Award a contract to Fleming Environmental, Inc., the lowest responsible bidder, in accordance with unit bid prices in the estimated amount of $465,849 for construction of Corporate Yard National Pollutant Discharge Elimination System Improvements. 2. Approve a Funding Analysis with a total estimated construction cost of $605,400. The City's maintenance yard was constructed in 1994 and is not in compliance with the National Pollutant Discharge Elimination System (NPDES) requirements (Exhibit 1) This project will provide upgraded components of the existing sewer line bypass system, new structures to cover exposed material to prevent runoff into the city's storm drain system, and a bird netting system to prevent accumulation of bird feces. Once completed, the maintenance yard will operate in compliance with the NPDES permit. The Notice Inviting Bids was advertised on May 30 and June 1, 2007, bids were opened on June 14, 2007. A summary of the bid invitations mailed, the bids received, and the bid results follows. Fleming Environmental, Inc. 2. L.H. Engineering, Inc. CITY Buena Park Anaheim BID AMOUNT $465,849 $556,500 A total of two bids were received and both were responsive. The lowest bid was submitted by Fleming Environmental, Inc., for $465,849, which is above the Engineer's estimate of $300,000. The high bid received is due to specialized construction and volatile steel prices. ENVIRONMENTAL IMPACT In accordance with the California Environmental Quality Act, the recommended action is exempt from further review. Categorical Exemption, No. ER 07-106 has been filed. FISCAL IMPACT The funding analysis shows a total estimated construction cost of $605,400 for the project (Exhibit 2) Funds are available in the Fred Clean Water Protection Enterprise Fund (account no. 57-635-6631).
