OPEN SESSION
Pursuant to Section 54954.2(b) of the California Government Code, the Council may
consider matters not appearing on the posted agenda if the Council finds that (1) an
emergency condition exists that prevents waiting until the next meeting, and (2) the
need to take action became known to the City after the posting of the agenda.
The City Attorney advised the City Council that he received a copy of a lawsuit filed by
Mark Lehman of Lehman Construction Co. challenging the legality of the Children's Zoo
Construction Management Agreement with Griffin Structures and Roger Torriero. He
recommended the following agenda item be added to the Closed Session Agenda:
Motion: Find that there is a need to add item that arose subsequent to the
posting of the Agenda.
