Revised 8-7-03 Signature: Date: City of Santa Ana Clerk of the Council r<FFS (t 36 tic: 3,i5—ocp CONSULTANT AGREEMENT A-2006-022 0: L'RO Czl THIS AGREEMENT, made and entered into this 27 day of February, 2006 by and between ELIZABETH MOULE & STEFANOS POLYZOIDES, ARCHITECTS AND URBANISTS, a California corporation (hereinafter "Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). RECITALS A. The City desires to retain a consultant having special skill and knowledge in the field of preparing planning documents, such as Specific Plans and related technical studies. B. Consultant represents that Consultant is able and willing to provide such services to the City. C. In undertaking the performance of this Agreement, Consultant represents that it is knowledgeable in its field and that any services performed by Consultant under this Agreement will be performed in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: 1. SCOPE OF SERVICES Consultant shall perform those services necessary to preparation of the Renaissance Specific Plan and related technical studies, as set forth in Exhibit A to this Agreement. 2. COMPENSATION a. City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Consultant's Fee Proposal, attached hereto as Exhibit B. The total sum to be expended under this Agreement shall not exceed $528,000.00 during the term of this Agreement. b. Payment by City shall be made within thirty (30) days following receipt of proper invoice evidencing work performed, subject to City accounting procedures. Payment need not be made for work which fails to meet the standards of performance set forth in the Recitals which may reasonably be expected by City. 3. TERM This Agreement shall commence on the date first written above and terminate upon final City Council approval of the Renaissance Specific Plan, unless terminated earlier in accordance with Section 12, below. 4. WORK PRODUCT Consultant shall deliver to City all work -product which results from the services provided. Said work product shall be submitted in a hard copy and in a digital form compatible with City's computer system, as agreed between the Project Manager and Consultant. In regard to any copyrightable material produced as a deliverable under the Agreement, including but not limited to books, reports, plans, photographs, drawings, films, recordings, videotapes, and computer programs, Consultant agrees and shall ensure that all of Consultant's affected officers, employees, agents, contractors, and volunteer workers also agree that (a) other such material may not be copyrighted without prior review from the City; and (b) the authors of all such material, whether copyrighted or not, award to the City, and to its officers, agents and employees acting within the scope of their official duties, as a condition of payment to the Consultant, a royalty -free, nonexclusive, irrevocable license throughout the world for governmental purposes to disclose, publish, translate, reproduce, and use such materials. 5. INDEPENDENT CONTRACTOR Consultant shall, during the entire term of this Agreement, be construed to be an independent contractor and not an employee of the City. This Agreement is not intended nor shall it be construed to create an employer-employee relationship, a joint venture relationship, or to allow the City to exercise discretion or control over the professional manner in which Consultant performs the services which are the subject matter of this Agreement; however, the services to be provided by Consultant shall be provided in a manner consistent with all applicable standards and regulations governing such services. Consultant shall pay all salaries and wages, employer's social security taxes, unemployment insurance and similar taxes relating to employees and shall be responsible for all applicable withholding taxes. 6. INSURANCE Prior to undertaking performance of work under this Agreement, Consultant shall maintain and shall require its subcontractors, if any, to obtain and maintain insurance as described below: a. Reserved. b. Reserved. c. Worker's Compensation Insurance. In accordance with the provisions of Section 3300 of the Labor Code, Consultant, if Consultant has any employees, is required to be insured against liability for worker's compensation or to undertake self-insurance. Prior to commencing the performance of the work under this Agreement, Consultant agrees to obtain and maintain any employer's liability insurance with limits not less than $1,000,000 per accident. d. Professional liability (errors and omissions) insurance, with a combined single limit of not less than $1,000,000 per claim. e. The following requirements apply to the insurance to be provided by Consultant pursuant to this section: (i) Consultant shall maintain all insurance required above in full force and effect for the entire period covered by this Agreement. (ii) Certificates of insurance shall be furnished to the City upon execution of this Agreement and shall be approved in form by the City Attorney. (iii) Certificates and policies shall state that the policies shall not be canceled or reduced in coverage or changed in any other material aspect without thirty (30) days prior written notice to the City. f. If Consultant fails or refuses to produce or maintain the insurance required by this section or fails or refuses to furnish the City with required proof that insurance has been procured and is in force and paid for, the City shall have the right, at the City's election, to forthwith terminate this Agreement. Such termination shall not effect Consultant's right to be paid for its time and materials expended prior to notification of termination. Consultant waives the right to receive compensation and agrees to indemnify the City for any