In response to Councilmember McGuigan's inquiry, Planning and Building Agency Executive
Director Robyn Uptegmff explained that staff was in the process of preparing a plan to
communicate the new property maintenance standards to residential property owners.

ZOA 92-004 - CUP'S FOR ALL-NIGHT RESTAURANTS
Alberta Christy, 2108 W. Glenwood, Valley High Neighborhood Association President,
expressed support for proposed Ordinance NS-2213, a zoning ordinance amendment which
would require Conditional Use Permits (CUP's) for restaurants with 24-hour operations
adjacent to residential neighborhoods.
Leonardo Nufiez, 1221 E. First St., and Lucia Salinas, 1904 W. First St., expressed concerns
regarding the adverse impact of the ordinance on their respective businesses.
Planning and Building Agency Executive Director Robyn Uptegraff explained the specifics of
the ordinance, indicating that existing businesses had a two-year period in which to apply for
a Permit and would be exempt from Permit fees, and that only the conditions relating to
business operations would be evaluated during the permitting process.
Motion: Place ordinance on first reading and authorize publication of title.

Councilmember Richardson requested that the establishment of the Utility District be deferred
to allow the inclusion of additional footage along Civic Center Drive and to address concerns
raised by Councilmember Moreno regarding hook-up costs to be paid by affected residents.

PUBLIC COMMENTS
Miles Leach, 2025 W. Tenth Street, expressed dissatisfaction with the City Attorney's
interpretation of the Charter section on Councilmember term limits and opined the Charter
should be amended to specifically bar Councilmembers who had served two full terms to ever
run for Council again.

COMMENTS
John Raya distributed copies of "Orange County Challenge: Youth Development" to the
Council, commented on the City's various anti-gang efforts, and suggested the court referral
program which permits community service as a means of restitution for those convicted of
minor crimes should be a countywide effort.
Tamara Niles, 200 W. Columbine, J-5 reported continuing difficulty in parking on the street
near her apartment complex due to the City's enactment of a permit parking district in the
area. City Manager Dave Ream indicated staff was working on the problem and would report
to the Council in the coming week.

Councilmembers present except Councilmember Mills

CITY COUNCIL COMMENTS
In response to Councilmember McGuigan's query, Police Chief Walters reported no vehicular
deaths had occurred over the Holiday Season. McGuigan noted the Century High School
cheer leaders would be participating in the upcoming National Band Association competition
in Orlando, Florida and encouraged the audience to contribute toward their travel expenses.
Councilmember Lutz commended the Fire Department on its excellent job in extinguishing
several fires during adverse wind conditions in his neighborhood during the Holidays. He
requested staff contact the property owner at the northeast comer of Bristol Street and
Memory Lane to replace a fence apparently damaged by wind.
Councilmember Richardson noted the recent death of Fire Safety Analyst Lou Sargent,
requested the Council meeting be adjourned in his honor, and extended condolences to the
Sargent family. Richardson also commended the Fire Department on its Christmas Toy Drive
in which he had personally participated in distributing gifts.
Mayor Pro Tern Pulido requested the Clerk of the Council prepare appropriate recognition at
an upcoming Council meeting for service above and beyond the call of duty by Police
Division Cormmanders Bmce Carlson and Dan McCoy and Miniondas' Sergio Velasquez in
locating a missing person.
In response to Councilmember Moreno's inquiry, Community Development Agency Executive
Director Cindy Nelson provided an update regarding anticipated receipt of a two grants to
assist the homeless. Also in response to Councilmember Moreno, Police Chief Paul Walters
reported Santa was still in contention for funds to be awarded through a federal grant to put
more police officers on the streets.
