RECOMMENDED ACTION
Direct the City Attorney to prepare and authorize the City Manager and
the Clerk of the Council to execute an agreement with LA Cart's Mfg. Inc.
to purchase a vendor cart for downtown in the amount of $9,000.
DISCUSSION
On October 16, 2000, the Council approved a settlement agreement related
to the downtown vendor carts. City staff, in partnership with the vendor
cart owners, reached a joint consensus on the design and specification of
the standard cart unit. On March 25, 2006, the City and vendor cart
owners released the new downtown vendor carts. One downtown vendor cart
owner did not participate in the original settlement agreement and
therefore was not included in the original purchase. This one remaining
vendor cart needs to be replaced with the new design in order to have a
consistent theme in the downtown. This agreement would provide one half
the cost to cover the purchase under the same terms and agreement with
all other carts owners.

FISCAL IMPACT
Funds in the amount of $9,000 are available in the Liability and Property
Insurance Fund (account no. 80-180-6522).