work performed prior to approval of insurance by the City. 7. INDEMNIFICATION Consultant agrees to and shall indemnify and hold harmless the City, its officers, agents, employees, consultants, and representatives from liability: (1) for personal injury, damages, just compensation, restitution, judicial or equitable relief arising out of claims for personal injury, including health, and claims for property damage, which may arise from the negligence, willful misconduct, errors or omissions of the Consultant or its contractors, subcontractors, agents, employees, or other persons acting on their behalf which relates to the services described in section 1 of this Agreement; and (2) from any personal injury, damages, just compensation, restitution, judicial or equitable relief, to the extent caused by the negligence, willful misconduct errors or omissions of Consultant or its contractors, subcontractors, agents, employees or other persons acting on their behalf. This indemnity and hold harmless agreement applies to all damages, just compensation, restitution, judicial or equitable relief suffered by reason of the events referred to in this Section or by reason of the terms of, or effects, arising from this Agreement, to the extent caused by the negligence, willful misconduct, errors or omissions of the Consultant or its contractors, subcontractors, agents, employees or other persons acting on its behalf in the performance of this Agreement. City may make all reasonable decisions with respect to its representation in any legal proceeding. 8. CONFIDENTIALITY If Consultant receives from the City information which due to the nature of such information is reasonably understood to be confidential and/or proprietary, Consultant agrees that it shall not use or disclose such information except in the performance of this Agreement, and further agrees to exercise the same degree of care it uses to protect its own information of like importance, but in no event less than reasonable care. "Confidential Information' shall include all nonpublic information. Confidential information includes not only written information, but also information transferred orally, visually, electronically, or by other means. Confidential information disclosed to either party by any subsidiary and/or agent of the other party is covered by this Agreement. The foregoing obligations of non-use and nondisclosure shall not apply to any information that (a) has been disclosed in publicly available sources; (b) is, through no fault of the Consultant disclosed in a publicly available source; (c) is in rightful possession of the Consultant without an obligation of confidentiality; (d) is required to be disclosed by operation of law; or (e) is independently developed by the Consultant without reference to information disclosed by the City. 9. CONFLICT OF INTEREST CLAUSE Consultant covenants that it presently has no interests and shall not have interests, direct or indirect, which would conflict in any manner with performance of services specified under this Agreement. 10. NOTICE Any notice, tender, demand, delivery, or other communication pursuant to this Agreement shall be in writing and shall be deemed to be properly given if delivered in person or mailed by first class or certified mail, postage prepaid, or sent by telefacsimile or other telegraphic communication in the manner provided in this Section, to the following persons: To City: Clerk of the City Council City of Santa Ana 20 Civic Center Plaza (M-30) P.O. Thereafter, any communication shall be addressed and transmitted to the new address. If sent by mail, communication shall be effective or deemed to have been given three (3) days after it has been deposited in the United States mail, duly registered or certified, with postage prepaid, and addressed as set forth above. if sent by telefacsimile, communication shall be effective or deemed to have been given twenty-four (24) hours after the time set forth on the transmission report issued by the transmitting facsimile machine, addressed as set forth above. For purposes of calculating these time frames, weekends, federal, state, County or City holidays shall be excluded. 11. EXCLUSIVITY AND AMENDMENT This Agreement represents the complete and exclusive statement between the City and Consultant, and supersedes any and all other agreements, oral or written, between the parties. In the event of a conflict between the terms of this Agreement and any attachments hereto, the terms of this Agreement shall prevail. This Agreement may not be modified except by written instrument signed by the City and by an authorized representative of Consultant. The parties agree that any terms or conditions of any purchase order or other instrument that are inconsistent with, or in addition to, the terms and conditions hereof, shall not bind or obligate Consultant nor the City. Each party to this Agreement acknowledges that no representations, inducements, promises or agreements, orally or otherwise, have been made by any party, or anyone acting on behalf of any party, which are not embodied herein. 