WITNESSETH RECITALS: 1. CITY and SUPERINTENDENT entered into an agreement dated August 1, 1997, ("AGREEMENT") which allowed SUPERINTENDENT access to inmates in order to administer GED testing. 2. In accordance with the terms and conditions of the AGREEMENT, CITY and SUPERINTENDENT wish to renew the AGREEMENT for an additional one (1) year period, in conformance with paragraph 1.0 (Term) of the AGREEMENT. 3. In accordance with the terms and conditions of the AGREEMENT, CITY and SUPERINTENDENT wish to adjust the fees for the GED testing to each inmate to Fifty-one dollars ($51.00), in conformance with paragraph 2.0(Duties and Responsibilities). WHEREFORE, in consideration of the mutual and respective covenants and promises contained in the AGREEMENT, and subject to all of the terms and conditions of the AGREEMENT, except those amended in the THIRD AMENDMENT TO AGREEMENT, CITY and SUPERINTENDENT hereby agree to amend paragraph 1 of the AGREEMENT and extend the AGREEMENT for one (1) additional year (August 1, 2000 to July 31, 2001) and also increase the fees identified in paragraph 2.0 (Duties and Responsibilities) to Fifty-one dollars ($51.00) per test. Paragraph 1, as amended shall read, as follows: 1.0 Term This MOU shall be effective for a period of one (1) year commencing '-' Page 2 ~ August 1, 2000 and continuing through July 31, 2001, and may be renewed on an annual basis for a period of one (1) additional year from the effective date, unless sooner terminated by any of the parties in accordance with Section 12.0. Paragraph 2.0, as amended shall read, as follows: 2.0 Duties and Responsibilities. A. SUPERINTENDENT agrees to: 1. Administer GED testing to inmates housed in the JAIL. 2. Provide GED testing materials, equipment and supplies necessary to administer the GED testing. 3. Administer one (1) session GED testing per month which consists of two (2) consecutive days of testing from 10:00 a.m. through 3:30 p.m. 4. Provide the examinees' GED test scores wi thin two (2) working days after they have been received from the state GED office. 5. Provide a yearly schedule of GED testing dates to CITY. 6. Charge each inmate the following rates for the GED Testing: 1. Test #1 - Writing Skills $ 6.00 (includes $3.00 fee for composition) 2. Test #2 - Social Studies $ 6.00 3. Test #3 - Science $ 6.00 4. Test #4 - Literature $ 6.00 5. Test #5 - Mathematics $ 6.00 6. Essay Fee $ 3.00 7. State and GED Office $12.00 Registration/GED Certificate 8. American Council on Education $ 6.00 TOTAL $51. 00 Per Test Retesting Fees: '-" Page 3 .I 1. Test #1 - Writing Skills 2. Tests #2-5 $ 8.00 per test. $5.00 per test. 7. Inform CITY and examinees of any increase in fees that are due to the General Educational Testing Center of the American Counsel on Education rate adjustments. B. CITY agrees to: 1. Provide a secure testing room with adequate space and testing stations, i.e., desks, tables, chalkboard, clock or other means of displaying written directions for SUPERINTENDENT to conduct GED testing prior to each scheduled testing. 2. Make certain that examinees arrive on time for each scheduled testing in order for the testing to operate on schedule. 3. Assign one (1) detention officer to remain inside the testing room when the GED testing is being administered for safety purposes. 4. Provide and validate parking spaces for SUPERINTENDENT's employees to conduct the GED testing. 5. Provide lunches for examinees in testing room. 6. Provide breaks when necessary for SUPERINTENDENT's staff to use the restroom facilities. 7. Collect the GED testing fees from the examinees and transfer the funds to SUPERINTENDENT on a monthly basis. 8. The total funds to be expended during the one-year term of this AGREEMENT shall not exceed $10,000.00. All other terms and conditions shall remain unchanged. , .
