AGREEMENT BETWEEN THE CITY OF SANTA ANA
AND THE CITY OF COSTA MESA FOR
REHABILITATION OF SUNFLOWER AVENUE
BETWEEN A VENUE OF THE ARTS AND BEAR STREET
This Agreement ("Agreement"), made and entered into this ;;l,.\>f day of
August, 2006, by and between the CITY OF COSTA MESA, a municipal corporation
("COSTA MESA"), and the CITY OF SANTA ANA, a charter city and municipal
corporation ("SANTA ANA").
RECITALS:
A. COSTA MESA and SANTA ANA desire to enter into a cooperative
agreement rehabilitate Sunflower A venue since a portion of the street lies within the
limits of the City of Santa Ana. The scope of work within SANTA ANA involves a
slurry seal application of the entire pavement, grinding and overlaying some areas and re-
striping of the street ("the PROJECT").
B. The PROJECT lies partly within the corporate and jurisdictional limits of
SANTA ANA and partly within the corporate and jurisdictional limits of COSTA MESA.
The portion of the PROJECT within Santa Ana city boundaries lies on Sunflower Avenue
between Avenue of the Arts and Bear Street.
C. The parties hereto desire to each provide fmances attributable to the
portion of work in each respective city for the PROJECT, with SANTA ANA
reimbursing COSTA MESA in an amount not to exceed $45,000.00.
NOW, THEREFORE, the parties agree as follows:
I. Rights and Duties:
A. COSTA MESA shall competitively bid the PROJECT, including obtaining all plans
and specifications for the entire PROJECT.
B. Each city shall provide its own inspection services.
C. COSTA MESA shall provide the services for the PROJECT and SANTA ANA shall,
upon inspection and approval, reimburse COST A MESA for the expenses related to
development of said PROJECT, in an amount not to exceed $45,000.00.
D. Mutual Indemnity Provision:
1. Upon completion of the PROJECT, COSTA MESA shall accept
maintenance responsibility for the PROJECT within COSTA
MESA jurisdictional limits.
II. Upon completion of the PROJECT, SANTA ANA shall accept
maintenance responsibility for the PROJECT within SANTA ANA
jurisdictional limits.

IN WITNESS WHEREOF, COSTA MESA has caused this Agreement to be executed by
its Mayor and attested by its Clerk, and SANTA ANA caused this Agreement to be
executed by its City Manager and attested by its Clerk, as duly authorized by the COSTA
MESA City Council and the SANTA ANA City Council, respectively.