12. ASSIGNMENT Inasmuch as this Agreement is intended to secure the specialized services of Consultant, Consultant may not assign, transfer, delegate, or subcontract any interest herein without the prior written consent of the City and any such assignment, transfer, delegation or subcontract without the City's prior written consent shall be considered null and void. Nothing in this Agreement shall be construed to limit the City's ability to have any of the services which are the subject to this Agreement performed by City personnel or by other consultants retained by City. 13. TERMINATION This Agreement may be terminated by the City upon thirty (30) days written notice of termination. In such event, Consultant shall be entitled to receive and the City shall pay Consultant compensation for all services performed by Consultant prior to receipt of such notice of termination, subject to the following conditions: a. As a condition of such payment, the Executive Director may require Consultant to deliver to the City all work product completed as of such date, and in such case such work product shall be the property of the City unless prohibited by law, and Consultant consents to the City's use thereof for such purposes as the City deems appropriate. b. Payment need not be made for work which fails to meet the standard of performance specified in the Recitals of this Agreement, 14. DISCRIMINATION Consultant shall not discriminate because of race, color, creed, religion, sex, marital status, sexual orientation, age, national origin, ancestry, or disability, as defined and prohibited by applicable law, in the recruitment, selection, training, utilization, promotion, termination or other employment related activities. Consultant affirms that it is an equal opportunity employer and shall comply with all applicable federal, state and local laws and regulations. 15. JURISDICTION -VENUE This Agreement has been executed and delivered in the State of California and the validity, interpretation, performance, and enforcement of any of the clauses of this Agreement shall be determined and governed by the laws of the State of California. Both parties further agree that Orange County, California, shall be the venue for any action or proceeding that may be brought or arise out of, in connection with or by reason of this Agreement. 16. PROFESSIONAL LICENSES Consultant shall, throughout the term of this Agreement, maintain all necessary licenses, permits, approvals, waivers, and exemptions necessary for the provision of the services hereunder and required by the laws and regulations of the United States, the State of California, the City of Santa Ana and all other governmental agencies. Consultant shall notify the City immediately and in writing of her inability to obtain or maintain such permits, licenses, approvals, waivers, and exemptions. Said inability shall be cause for termination of this Agreement. 17. MISCELLANEOUS PROVISIONS a. Each undersigned represents and warrants that its signature hereinbelow has the power, authority and right to bind their respective parties to each of the terms of this Agreement, and shall indemnify City fully, including reasonable costs and attorney's fees, for any injuries or damages to City in the event that such authority or power is not, in fact, held by the signatory or is withdrawn. b. All Exhibits referenced herein and attached hereto shall be incorporated as if fully set forth in the body of this Agreement. About Moule & Polyzoides and our team of consultants Moule & Polyzoides is an architectural and urbanism firm accomplished in produc- ing plans for distinctive, compact transit -oriented development, and the districts and neighborhoods that surround them. Much of our recent work has been in reclaiming underdeveloped land within cities to reconnect with the community in ways that extracts greater value and quality of place out of existing physical settings. This is an attitude diametrically opposed to the prevalent practice of fixed -end, "build it my way or perish", master planning that is not based on place but on formula. Our work unfolds by design iterations through various design options and crystallizes in com- monly understood and supported final recommendations and sequences of actions. The consequences of these actions are often more important than the actions them- selves, and our planning process seeks to expose them as clearly as possible. More specifically, with your assistance, we suggest that you identify every person, group or agency that has a stake, or has some regulatory responsibility in, the project. MOULE & POLYZOIDEs, ARCHITECTS AND URBANISTS SANTA ANA RENAISSANCE SPECIFIC PLAN PROPOSAL C I WORK PLAN - PROJECT UNDERSTANDING While there are many issues involved in such a project, we have experienced that there are typically key issues which, due to their particular influence to other aspects of the project, need to be identified for early strategic guidance. In this way, we devel- op a work program that fundamentally addresses the key issues to guide the project toward success. In reviewing the RFP and the City's goals for the project area and after touring the site recently, we understand the subject matter of this project to encompass the following key issues: Integrated, Creative, and'Turn-Key' Plan Our approach to planning and implementation is based on the premise that upon der ifying what it is that the community desires, those outcomes should be incen- tivized to be realized as soon as possible. We take pride in producing plans that are realistic, innovative and tailored to their place. Also, we work to eliminate the need for future guidelines, 'bridging plans' or other such additional documents. To address this issue, we propose to produce a Plan that is comprehensive, clear, con- cise and compelling toward producing results. Concurrent with the early research tasks, we propose to address the manufacturing areas so that the issue is expedited and so that the results can be incorporated into the process of preparing the Specific Plan. The Specific Plan will integrate the required project components into the appro- priate chapters. Community -wide Circulation It is fundamental that we not only solve circulation issues for the project area itself but also for the immediate neighborhoods and larger transportation and circulation framework that supports the project area. We realize