HomeMy WebLinkAboutACCESS-2006 !NSu~r\NCE llill ON FILE viul1i\ MAY N.QlPROCEED C~_ERK OF COUNCIL DATE: q~ -Bep AGREEMENT NUMBER 29586 A-2006-210 o : PD {)..} ~~ FIRST AMENDMENT TO AGREEMENT FOR PROVISION OF SUPPORT SERVICES THIS FIRST AMENDMENT TO AGREEMENT is entered into on July 17, 2006, by and between the Orange County Superintendent of Schools, maintaining the Alternative and Correctional Education Schools and Services ("ACCESS"), hereinafter "Educator", and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS: A. The parties entered into Agreement A-2005-219 (City)/ 29586 (Educator), dated September 1,2005, (hereinafter "said Agreement") by which Educator has provided GED testing for the benefit of adult inmates housed in the Santa Ana Police Department Jail Facility, hereinafter referred to as said "Program". B. In accordance with the terms and conditions of said Agreement, the parties wish to extend the term of said Agreement for an additional one-year period and to increase compensation to pay for said Program during the extended term. WHEREFORE, in consideration ofthe covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Agreement, the parties agree as follows: 1. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the following: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Section 1 of said Agreement. The total sum to be expended under said Agreement shall not exceed $25,000.00 during the 2005/06 fiscal year. The total sum to be expended pursuant to said Agreement shall not exceed $30,000.00 during the 2006/07 fiscal year." 2. Section 3, TERM, shall be amended to extend the termination date through June 30, 2007. 3. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Agreement on the date and year first written above.
