Adopt a resolution approving submission of an application to the California Department of Housing and Community Development under the Transit Oriented Development Program. 2. Authorize the Deputy City Manager for Development Services to execute the application and all documents related thereto. DISCUSSION On December 11, 2007, the California Department of Housing and Community Development announced the availability of $95 million through the Transit Oriented Development Program (TOD) The TOD Program is a multi-faceted housing program created by the State of California that utilizes funds made available by the passage of Proposition 1C, the Housing and Emergency Shelter Trust Fund Act of 2006. The applications are due March 7, 2008, and awards are anticipated to be announced in June of 2008. TOD funds are available to local public agencies and private developers for a variety of activities that increase the supply of affordable housing, increase public transit ridership, and minimize automobile trips. Proposed activities must support the development of affordable housing located within a quarter mile of the transit center. In order to qualify for funding, housing projects must have at least fifty dwelling units and a minimum net density of forty dwelling units per acre. Additionally, at least fifteen percent of the units must be restricted for low- and moderate-income households. In order to be eligible for funding, staff is proposing development on Agency-owned properties in the Santa Ana Boulevard area (Exhibit 1). Based on the proposed housing project, the City of Santa Ana would be able to apply for approximately $5 million in TOD infrastructure grant funds to support the development. These funds would be used to offset the City's costs for necessary infrastructure upgrades. CEQA COMPLIANCE In accordance with the California Environmental Quality Act, the proposed project is exempt from further review per Section 15061(b)(3) as the project will not have a significant effect on the environment. General Rule Exemption Environmental Review No. 2008-49 will be filed for this project. FISCAL IMPACT There is no fiscal impact associated with this action. ~. ~~~' Step en G. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A. The City of Santa Ana, a political subdivision of the State of California, wishes to apply for and receive an allocation of funds through the Transit Oriented Development Program (TOD). B. The California Department of Housing and Community Development (hereinafter referred to as "HCD") has announced the availability of $95 million through the TOD. The TOD Program is amulti-faceted housing program created by the State of California that utilizes funds made available by the passage of Proposition 1 C, the Housing and Emergency Shelter Trust Fund Act of 2006. C. TOD funds are available to local public agencies and private developers for a variety of activities that increase the supply of affordable housing, increase public transit ridership, and minimize automobile trips. D. Proposed activities must support the development of affordable housing located within a quarter mile of the transit center. Under the proposed application to HCD, the City is requesting an allocation of TOD funds for an infrastructure grant to support the development of a qualified housing project. 55B-4 2/21 /08 les Section 2. In accordance with the California Environmental Quality Act, the recommended action is exempt from further review pursuant to California Code of Regulations, Title 14, Chapter 3, Section 15061(b)(3). The project has been evaluated and found to have no significant effect on the environment. A Notice of Exemption for Environmental Review No. 2008-49 will be filed for this project. Section 3. The City of Santa Ana shall submit to HCD an application to participate in the TOD Program which will request a funding allocation for an infrastructure grant to support the development of a qualified housing project. Section 4. If the application for funding is approved, the City of Santa Ana hereby agrees to use the DOT funds for eligible activities in the manner presented in the application as approved by HCD and in accordance with program guidelines cited above. It also may execute any and all other instruments necessary or required by HCD for participation in the DOT Program. Section 5. The City of Santa Ana authorizes the Deputy City Manager for Development Services to execute in the name of the City of Santa Ana, the application, the Standard Agreement, and all other documents required by HCD for participation in the DOT Program, and any amendments thereto. 2 55B-5 2121 /08 les ADOPTED this day of , 2008.