that the responsibility is on the project team to clearly convey the associated results of the various scenarios that we will evaluate and pursue. This is necessary both for the technical success of the proj- ect and for grass-roots support and credibility throughout the process. With the larg- er issues in mind, the project can be effectively maximized for connectivity with and support by the adjacent neighborhoods in all directions. To address this Issue, we will prepare an overall transportation and circulation framework that will inform the structure of the project area, adjacent neighborhoods and larger system. Economic Development The ability to maximize the asset that a mature downtown represents is of high importance and an intrinsic responsibility of this effort. To this end, the programmat- ic strategy for all types of development, particularly employment, office and housing, needs to reflect the area's profound and intrinsic opportunities. The project repre- sents the opportunity to both set forth a positive trajectory for reinvestment and regeneration while appropriately completing Santa Ana's historic center. Demand is rising for housing, office and retail in such places, raising the interest of investors, reducing family transportation expenses, increasing the share of walking and transit trips, and enabling the public and private sectors to improve the quality of life. To address this issue, we will incorporate economic direction from the outset, with refinement of information and direction throughout the process until the desirable scenario and outcomes are identified. Design A Form -Based Code will address context and relationship issues. Santa Ana's significant historic context and public realm are being diluted through weak private realm responses. Areas of disinvestment must capture new development in ways that will create a strong public realm and sense ofplace Immediately adjacent to the specific plan area, the French Park neighborhood provides authentic architecture and a strong sense of place Above and beyond all of the community -related and technical work that will occur, the tool that will help us all realize and give it meaning is design. Upon understand- ing the sites from programmatic and appropriateness perspectives, the desired out- comes must be the result of design solutions based on the Santa Ana's heritage and patterns. Careful study and application of relevant design -precedents is critical and extremely useful in educating one another about the possibilities that, in other cases, may have seemed unattainable. We bring a depth of design experience and commit- ment to the creation of tailored results that are based on a serious understanding of appropriate typological precedents for this area. The result will be desired outcomes for the range of subjects involved that are clearly identifiable and quantifiable for Santa Ana to call its own. To address this issue, we will keep the physical outcomes and opportunities on a parallel path constantly informed, shaped and refined by all of the supporting disciplines. Execution Upon identifying the desired outcomes in appropriate detail, it is then necessary to provide a clear and useful set of implementing measures and regulations to consist- netly achieve those outcomes. We see two components in this regard: a) measures and provisions that enable financing, phasing and implementation and, b) develop- ment regulations that enable and require the type of desired outcomes. Implementation Measures - We propose to provide an integrated and comprehen- sive implementation chapter (chapter 3) in the Specific Plan. This chapter will iden- tify the necessary infrastructure, the associated planning -level cost -estimates, fund- ing sources, timing needs and, interdependencies upon other infrastructure or proj- ects. Chapter 3 will identify public or private catalytic projects (in the same detail) that produce substantial momentum for the plan. Chapter 3 will provide the individ- ual details of catalytic projects and infrastructure In a clear and visually compelling manner to help bring life to this key element of the Plan. This chapter will transform the intent of the plan to be fiscally positive through the individual public and private initiatives that, over time, will produce the desired results: a thriving downtown that supports and is supported by reemerging and vital neighborhoods. Development Regulations - We propose a 'form -based' development code in its own chapter (q) of the Specific Plan. This type of code and regulations is a superior tool to the standard zoning tools and guidelines as it is far more sensitive and adjustable than conventional zoning. Most importantly, it is based on physical results as com- pared to standard zoning which is not. This tool addresses the legal requirements of zoning wh ile placing emphasis on achieving the range of desired outcomes. This will be done through an integrated set of regulatory components: a) Regulating Plan (a 3-dimensional zoning map that integrates public realm and private realm require- ments), b) Zones (based on intensity, form, and land use), c) Public Realm Types (requirements for all open spaces and streets in the plan), d) Building Types (config- urations that are allocated throughout the plan to comprise the assembled project area), e) Frontage Types (requirements for how buildings react to and shape the pub- lic realm depending upon their location in the plan) and, f) Architectural Style (care- fully documented precedents from the area that provide clear direction for continu- ing the traditions that people recognize as their own). Such a code rewards those for doing the desired result instead of having to reward them for pursuing it in the first