RESOLUTION 2006-069
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA APPROVING THE SUMMARY VACATION OF
LEONARD LANE ADJACENT TO 2738 FREEMAN LANE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds
determines and declares as follows:
A. The City of Santa Ana intends to vacate Leonard Lane adjacent to 2738
Freeman Lane pursuant tD and in accordance with the provisions Df Chapter
3 of Part 3 of DivisiDn 9 Df the Streets and Highways CDde Df the State of
CalifDrnia.
B. The vacatiDn of LeDnard Lane is a summary vacatiDn because the street lies
within property under Dne Dwnership pursuant tD the provisions Df sectiDn
8334 Df the Streets and Highway Code of the State Df California. All prDperty
adjacent tD said street is Dwned in fee by Camille Paula Bauer. AlsD, the
strip of Leonard Lane to be vacated has nDt been utilized fDr over five years.
C. The strip of Leonard Lane tD be vacated is not necessary for traffic and/Dr
pedestrian circulatiDn.
D There are no existing overhead Dr underground utilities within the proposed
vacated area and it is unnecessary to reserve an easement fDr public service
purposes or fDr future street Dr alley purposes.
E. In accordance with the California Environmental Quality Act, Mitigated
Negative Declaration ER No. 2006-154 has been prepared fDr this prDject.
Section 2. The City CDuncil Df the City Df Santa Ana hereby apprDves the
summary vacation of the 30 fDot wide by 105.51 fODt long strip of Leonard Lane directly
west Df Freeman Lane, as mDre particularly described in Exhibit 1 hereto, which is
incorpDrated herein by reference.
Section 3. Said street shall nDt be deemed vacated until this resolution
is recorded.
SectiDn 4. This Resolution shall take effect immediately upon its adoption by
the City Council, and the Clerk of the Council shall attest to and certify the vote adopting
this Resolution.
