HomeMy WebLinkAboutA-2008-001 c'( II JSURANCE NOT REQUI RED WORK MAY PROCEED CLERK OF COUNCIL DAT~AR 1 9 2008 A-200S-001 2 3 4 5 6 7 8 THIS FIRST AMENDMENT. entered into this 1st day of May, 2008, which date FIRST AMENDMENT TO AGREEMENT BETWEEN COUNTY OF ORANGE AND CITY OF SANTA ANA FOR THE PROVISION OF WElFARE-TO-WORK EMPLOYMENT SERVICES 9 is particularized for reference purposes only, is to that certain AGREEMENT 10 Number WBC0607 between the parties hereto. dated July I, 2007. hereinafter 11 referred to as the "Agreement" and 1 s by and between the COUNTY OF ORANGE. 12 hereinafter referred to as "COUNTY," and CITY OF SANTA ANA, a California 13 municipality, hereinafter referred to as "CONTRACTOR," This Amendment shall be 14 administered by the County of Orange Social Services Agency. hereinafter 15 referred to as "ADMINISTRATOR." 16 17 18 19 WHEREAS. COUNTY desires to modify the terms of the Agreement to increase WIT N E SSE T H: 20 funding in order to provide additional Welfare-To-Work employment services to 21 clients referred to CONTRACTOR by COUNTY; and 22 WHEREAS. CONTRACTOR agrees to such modifi cat i on and to provi de 23 additional services under the terms and conditions set forth in this 24 Agreement; 25 NOW. THEREFORE. IT IS MUTUAllY AGREED AS FOllOWS: 26 27 28 Page 1 of 6 (WBC0607A) (February 25, 2008) 1 1. Subparagraph 18.1 of the Agreement is hereby amended to read as follows: 2 "18.1 Maximum Contractual Obligation: 3 The maximum obligation of COUNTY under this Agreement shall be $2.026.904. or 4 actual allowable costs. whichever is less." 5 2. Subparagraph 2.3 of Exhibit A to the Agreement is hereby amended to read as 6 fo 11 ows : 7 "CONTRACTOR must accept and provi de servi ces to all Ca 1 WORKs 8 participants referred to CONTRACTOR by WTW Case Managers. Although services 9 may be ceased if there is a participation problem due to non-cooperation. a 10 participant may not be refused service by CONTRACTOR without discussion with. 11 and concurrence by. the participant's assigned WTW Case Manager. The WTW Case 12 Manager shall concur prior to any action taken to minimize issues that impede 13 a participant's ability to complete Job Services." 14 3. Paragraph 12 of Exhi bit A to the Agreement is hereby amended to read as 15 follows: 16 "12. BUDGET FOR PROVISION OF ON-THE-JOB TRAINING. (2)For hourly employees, Full-Time Equivalent (FTE) is defined as the amount of time (stated as a percentage) the position will be providing services under the terms of this Agreement. This percentage is based upon a 40-hour work week. For salaried employees, Full-Time Equivalent (FTE) is defined as the amount of time (stated as a percentage) the position will be paid for under the terms of this Agreement, regardless of the number of hours actually worked. (3)Medical, long term disability, retirement, pension, employee assistance, FICA, SUI, Worker's Compensation and vacation accrual. (4) Mileage is limited to the amount allowed by IRS. 12.4 CONTRACTOR and ADMINISTRATOR may agree in writing to add, delete or otherwise modify individual line items andlor amounts andlor the number and type of FTE positions particularized in this andlor Paragraph 13 of Exhibit A of this Agreement without changing the COUNTY's maximum obligation under this Agreement."