place. PLAN TASKS Task 1: Project Initiation, Fieldwork, Interviews, Analysis Weeks 1-6: Ian 3 to Feb io We propose the following scope of work to accomplish the needs identified by the City in the RFP. For the purposes of this proposal, we assume the schedule begin- ning January 3, 2005 per the RFP. We propose to accomplish the schedule by using the charrette process. We conduct the vast majority of our planning projects in this manner and receive consistent high marks from everyone involved. We are experts at this process in that we understand what needs to be invested in the beginning, during and the end of the process to realize effective and desired change. We understand the long-term substantial bene- fit of early, relationship -building with the community and stakeholders. Not only do we achieve Inspired results In less time, but we use people's time more effectively and create genuine momentum often absent or diminished through longer process- es. Through the charrette, the consultant team gets maximum results out of each team member by working more intensely and collaboratively than in typical planning efforts: you have our collective, undivided attention on the project with synergy and maximum creativity. Very few teams can effectively work in this manner due to the numerous intricacies and needs of the process and project. We are one of those few who have proven over time to work successfully in this way. Last, while we clearly pre- fer and propose the charrette process, we are prepared to discuss modifications with you if you so desire. However, the budget would require adjustment. Purpose: To familiarize the team, staff and the decision -makers with all of the rele- vant information, requirements and range of preliminary Ideas about the site for early direction and preparation for the Charrette. Kickoff Meeting Week 1: We will facilitate the initial meeting with City staff and any other parties the city invites, to review the project scope, finalize the work program/schedule and con- firm key project issues and goals. For efficiency purposes, we propose to include this meeting as the initial portion of our on-site 'Pre-Charrette' work. Pre-Charrette Work Weeks 1-3: Here, we focus on gaining the necessary information with which to pre- pare a series of 'x-ray' diagrams of the project area for a variety of subjects ranging from historic resources, open space, traffic and transit, parking, walkability, econom- ics and development patterns. We will tour the project area with City staff and con- duct interviews with the appropriate staff and interested parties to gain additional insight and direction. Week 4: We will meet with City staff to present the work to date on analysis and inter- views to prepare for Joint Study Session I. We propose joint study sessions to accom- plish the 10 month schedule and to maximize interaction between all intersted par- ties. Week 6: We will present the following to the Planning Commission in a study ses- sion: a) findings and recommendations about the sites, b) principles of Traditional Neighborhood Development as they apply to the project sites, c) 3 Scale and Comparison studies for the project site about the 'possibilities' and, d) site bound- ary alternatives. This task focuses on taking the knowledge and base -information gained in task C -i to produce the desired outcomes that will become the constituent elements of the Specific Plan. Because the community would like to move expeditiously toward tan- gible results, we propose the charrette as the method to seriously engage the com- munity and identify the desired outcomes to pursue with the Plan area. The Charrette Through the course of the 5 -day charrette, participants will participate in and see the strategies formed by the team that will lead to the preparation of design solutions for the various subjects. Using the interview results from task C -i, the team embarks on ideas and solutions that are applicable and in the realm of possibility and acceptance by the community. Throughout each day, the team holds working meetings for par- ticular subjects with the appropriate parties. By Involving the public and any other stakeholders (e.g., owner's groups, merchants, traffic engineers, public works staff - planning staff, etc.), the team's work progresses confidently toward completion. At the end of each day, the structural content of the Specific Plan evolves and the progress is presented to the participants for review and comment. Each day builds upon the next with participants clearly seeing the progress and results. The charrette concludes with a final presentation to the community by the consultant team. However, depending upon the issues and needs, we also provide daily summary pre- sentations throughout the charrette. On the last day of the charrette, the consensus structural content for the Specific Plan will be presented for review and comment. Community Participation Community Participation will be carried out with patience and enthusiasm by the consultant team in English, and in Spanish if necessary. The Principal in charge of this project, Stefanos Polyzoides, is fluent in Spanish as are several members of the team. Mr. Polyzoides, a former professor at University of Southern California for 20 years is an accomplished public speaker, energetic and effective team leader having conducted over 50 charrettes of this complexity. As all our projects occur largely in the public arena, we are committed to meaningful community involvement that directly involves the community as well as City staff and officials, and have an impressive track record of success in gaining consensus on a wide variety of com- plex and difficult projects. The team is comprised of effective and approachable