CITY COUNCIL COMMITTEE ON NEIGHBORHOOD IMPROVEMENT/CODE ENFORCEMENT Meeting Minutes February 28, 2006 CALL TO ORDER The meeting was called to order at 5:40 p.m. in the Council Chambers, 22 Civic Center Plaza, Santa Ana. ATTENDANCE The following Committee members were present: Lisa Bist, Alberta Christy and Carlos Bustamante Staff present were: Jay Trevino, Executive Director Planning and Building Agency; Kenneth Adams, Assistant Director Planning and Building Agency; Ben Kaufman, Chief Assistant City Attorney; Bruce Dunams, Community Preservation Manager; Steve Gutmann, Supervisor of Inspections; and Estella Rodarte, Senior Community Preservation Inspector. AGENDA ITEMS 1. APPROVAL OF MINUTES - JANUARY 24, 2006 MEETING Approved by a vote of 3:0 '-' 2. PRE-SALE INSPECTION ORDINANCE Bruce Dunams provided a historic overview of the genesis of the pre-sale inspection proposal to date. His gave an overview of the staff work and preparatory work to date, including outreach to the community and the real estate industry. The floor was opened for public comments. A cross section of individuals spoke to the issue of a potential pre-sale ordinance with the majority being community residents who expressed support for some type of pre-sale review. The general theme of the community was that they supported a program that would get at illegal conversions, illegal additions and major health and safety issues. There was a consensus that the program should provide some flexibility in addressing minor code issues. "" Representatives from the real estate industry also spoke but felt that the prerequisite disclosure requirements imposed on the industry to date were adequate. However, other real estate professionals who spoke felt that such an ordinance could be desirable. There was considerable discussion as to whether the appropriate time to require an inspection was at transfer/sale of property. There were several comments about whether the pre-sale inspection was appropriate given the purported fact that city's housing stock turned over once every 11 years. There were 18 speakers on the proposed pre-sale ordinance. Fourteen spoke in favor of the proposal with four in opposition. ....I 3. PUBLIC COMMENTS ON NON-AGENDA ITEMS A. Graffiti on the side of trucks parked on the public right-of-ways B. Graffiti on the OCTA bus stops and benches C. Enforcement of the vending truck ordinance D.
