W. Luxembourger. Councilmembers present were John Acosta, Gordon Bricken, Daniel E. Griset, P. Lee Johnson, Patricia A. McGuigan, Dan Young, and Mayor Luxembourger. Also present were City Attorney Edward J. Cooper, Clerk of t/le Council Janice C. Guy, and Paul Reaume of PARA, Inc., the firm hired by the City to recruit a new City Manager. The Council Lmmediately recessed to Executive Session for personnel purposes. W. Luxembourger. Councilmembers present were John A~osta, Gordon Bricken, P. Lee Johnson, Patricia A. McGuigan, Dan Young, and Mayor Luxembourger. Also present were Interim City Manager Rex Swanson, City Attorney Edward J. Cooper, Clerk of the Council Janice C. Guy, and members of the City's Executive Management staff. Councilmember Daniel E. Griset joined the meeting at 4:26 p.m. WORK STUDY SESSION - ICE CREAM TRUCK O~DINANCE The Director of Planning & Development Services briefly reviewed possible components for a proposed ordinance relative to ice cream trucks. Councilmember Gordon Bricken inquired as to whether staff had investigated all options for signalling prospective customers. The Council then discussed enforcement problems relating to banning the trucks entirely and banning noise devices on the trucks. MOTION: Instruct the City Attorney to develop an ordinance banning ice cream trucks from the City of Santa Ana. MOTION: Griset SECOSD: Young Following discussion, the motion was withdrawn by the maker and second. At the request of Counci~r M~Guigan, staff agreed to place the ice cream truck ordinance on the evening agenda of the December 5 moeting. TRANSi~q/9~ION SALES TAX (1 CENT BALLOT ~URE) The Director of Transportation introduced Ron Cole, Orange County Transportation Co~mission, and Brian Pearson, Orange County Transportation District, indicating they would report on the Orange County Transportation Con~lission 15-year investment strategy. Mr. Cole provided an overview of the procedures and the schedule for the ballot measure relative to the one-cent sales tax increase. He explained 5~ percent of the proceeds would be allocated to highways, 25 percent to transit development and transit development and 2~ to 25 percent turned back to local municipalities. He also noted that the measure must be approved by 5~ percent of the County's population, as well as 5~ percent of the cities and the Board of Supervisors before the measure may be placed on the ballot. Mr. Pearson addressed the transit element of the 15-year investment plan explaining that the north-south leg would run from Fullerton to the John Wayne Airport and South Coast Plaza, and that the east-west portion would begin in Buena Park and terminate at the Santa Ana Transportation Center o He indicated that the City would be provided with an opportunity to comment on the design of the project and that the cost was projected at $762 million. The Director of Transportation then explained local turnback options, which included returning various percentages to municipalities for unrestricted use and allocating various percentages to arterial or project use. Councilmember Young expressed his preference for the plan which would allow most local discretion, while Councilmember Bricken suggested that Santa Ana endorse the plan favored by the majority of Orange County cities. Councilmember Griset reminded the Councilmembers of the need to maintain co~.itment to Countywide values. CONCEPTUAL PLAN FOR BOWERS MUSEU~ - NDN-PRfFIT C(~SORATION Interim City Manager Swanson indicated that staff was ready to respond to any questions relative to the proposed agreement for the operation of the Bowers Museum, but the Council had no questions on the subject. Councilmembers then discussed their concerns relative to Consent Calendar items. The Council recessed to Executive Session at 6 :~4 p.m., and reconvened at 6:17 p.m., with all m~mbers present. The City Attorney reported that the City had submitted its last, best and final offer relative to employee negotiations to the Police Benevolent Association and indicated that the contract had not been accepted by the Association to date. He also stated there was no need for a public hearing on the matter. Seth Kelsey, 16~ N. Broadway, provided each Councilmember with a copy of a report entitled, "Santa Ana Police Deportment Alternative Patrol Allocation Feasibility Study." He then addressed Council, /ndicating the Police Benevolent Association's concern with the cap on m~dical benefits and the need to amend the last, best and final offer to include alternative manpower scheduling for police personnel. George Sullivan, 3115 Serrano Drive, Carlsbad, addressed Council, indicating that alternative manpower scheduling was feasible and would not result in additional cost to the City. Seth Kelsey again addressed the Council reiterating the Police Benevolent Association position.