com- municators and has substantial experience in positively communicating with the public, avoiding the use of jargon or overly technical terms. We understand the com- munity's desire to move expeditiously and propose that the charrette, as we execute it, is the appropriate outreach method. This method of planning enlightens, empow- ers and engages the community because the process brings people with varied inter- ests together to focus on what can happen. We are often in the position of mediator and use our team's depth of experience and talent to both help people envision change and to understand its implications. We submit this information as clarification to the proposed scope of work submitted for this project dated November 18, 2005. We reserve the right to further clarify or respond to new information as it relates to these or any other tasks for this project as issues arise throughout this project. Item t: Clarify the charrette program, including the modifications needed to accommodate the 5 or 6 distinct geographic areas and/or interested stakeholders within the study area. Response: The charrette is the method by which we develop the individual solutions to the overall effort of preparing a plan for the project area. Over the course of the charrette, those solutions are prepared in response to direction and input from the community. Each solution builds on the next until there is a consensus plan supported by all of the individual accomplishments (quantitative and qualitative). To have an effective charrette, it is first necessary to conduct what we call 'pre-charrette' work in the following areas: Pre-Charrette Work a. Interviews of applicable city/ county/ other public agency staff Each team member speaks with their counterpart in the applicable agency to gain understanding of that agency's or a department's needs, requirements and/or expectations as it relates to the project; b. Understanding the Geography of the Project Area Moule & Polyzoides staff meets with city staff to communicate on and understand the geography of the area from physical, regulatory and political perspectives. With this understanding, the public outreach program is tailored to those specifically identified areas/groups. c. Analytical Work Each team member analyzes their respective areas and submits the work to Moule & Polyzoides for the preparation of a catalog that becomes the first public document to be published for the project. d. Pre-Charrette Catalog With each team member's analysis complete, Moule & Polyzoides prepares this ii x 17, color, catalog and submits z copies to the city along with an electronic (PDF) copy for publication on the city's website. Additional copies are available at a cost of approximately $50 per copy. This catalog is for the purpose of everyone being able to both see and examine what we've found and to be able to communicate about with each other it in an effective way. The contents of the catalog will then be used in all preliminary outreach and discovery workshops. Response: Outreach Program: The outreach program consists of two general components: a) A series of Discovery Workshops with each of the geographic areas we identify above in phase i will be held prior to the pre-charrette study session. Stefanos discussed with you that this is most likely between 4 and 5 based and intended to focus on the issues, needs and objectives of each geographic area. b) Per the RFP, five joint Study Sessions with the Planning Commission and City Council (including the Redevelopment Commission and Historic Resources Commission). It is the goal to consolidate these sessions as practical. Discovery Workshops Scope and Purpose — These are between 4 and 6 hours in length for the purpose of communicating with a particular geographic area of the community and the associated stakeholder groups within it (e.g., neighborhood groups, merchants' association, bicycle coalition, etc.). At these workshops, we will present what we've learned about the particular area in relation to the overall downtown. In this way, we begin the dialogue with each area and gain a deeper understanding of the issues and needs as well as begin a relationship that will take all of us through the process over the next year. At the end of each discovery workshop, we expect to have: a) refined/corrected analysis, b) detailed list of comments received, c) summary of direction/input from participants. Each workshop will be represented in a catalog to be produced at the end of this process (Post -Discovery Workshop Catalog) for all participants to use in communicating about the project and for the consultant team to use in preparing for the charrette (2, It x 17 color copies and PDF version for web). Participants - The RFP identifies several groups that are to be addressed in the outreach and participation phase of the plan. In our experience, individual meetings should be used sparingly so that all participants directly see and hear each other's discussion and concerns. In processes where the focus is on meeting individually with each interested group, it tends to foster conflicting expectations that are not truly understood as conflicting, by the community, until late in the process. For this fundamental reason, we propose to combine as many groups as is practical within the context of the individual geographic areas we identify with you. We will then engage in discussion with participants about their response to this information to tell us what issues they see that need attention and, what desires or vision they have about the project. Notification - Each meeting will be advertised on the internet. We recommend that flyers be provided at high-profile locations such as: post office, libraries, city hall, park and