RECITALS: A. The parties entered into Consultant Agreement N-2004-081, dated July 1,2004, (hereinafter "said Agreement") by which Consultant has provided asbestos, lead based paint and microbial consulting services. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend the term of said Agreement for an additional one-year period, amend the fee schedule and increase compensation. WHERERFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: I. Section 2, COMPENSA nON, shall be amended to replace the applicable fee schedule and increase Compensation by $10,000.00 by deleting said section 2 in its entirety and replacing it with the following: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A-I, attached hereto. The total sum to be expended under this Agreement shall not exceed $10,000.00, annually, during the term of this Agreement." 2. Section 3, TERM, shall be extended through June 30, 2006.
