HomeMy WebLinkAboutA-2004-266A A-2004-266 H 2 SECOND AMENDMENT TO AGREEMENT BETWEEN COUNTY OF ORANGE AND THE CITY OF SANTA ANA 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 THIS SECOND AMENDMENT is entered into this 15 day of December 2004, which date is enumerated for purposes of reference only, by and between the County of Orange, a political subdivision 0 the State of California, hereinafter referred to as "COUNTY" and the City of Santa Ana, hereinafter referred to as "CONTRACTOR", to amend the certain Agreement between the parties commencing October 1,2003, pertaining to the provision of Workforce Investment Act services, hereinafter referred to as "the Act." WITNESSETH WHEREAS, the parties desire to extend the term of the Agreement for an additional nine Months, from December 31, 2004 to September 30, 2005; NOW, THEREFORE, IT IS MUTUALLY AGREE)) AS FOLLOWS: 1. Paragraph I, under "TERM", page 4, of the Agreement is amended to read as follows: This Agreement shall be extended from the period beginning October 1,2003 through September 30, 2005. upon approval by COUNTY's Board of Supervisors, as provided for under the Act and or subsequent federal and state guidelines. CONTRACTOR agrees that any and all funds received under this extension to the Agreement shall be disbursed or encumbered on or before September 30, 7005 and that any and all funds remaining as of SePtember 30, 2005, which have no been disbursed or encumbered shall be returned by CONTRACTOR to the COUNTY. COUNTY will not reimburse any expense of CONTRACTOR if incurred after September 30, 2005. No CONTRACTOR expenses shall be paid if billing is received by COUNTY after November 10. 2005.
