RESOLUTION NO. 81-66
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA AUTHORIZING
THE CHAIRMAN TO EXECUTE A COMMERCIAL REHA-
BILITATION AGREEMENT BETWEEN THE AGENCY AND
JACK MC CULLOCH AND JOY R. MC CULLOCH
FOR PROPERTY LOCATED AT 214/216 AND
220 W. FOURTH STREET
AND PROVIDING FOR THE EXEMPTION OF SAID
PROPERTY FROM ACQUISITION BY THE AGENCY BY
EMINENT DOMAIN UPON CERTAIN CONDITIONS
.
BE IT RESOLVED by the Community Redevelopment
Agency of the City of Santa Ana as follows:
1. The Chairman of the Agency is hereby
authorized to execute on behalf of the Agency that certain
agreement entitled "Canmercial Rehabilitation Participation
Agreement, (214/216 and 220 W. Fourth Street),"
form dated 3/25/81, between the Agency and Jack Mc Culloch
and Joy R. Mc Culloch,
copies of which are on file in the office of the Executive
Director of the Agency and to which reference is hereby made
for full particulars, which Agreement pertains to property
(hereinafter referred to as the "subject property")
specifically described in Exhibit A, attached hereto and
incorporated herein by reference.

2. The Executive Director is hereby authorized
to take all steps, and to sign all documents and instruments
necessary to implement and carry out this Agreement on
behalf of the Agency.

3. Upon issuance of a Certificate of Completion
pursuant to the abovesaid Agreement, the Executive Director
of the Agency shall cause this Resolution to be recorded in
the Official Records of Orange County. From and after the
date of such recordation, the subject property shall be
exempt from acquisition by the Agency by eminent domain in
accordance with section 33399(g) of the Community
Redevelopment Law, subject to the condition that, in the
event of the substantial destruction of the building
rehabilitated pursuant to the abovesaid Agreement, said
exemption shall terminate.

All that certain parcel of real property situated in the
State of California, County of Orange, City of Santa Ana,
described as follows:
The Westerly 72.66 feet of the Easterly 83.32 feet of Lots
7 and 10 in Block 12 of the Town of Santa Ana, as shown in
that certain map recorded in Book 2, Page 51 of Miscellaneous
Records of Los Angeles County, California.
