DISCUSSION On November 29, 2006, the Orange County Registrar of Voters certified the results of the canvass of the Santa Ana General Election returns. Pursuant to State Elections Code 10263 and 10264, the City Council must adopt a resolution reciting the fact of the election and the results of: (a) the whole number of votes cast in the city, (b) the names of the candidates voted for, and the offices voted for, (c) the measures voted upon, (d) the number of votes by precinct for each candidate and for or against each measure, and Ie) the number of votes in the City for each candidate and for or against each ballot measure. The accompanying resolution and Exhibit A identify the results of the balloting. By adopting the resolution, the City Council declares elected the following individuals: Miguel A. Pulido, Mayor; Michele Martinez, Councilmember, Ward 2; David Benavides, Councilmember, Ward 4; and, Sal Tinajero, Councilmember, Ward 6. Additionally, Measures Z, AA, BB, CC, and DD which proposed various amendments to the City Charter all received a majority vote. Pursuant to the provisions of California Government Code Section 34459, these measures shall take effect after they are accepted and filed by the Secretary of State. The Clerk of the Council will file the necessary documents with the Secretary of State following the Council's action on the resolution declaring the results of the election. ',d~ l,~);;JCk ;, ,~"'U 1-1 RESOLUTION NO. 2006- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 7,2006. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A. Pursuant to the Charter of the City of Santa Ana, a general municipal election was held in the City of Santa Ana on November 7, 2006, to fill the office of Mayor and offices of members of the City Council nominated from Wards 2, 4, and 6 of the City, and to consider ballot measures amending the City Charter. B. The results of the said election, including the whole number of votes cast in the City, the names of the persons voted for, for what office each person was voted for, and the number of votes given in the City to each person, are set forth in that certain document attached hereto as Exhibit A and incorporated herein by this reference as though fully set forth. C. That, based upon said results, Miguel A. Pulido is declared elected to the office of Mayor of the City of Santa Ana to a two year term. D. That, based upon said results, the following persons are declared elected to the following respective offices, each to a four year term: 1. Michele Martinez, member of the City Council of the City of Santa Ana from Ward 2. 2. David Benavides, member of the City Council of the City of Santa Ana from Ward 4. 3. Sal Tinajero, member of the City Council of the City of Santa Ana from Ward 6. E. That based upon said results, the following ballot measures shall become effective after acceptance and filing by the Secretary of State: 1. Measure Z - Amendments to Charter Sections 400, 413, and 1200. 1-2 2. Measure AA - Amendments to Charter Sections 421 and 422. 3. Measure BB - Amendments to Charter Section 401. 4. Measure CC - Amendments to Charter Section 901. 5. Measure DD - Amendments to Charter Sections 901.1, 910, 911, and 912. Section 2. This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