recreation centers, churches, grocery stores, etc., to try and reach as many people as possible. We also recommend making contact with the social organizations and service groups in the area to determine if they can help spread the word about the project. This can take the form of the consultant informing these groups for them to directly communicate with the community or, the consultant can meet with combined 30 January 2oo6 Page 2 of 6 Santa Ana Renaissance Specific Plan Proposal Clarifications by Moule &. Polyzoides groups to make them aware of the upcoming process (e.g., talk to several churches over one weekend). In addition to combining groups to be targeted in the outreach (e.g., Logan, French Park, etc.) we propose to use some of the outreach meetings identified in the RFP for meeting directly with such social and service organizations. Study Sessions The RFP identifies 5 such meetings (z:Planning Commission, i:Redevelopment Commission, 1:Historic Resources, t:City Council). Consistent with the above, we propose to combine these boards as is practical for the same purpose as with the community participants. This could be as simple as two joint study sessions: the first with all boards and the City Council, and the second with the Planning Commission and City Council only), If scheduling joint sessions is not possible, the consultant will conduct the 5 required sessions as individual sessions. After we have met with each of the geographic areas, we propose the first of two combined joint study sessions to share all of the individual results with everyone, including the City Council and Planning Commission. In this way, we expect to bring everyone up to date on both the specific and macro issues that the project must address. At the end of this study session, we expect to have a general consensus and understanding of the direction with which we will enter the charrette process. The second study session is proposed after the charrette to summarize and present the results of the charrette for review, comment and direction with which to prepare the administrative draft specific plan. Bilingual Staff The following Moule & Polyzoides staff are bilingual in Spanish: Stefanos Polyzoides, Orlando Gonzalez, Roberto Moreno, Jean -Maurice Moulene, Anthony Perez, Monica Plata, David Thurman Our approach to the issue of communicating in Spanish is to have the very people that are involved in the project be the persons that communicate the information. This is in contrast to the prevalent practice of using interpreters which can cause for unintentional interpretations of the information being translated. This practice also, unfortunately, dilutes the emphasis and power of the information being presented and discussed. This is particularly true when the presenter and the interpreter lack the rhythm necessary to keep the information and discussion flowing: the lag between something being said in English and then waiting to hear it in Spanish can be frustrating for participants. We are the same people that are working on the project and can communicate seamlessly with the participants as well as react quickly to comments mid -sentence or mid -thought. It is critical that we be allowed to communicate directly with the participants to maximize the effect of the outreach, as it relates to bilingual needs. In addition, our office has administrative staff that supports this team. In the event of a scheduling conflict, due to circumstances unforeseen at this time, equally qualified staff may have to be substituted to address the needs of the project at the particular time. Stefanos Polyzoides is the principal -in -charge and will oversee all work and activity on the part of the consultant team. Stefanos will be the primary presenter at public meetings, workshops, study sessions and public hearings. Anthony Perez is the project manager and will manage and supervise the consultant team's work on a daily basis with daily reports and updates to Stefanos Polyzoides. Anthony will be responsible for coordinating all sub -consultants, preparing the various documents to be submitted to the city and meeting with city staff throughout the process. Anthony will be the city's primary contact for day-to-day operations. Roberto Moreno is the project designer that, under the supervision of Stefanos Polyzoides, will be responsible for generating design responses to the variety of issues and needs that will arise throughout the process. Roberto's contributions will be most visible during the charrette phase of this project. Orlando Gonzales is the day-to-day project designer that will assist in the pre-charrette phase, charrette phase and the document -preparation phase. For example include language that states that transit supportive housing options and streetscapes that accommodate mass transit, such as feeder lines, monorail, etc will be studied. Response: our work typically examines such potential as part of the pre-charrette and charrette phases of the project. During these critical portions of the project, we will examine the location and service of such existing systems and the potential for expansion or modification based on both the urban design and programmatic possibilities. Such potential for enhancement of the transit system is a fundamental factor in determining the appropriateness of intensity, scale and type of buildings and land uses, particularly housing throughout the plan area. At the end of the pre-charrette phase of work, Ne will summarize our findings on this subject regarding the potential, the needs and the constraints to realizing the potential. We will carry this forward to the discovery workshops for review and input by the community and then to the pre-charrette study session for direction.
