Orange Avenue - For McFadden Avenue realignment in the amount of $135,000.00 - Public Works Agency DEED 7827 CITY COUNCIL MlNUTES 208 JULY 7, 1997 CONSENT CALENDAR CONDITIONAL USE PERMITS/VARIANCES/PARKING WAIVERS Filed by RESCO Properties to allow relief from commercial development requirements for landscaping and parking in order to allow a medical facility in the Community Commercial (C 1 and R1-B) zoning district - Planning and Building Agency Planning Commission Action: Approval FILE CA Councilmember Moreno opined that Variance 97-04, which allows both insufficient parking and landscaping, constituted an unacceptable deviation from City standards and urged the Council to deny the variance. In response to Councilmember Moreno's query, Executive Director Planning and Building Agency Executive Director Robyn Uptegraffexplained the Planning Commission vote (3/1 to approve with two abstentions and one member absent) on the variance, and noted variance conditions had been modified since the original submission. Deny Variance 97-04. (City Attorney Fletcher indicated the motion should be to "Set Variance 97-04 for public hearing".) MOTION: Moreno SECOND: Espinoza In response to Councilmember Lutz' query, the City Attorney clarified that Lutz did not have a conflict of interest and might vote on the matter. Washington Square Neighborhood Association President Ed Tudor reported the Association supported approval of the variance. REINSTATEMENT OF THREE POSITIONS ELIMINATED IN CITY'S FY 97-98 BUDGET (MORENO) Sally Ramirez, representing the Santa Ana City Employees' Association/Service Employees International Union (SEIU) Local 1939, opined the City had failed to comply with "meet and confer" obligations regarding three positions eliminated from the C'ty s FY 97-98 budget and asked that the positions and employees be reinstated. CITY COUNCIL MINUTES 210 JULY 7, 1997 The following persons expressed support for Ramirez' request: Phil LeCours Bill Fogarty Ruben Gomez Julie Butcher Chuck Coperning Dave Lopez Max Lopez Councilmember Moreno urged the Council to reinstate the positions, and suggested salary costs could be covered by renegotiating the recently amended Great Western Reclamation contract to transfer maintenance service in the Downtown back to the City. (See Minutes page 182.) Motion: Reinstate the three positions eliminated itt the FY 97-98 City budget. MOTION: Moreno SECOND: Espinoza City Manager David Ream outlined the sequence of meetings the City scheduled with the SE1U during the budget process. City Attorney Fletcher opined the decision to contract for Downtown maintenance service was valid and proper, and that the City had met its legal "meet and confer" obligations regarding elimination of the budget positions. Substitute Motion: 1. Table previous motion; and 2. Review Downtown maintenance service in six months. RECONVENED - 7:36 P.M. - All Councilmembers present CITY COUNCIL MINUTES 211 JULY 7, 1997 COMMENTS 90.A. PUBLIC COMMENTS Bill Wilkinson indicated the current design plans for the Garthe Reservoir would adversely impact the Santiago Creek bed, reported the residents adjacent to the Creek opposed a cement channel, and suggested a public hearing be held regarding the finish work on the Reservoir's north side. Ron Heike supported Wilkinson's position, expressed a need for "open dialogue" regarding several proposals for Northwest Santa Ana such as the 2828 N. Bristol re-use project and extension of the Interstate 57 Freeway, and encouraged the City to proceed with privatizing the Bowers Museum. 90.B. CITY COUNCIL COMMENTS Councilmember Moreno reported the medians on 17th Street need watering. Councilmember Espinoza reiterated an earlier request regarding a Thornton Park sprinkler problem and suggested the City consider placing flags along major arterials to celebrate national patriotic holidays. City Manager Ream indicate he would investigate both requests. Mayor Pro Tem Richardson: - expressed appreciation to staff for code enforcement against illegal signage on S. Main and 17th Streets; - requested an update on regulation of recycling vendors; - commented on the numerous street tree and infrastructure improvements occurring throughout the City; and - noted the Planning Division current projects report had lengthened significantly, reflecting an improved California economy. Councilmember McGuigan: - reported the Flower Park neighborhood recently celebrated "Streets without Crime," commemorating the neighborhood's successful transformation from gang-controlled turf to a safe family environment; - noted the June 29 French Park Jazz Festival and the July 6 Plein Air Art event at the Bowers Museum were both tremendously successful and brought positive recognition to the City; and CITY COUNCIL MINUTES 212 JULY 7, 1997 - requested clarification regarding the transfer of the Abandoned Vehicle Abatement program from the Police Department to the Planning and Building Agency. Councilmember Lutz: - reiterated and amplified Councilmember McGuigan's positive comments regarding the Flower Park, Jazz Festival, and Plein Air events; and reported the circuitry for the "Sojourner," a technical device currently probing Mars' terrain, had been developed by Pioneer Circuitry, Inc., a local Santa Ana finn, and asked that Pioneer Circuitry President Jim Lee be invited to an upcoming Council meeting for recognition of his company's contribution to outer space exploration. Councilmember Franklin: - commented that Redwing Shoe Store owner Dee Hoppie had recently informed him the store had had its "best business year" ever