RESOLUTION NO. 81-72
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA AUTHORIZING
THE CHAIRMAN TO EXECUTE A COMMERCIAL REHA-
BILITATION AGREEMENT BETWEEN THE AGENCY AND
ELIZABETH PHILLIPS, LOUISE HUTTON, AND
AUDREY E. PHILLIPS FOR PROPERTY LOCATED AT
301/305 W. FOURTH AND 410 N. BROADWAY
AND PROVIDING FOR THE EXEMPTION OF SAID
PROPERTY FROM ACQUISITION BY THE AGENCY BY
EMINENT DOMAIN UPON CERTAIN CONDITIONS
BE IT RESOLVED by the Community Redevelopment
Agency of the City of Santa Ana as follow9:
I. The Chairman of the Agency is hereby
authorized to execute on behalf of the Agency that certain
agreement entitled .Commercial Rehabilitation Participation
Agreement, (301/305 W. Fourth and 410 N. Broadway),.
form dated 3/25/81, between the Agency and Elizabeth Phillips,
Louise Hutton, and AudreyE. Phillips, copies of which are
on file in the office of the Executive Director of the
Agency and to which reference is hereby made for full
particular9, which Agreement pertains to property
(hereinafter referred to as the "subject property")
specifically described in Exhibit A, attached hereto and
incorporated herein by reference.
2. The Executive Director is hereby authorized
to take all steps, and to sign all documents and instruments
necessary to implement and carry out thi9 Agreement on
behalf of the Agency.

3. Upon is9uance of a Certificate of Completion
pursuant to the abovesaid Agreement, the Executive Director
of the Agency shall cause this Re901ution to be recorded in
the Official Record9 of orange County. From and after the
date of such recordation, the 9ubject property shall be
exempt from acquisition by the AgenCy by eminent domain in
accordance with gection 33399(g) of the Community
Redevelopment Law, 9ubject to the condition that, in the
event of the substantial destruction of the building
rehabilitated pursuant to the abovesaid Agreement, said
exemption shall terminate.

EXHIBIT A
All that certain land situated in the State of California,
County of Orange, City of Santa Ana, described as follows:
Beginning at the southeast corner of Lot 16 of Birch Addition
to Santa Ana, as shown on a Map recorded in Book 3, Page 145,
of Miscellaneous Records of Los Angeles County, California,
running thence Easterly along the Easterly prolongation of the
Southerly line of said Lot 16, 125.11 feet to a point in the
Westerly line of Broadway, as located July 8,1925, which said
point is 125.20 feet southerly from the point of intersection
of said Westerly line of Broadway with the southerly line of
Fifth Street, as located on July 8,1925; thence southerly
along said Westerly line of Broadway 25 feet to a point; thence
Westerly parallel with first course herein described, 125 feet
to a point in the Easterly line of Lot 17 of said Birch Addition
to Santa Ana, and thence Northerly along the Easterly line of
said Lot 17,25 feet to the point of beginning.
That certain real property situated in the City of Santa Ana,
County of Orange, State of California described as follows:
Beginning at a point on the North line of Fourth Street, 130
feet West of the Southwest corner of Block 13 of the Town of
Santa Ana, as shown on a map recorded in Book 2, Page 51 of
Miscellaneous Records of Los Angeles County, California;
running thence North 100 feet parallel to the West line of
Broadway; thence East 50 feet parallel to the North line of
Fourth Street; thence South 100 feet parallel to the West line
of Broadway to a point on the north line of Fourth Street;
thence West 50 feet along the North line of Fourth Street to the
point of beginning.
That certain real property commonly known as 305 West Fourth
Street, City of Santa Ana, County of Orange, State of California
described as follows:
Beginning at a point on the North line of Fourth Street 130 feet
West of the Southwest corner of Block 13 of Santa Ana, as shown
on a Map recorded in Book 2, Page 51 of Miscellaneous ~s,
records of Orange County, California, running thence North 100
feet parallel to the West line of Broadway; thence West.. 25 feet
parallel to the North line of Fourth Street; thence South 100
feet parallel to the West line of Broadway to a point on the North
line of Fourth Street; thence East 25 feet along the North line
of Fourth Street to the point of beginning.
