TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM FEES - SINGLE FAMILY RESIDENCES Camille Courtney, CGC Enterprises, reported that the new transportation system improvement fee on single-family residential development would increase the cost of her development project by $90,000 and that the City had not notified her in a timely manner of the new fee and its financial impact on her project's tract map. City Attorney Edward J. Cooper noted that this ordinance had already passed first reading and was slated for second reading on the Agenda, and that any amendment would revert the ordinance back to first reading. REVISION OF SOLID WASTE COLLECTION PROCEDURES Revises definitions of solid waste in Santa Ana Municipal Code to correspond with definitions in the Integrated Waste Management Act and the City's refuse collection agreement and allows the City to require additional refuse collection service in areas with inadequate service, especially in apartment areas where the City continually has overflowing refuse containers, and sets forth requirements for sorting yard waste and newspapers. Guy: None Larry Lazar, 3636 Bird St. Sp 290, Newport Beach spoke in favor of Variance 92-008. The Mayor closed the public hearing at 7:10 p.m. Motion: Approve. Continuance of VA 92-008 to June 7, 1993, pending determination of ownership of wall on east property line. MOTION: Pulido VOTE: AYES: NOES: SECOND: Young Lutz, Mills, Moreno, Norton, Pulido, Richardson, Young None ABSENT: None COMMENTS 90.A. PUBLIC COMMENTS Isabel Hernandez, 2028 S. Wood St., thanked the Council for its continuing support of Great Western Reclamation as demonstrated by the recent award of the contract for City trash collection and recycling services. Sean Mill, 617 S. Starboard, expressed opposition to a materials recovery facility proposed at 2003 S. Standard and asked the Council to reject siting such a facility in an economically depressed neighborhood. Pat Mill, 617 S. Starboard, requested the Council advise the listening audience of the subject matter being considered by the Council as the items are taken up, and expressed concern about State impacts on recycling efforts by individuals. Sal Juarez, 2723 W. Camden, and Beatrice Calderon, 1238 S. Clara, expressed opposition to the materials recovery facility referred to by previous speaker Sean Mill. Don Edwards, 1424 Louise Street, spoke concerning the United States Constitution. Florence Leach, 2025 W. 10th Street, reminded the listening audience of the upcoming public hearing on a proposed community facilities improvement plan scheduled for 5:30 p.m. in the Council Chambers on May 18, 1993. CITY COUNCIL MINUTES 206 MAY 17, 1~93 90.B. CITY COUNCIL COMMENTS Councilmember Richardson: - commented on the recent graduation ceremonies for the City's first class of detention officers and noted the program might be viewed on cable television; -commended staff on a successful "Breakfast for Small Businesses"; - requested the Police Department and Public Works Agency investigate installation of speed "humps" as a traffic control measure; - encouraged the tri-partite partnership consisting of the Planning and Building Agency, the City Attorney's Office, and neighborhood residents to continue their aggressive code enforcement efforts; and - suggested the Planning and Building Agency's Code Enforcement staff and the Community Development Agency's Neighborhood Improvement staff develop a "court watch" program that would make residents aware of pending court cases involving code violations in their neighborhoods. Councilmember Mills requested the City Manager provide the Council with a schedule of anticipated actions relative to the proposed materials recovery facility. Councilmember Pulido: - commended staff and the City Manager for successfully concluding the Community Development Block Grant budget process; - advised the listening audience of a Delhi Community Center parade in the Delhi neighborhood on Saturday, May 22, 1993; and - requested the City Manager provide the Council with an update regarding revised regulations for garage and yard sales. RECESS TO CLOSED SESSION - 7:37 p.m. - ROOM 147 The Clerk of the Council announced that the City Council was recessing to Closed Session pursuant to: Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which had been initiated formally and to which the City was a party, to wit: - Escobar v. City of Santa Ana; and pursuant to: Government Code Section 54957.6 to meet with its designated representatives regarding labor relations matters. 8:12 p.m. - Councilmember Pulido left the meeting.