and congratulated Hoppie on his success; and - invited the audience to the Floral Park Neighborhood's "Dancing in the Dark" concert scheduled for 7:00 - 10:00 p.m. on July 19, 1997 at Heliotrope and 19th Streets. Mayor Pulido: - encouraged Councilmember Lutz to explore possible opportunities with Jim Lee relating to the Discovery Science Center; reported the City was closely following development of the Federal budget for possible funding allocations for Santa Ana and his participation in a conference call with the mayors of the 10 largest California cities regarding enterprise zones; and noted the Irvine Galleries, renowned for its own plein air art collection, had selected a large number of paintings from among the Plein Air award-winning pieces for exhibition in its San Juan Capistrano facility. PUBLIC COMMENTS Charles Bordenave deplored the Council majority's voting record and opined the majority evidenced a lack of honesty and integrity. Janet Debs Fahmie reported ongoing problems with the federal government and requested Council assistance to stop the CIA from harassing her. James Kendrick thanked the Council for its support of the Grand Central Art Center project, cited examples of similar projects successful elsewhere in the United States, and expressed a need for a high quality development on the N. Main Street Shimizu site. 90.B. CITY COUNCIL COMMENTS Councilmember Moreno asked Mayor Pulido to explain his reported opposition to a proposal to locate an Immigration and Naturalization Services facility at Flower and Civic Center Drive. Pulido indicated he would respond at the conclusion of City Council Comments. CITY COUNCIL MINUTES 220 JULY 21, 1997 Councilmember Espinoza: - asked that a letter be sent to the Santa Ana Unified School District commending the District on its adoption of student and teacher dress code policies; and - opined that graffiti incidents escalate during weekends and reiterated his suggestion that the City's graffiti contractor be encouraged to provide weekend service. Mayor Pro Tern Richardson: congratulated the Willard Intermediate School parents group, noting 69th District State Assemblymember Jim Morrissey's participation, on its volunteer neighborhood clean-up on July 19, 1997; asked the Public Works Agency to survey the Willard Neighborhood for possible improvements, such as repair of broken curbs, that could be included in other project bid solicitations; and - noted the Heninger Park Special District design standards were still in process and requested a status report from staff Councilmember McGuigan: - reported the Floral Park concert on July 19 had been very successful and enjoyable; and - noted the Santora Building would celebrate its 2nd anniversary as an arts attraction on July 26, 1997. Councilmember Lutz: indicated the major reception at the Santora Building arts celebration would be held at 10:00 p.m. and asked Community Development Agency Executive Director Cindy Nelson to provide the Council with a list of the evening's events; reported a coalition of residents, the Assistance League, Recreation and Community Services, and Police Department were continuing to work on improvements in the Flower Park area and suggested interested persons call City Hall to volunteer for a neighborhood work day in October, particularly those with skills to set forms for concrete work; and - reported a proliferation of illegal signs on Bristol between Warner and Civic Center Drive. CITY COUNCIL MINUTES 221 JULY 21, 1997 Councilmember Franklin: reported he had toured the Alona Park/Riverview West area with Recreation and Community Services Executive Director Cleve Williams and requested the Council be provided with an update on plans for Park grant funds; - complimented the Community Preservation and Building Divisions on their excellent "Keep It Safe, Keep It Beautiful" brochure and suggested interested persons call City Hall to request copies; - informed the audience that Santa Ana responds on a 24-hour basis to anonymous complaints regarding excessive noise from loud radios and large social gatherings, and encouraged residents to call the Police Department for service if needed; - announced the Santa Ana Unified School District was considering possible names for the new space saver school at 17th and Bristol and invited the public to send suggestions to the District's Public Information Office at 1601 Chestnut or call (714) 558-5555; and - requested a staffpresentation on Recreation & Community Services Fall '97 programs and events be provided at a future Council meeting. Mayor Pulido: - indicated his reservations regarding a proposal to locate an Immigration and Naturalization Services office at Civic Center and Flower were in response to concerns raised by the neighborhood adjacent to the proposed location; - reported Congresswoman Loretta Sanchez and Senator Barbara Boxer were assisting the City to secure funding for the Discovery Science Center and that $500,000 in Federal funds had been earmarked for the project; requested Public Works staffmeet with Art Delgado to evaluate Delgado's graffiti removal proposal and report back to Council; - asked staff to consider language from a City of Los Angeles truancy law in evaluating the feasibility of a truancy ordinance for Santa Ana; - suggested the City advocate for state legislation against playing "boom boxes" (stereo sound equipment) at excessively loud levels; and - invited the public to attend the Santora Building anniversary celebration on July 26, 1997 and to call City Hall for the schedule of art opening events.
