the public hearing.
Following comments by Councilmembers, the MOTION made by Serrato to continue
the matter for sixty days was withdrawn.
The Council recessed at 11:59 p.m., and reconvened at 12:13 a.m., with the
same members present.
Following further discussion, MOTION was made by Serrato, seconded by
Luxembourger, to continue consideration of the following for thirty
days:

RESOLUTION NO. 81-140 - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF SANTA ANA FINDING AND DETERMINING
THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
PROPOSED IMPROVEMENTS WITHOUT FURTHER COMPLIANCE WITH
THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND
MAJORITY PROTEST ACT OF 1931.

RESOLUTION NO. 81-141 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA CONFIRMING THE ASSESSMENT,
ORDERING THE PROPOSED IMPROVEMENTS TO BE MADE, AND DE-
SIGNATING THE CITY TREASURER TO COLLECT AND RECEIVE
MONEY.

RESOLUTION NO. 81-142 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA AWARDING THE SALE OF IMPROVEMENT
BONDS TO THE LOW BIDDER.

ORDINANCE NO. NS-1599 - AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA PROVIDING FOR THE CONTRIBUTION
FROM THE GENERAL FUND TOWARD THE COST OF IMPROVEMENTS TO
BE CONSTRUCTED WITHIN ASSESSMENT DISTRICT NO. 246.
5) Rejection of bid from Donlan Corporation as non-responsive.

Award of contract to C & I Construction Co., Inc., Santa Ana,
the lowest responsive bidder to Design and Construct Down-
town Parking Facilities in the amount of $2,343,989.00.
7)
RESOLUTION NO. 81-143 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA AWARDING THE CONTRACT FOR
CONSTRUCTION OF IMPROVEMENTS.
