MC CULLOCH FOR PROPERTY LOCATED AT 108 W. FOURTH AND PROVIDING FOR THE EXEMPTION OF SAID PROPERTY FROM ACQUISI-TION BY THE AGENCY BY EMINENT DOMAIN UPON CERTAIN CONDITIONS BE IT RESOLVED by the Community Redevelopment Agency of the City of Santa Ana as follows: 1. The Chairman of the Agency is hereby authorized to execute on behalf of the Agency that certain agreement entitled "Commercial Rehabilitation Participation Agreement, (108 W. Fourth)," form dated 3/25/81, between the Agency and Jack Mc Culloch and Joy R. Mc Culloch, copies of which are on file in the office of the Executive Director of the Agency and to which reference is hereby made for full particulars, which Agreement pertains to property (hereinafter referred to as the "subject property") specifically described in Exhibit A, attached hereto and incorporated herein by reference. 2. The Executive Director is hereby authorized to take all steps, and to sign all documents and instruments necessary to implement and carry out this Agreement on behalf of the Agency. Upon issuance of a Certificate of Completion pursuant to the abovesaid Agreement, the Executive Director of the Agency shall cause this Re90lution to be recorded in the Official Records of Orange County. From and after the date of such recordation, the subject property shall be exempt from acquisition by the Agency by eminent domain in accordance with section 33399(g) of the Community Redevelopment Law, subject to the condition that, in the event of the substantial destruction of the building rehabilitated pursuant to the abovesaid Agreement, said exemption shall terminate. RECORDING SECRETARY APPROVED AS TO FORM: ~o~h AGENCY LEGAL COUNSEL 8 /9--IS- st\ Y" . , 8 8 8 1 EXHIBIT A All that certain land situated in the State of California, County of Orange, City of Santa Ana, described as follows: That portion of Lots 8 and 9 in Block 11 of the Town of Santa Ana, as per map thereof recorded in Book 2, Page 51 of miscellaneous records of Los Angeles County, California, bounded and described as follows: Beginning at a point 75 feet west of the northeast corner of Block 11 and running thence south 100 feet; thence west 25 feet to the east line of the land described in the deed to Fred Newcomb and Dora Newcomb dated September 7,1943 and filed for record September 29, 1943 in the office of the County Recorder of said Orange County; thence north along the east line of said land conveyed to Fred Newcomb and Dora Newcomb 100 feet; thence east 25 feet to the point of beginning. 2, 5!\.
