RECONVENED - COUNCIL CHAMBERS - 6:53 P.M. - All Councilmembers present except Councilmember Richardson CITY COUNCIL MINUTES 305 SEPTEMBER 7, 1993 COMMENTS 90.A. PUBLIC COMMENTS Miles Leach, 2025 W. 10th Street, inquired as to whether the City Charter would prevail over State mandates in the event of conflicting provisions. City Attorney Edward Cooper explained that the City was pre-empted by State law in many instances. Richard Meruelo, 8459 Kass Drive, Buena Park, provided the Council with a letter regarding a 4,290-square foot property that he has been trying to develop into a music retail business for the last 18 months. Meruelo requested the Council either waive or lower the transportation fees due on his project as his project called for a decrease instead of an increase in floor area. Mayor Young referred Meruelo's request to the City Manager and the City Attorney, asked the Council to schedule a session to reevaluate the City's transportation fees, requested staff provide Council with a background memo on the Meruelo project, and urged staff to reassess the approval process that took 18 months to review a project under 5,000 square feet. Ron Heike, 1010 W. Santa Clara, thanked the Council for approving the Main Street bridge closure traffic plan and reported the traffic plan was working well. Paul Le, 1814 W. Carlton, asked why the City has not made an offer to buy his property under the Bristol Corridor Project. Community Development Agency Executive Director Cindy Nelson explained that the City cannot acquire Mr. Le's property at this time because Le's property falls outside the target area of the current acquisition schedule which is limited to the sections of Bristol from McFadden to Edinger and from First Street to Tenth Street. 90.B. CITY COUNCIL COMMENTS Councilmember Lutz commended the Orange County Lumber employees who pursued and apprehended the suspect in a diamond necklace-snatching incident that occurred on September 2, 1993 near the Santa Ana Regional Transportation Center; admonished opponents of the Materials Recovery Facility (MRF) to temper their campaign with common sense so as not to unduly alarm residents; and congratulated Recreation and Community Services Executive Director Allen Doby on the Santa Ana Zoo's "Amazon's Edge" opening ceremony. Councilmember Mills encouraged Jim Walker and his colleagues to work with the Chamber of Commerce to determine what smoking regulations Santa Ana businesses have established and to collaborate with the Chamber of Commerce in crafting regulations that would be acceptable to the parties concerned. Mills also requested the Council meeting be adjourned in memory of Corinne Segerstrom who recently died in a freak accident on the Segerstrom family's farm. CITY COUNCIL MINUTES 306 SEPTEMBER 7, 1993 Councilmember Moreno reported the "Youth Services Directory" which contained information on various programs and facilities for Santa Ana youth was now available at the City's library branches, community centers, and recreation centers. Moreno also invited the general public to the 4th Street Annual Street Fair to be held from September 17 through 19, 1993 as part of the September 16 celebration of Mexico's Independence Day. RECESSED TO CLOSED SESSION - ROOM 147 - 7:15 P.M. The Assistant Clerk of the Council announced the City Council was recessing to Closed Session pursuant to: Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which had been initiated formally and to which the City was a party to wit: PAI-22 vs. City of Santa Ana Rattelman vs. City of Santa Ana (Workers' Compensation) Ramirez vs. City of Santa Ana Soza vs. City of Santa Ana; and pursuant to Government Code Section 54957.6 to meet with its designated representatives regarding labor relations matters. RECONVENED - COUNCIL CHAMBERS - 7:28 P.M. - All Councilmembers present except Councilmember Richardson 95.A. Motion: CLOSED SESSION REPORT Authorize settlements as follows: PAI-22 vs. City of Santa Ana, in the amount of $6,150.35 Rattleman vs. City of Santa Ana, Workers' Compensation, in a stipulation in the amount of $21,105.00. Ramirez vs. City of Santa Ana, in the amount of $10,000.00. Soza vs. City of Santa Ana, in the amount of $18,000.00.
