WHEREAS, on April 14, 2003, WATER QUALITY ORDINANCE IMPLEMENTATION AGREEMENT NO.

D02-104 (hereinafter referred to as ~AGREEMENTn) between the Orange County Flood
7 Control DistrLct, (hereinafter referred to as ~DISTRICT"), and the City of Santa Ana,
8 (h8reinafter referred to as "CITY"), sometimes COllectively referred to herein as "the
9 PARTIES, "was executed for a period of two (2) years.

WHEREAS, SECTION 3(a) of AGREEMENT NO. D02-104 stipulates that the AGREEMENT is
11
renewable for an additional three (3) years upon mutual agreement of the PARTIES as
memorialized in writing by the CITY and the Director of Public Facilities and
12
Resources Department (PFRD), or her designee, on behalf of the DISTRICT.

WHEREAS, SECTION 3(a), line 22 currently refers to the Director, Public
14
Facilities and Resources Department, or her designee, and the title of that individual
15 has recently been changed to the Director, Resources and Development Management
16 Department (RDMD).

NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS:

1. Section 3{a) of AGREEMENT NO. D02-104 is hereby amended to read:

2. Any reference in the Agreement to "Director of Publ.ic Facilities and

Resources Department (PFRD), or her designeeu is hereby amended to read

"Director of Resources and Development Management Department (RDMD), or

3. Except as amended herein, all other terms, conditions and covenants of

AGREEMENT NO. D02~104 remain unchanged and enforceable as originally seL

forth.

Subject: Renewal of Water Quality Ordinance Implementation Agreement - 002-104
Dear Mr. Parco,
On April 14, 2003, Water Quality Ordinance Implementation Agreement No. 002-104 was executed between
your city and the Orange County Flood Control District (District). This agreement authorizes the District,
upon request, to provide NPDES authorized inspector services under the city's ordinance and establishes a
mechanism for payment. Section 3(a) of the agreement specifies that it is valid for two years from the date
executed, renewable for an additional three years upon mutual agreement memorialized in writing.
In a letter dated December 16, 2004, this Department provided notification that the Agreement will be expiring
April 14, 2005. Thank you for your recent response for the renewal of the agreement. Attached to this letter,
you will find two identicai copies of an amendment to Agreement No. 002-104 signed by County Counsel.
The amendment execution date is set on April 14, 2005 to provide continuity of the original agreement.
Please return both copies, with original signatures as soon as possible to:
