O PBA (2) 6 Zc:rba CONSULTANT AGREEMENT A-2008-107 THIS AGREEMENT, made and entered into this 2"d day of June, 2008 by and between Chambers Group, Inc., a California corporation (hereinafter "Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). RECITALS A. The City desires to retain a consultant having special skill and knowledge in the field of environmental services and related technical studies. B. Consultant represents that Consultant is able and willing to provide such services to the Citv. C. In undertaking the performance of this Agreement, Consultant represents that it is knowledgeable in its field and that any services performed by Consultant under this Agreement will be performed in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: 1. SCOPE OF SERVICES Consultant shall provide environmental study and related technical study services related to analyses of the California Environmental Quality Act and the National Environmental Policy Act, as set forth in City's Request for Qualifications for Environmental Consultants, incorporated to this Agreement by reference, and Consultant's Proposal, attached hereto as Exhibit A and incorporated by reference to this Agreement. Said services shall be provided at the request of the Executive Director of the Planning and Building Agency, as evidenced by a writing signed by the Executive Director and the City Attorney. 2. DELIVERY OF WORK PRODUCT Consultant shall deliver to City all work product which results from the services provided. Said work product shall be submitted in hard copy and produced in a form compatible with City's computer system, as agreed between the Project Manager and Consultant. In regard to all copyrightable material produced as a deliverable under this Agreement, including but not limited to books, reports, plans, photographs, drawings, films, recordings, videotapes, and computer programs, Consultant agrees, for itself and for its affected officers, employees, agents, contractors, and volunteer workers, that (a) other such material may not be copyrighted without prior review from the City, and (b) the authors of all such material, whether copyrighted or not, award to the City, and to its officers, agents and employees acting within the scope of their official duties, as a condition of payment to the Consultant, a royalty -free, nonexclusive, irrevocable license throughout the world for governmental purposes to disclose, publish, translate, reproduce, and use such materials. 3. COMPENSATION a. City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A. The total sum to be expended under this Agreement shall be set in the writing authorizing Consultant to perform a specific project pursuant to this Agreement. b. Payment by City shall be made within thirty (30) days following receipt of proper invoice evidencing work performed, subject to City accounting procedures. Payment need not be made for work which fails to meet the standards of performance set forth in the Recitals which may reasonably be expected by City. 4. TERM This Agreement shall commence on the date first written above and terminate on June 30, 2009, unless terminated earlier in accordance with Section 13, below. The term of this Agreement may be extended upon a writing executed by the Executive Director of Planning and Building and the City Attorney. 5. INDEPENDENT CONTRACTOR Consultant shall, during the entire term of this Agreement, be construed to be an independent contractor and not an employee of the City. This Agreement is not intended nor shall it be construed to create an employer-employee relationship, ajoint venture relationship, or to allow the City to exercise discretion or control over the professional manner in which Consultant performs the services which are the subject matter of this Agreement; however, the services to be provided by Consultant shall be provided in a manner consistent with all applicable standards and regulations governing such services. Consultant shall pay all salaries and wages, employer's social security taxes, unemployment insurance and similar taxes relating to employees and shall be responsible for all applicable withholding taxes. 6. INSURANCE Prior to undertaking performance of work under this Agreement, Consultant shall maintain and shall require its subcontractors, if any, to obtain and maintain insurance as described below: a. Commercial General Liability Insurance. Consultant shall maintain commercial general liability insurance naming the City, its officers, employees, agents, volunteers and representatives as additional insured(s) and shall include, but not be limited to protection against claims arising from bodily and personal injury, including death resulting therefrom and damage to property, resulting from any act or occurrence arising out of Consultant's operations in the performance of this Agreement, including, without limitation, acts involving vehicles. The amounts of insurance shall be not less than the following: single limit coverage applying to bodily and personal injury, including death resulting therefrom, and property damage, in the total amount of $1,000,000 per occurrence. Consultant shall supply City with a fully executed additional insured endorsement in substantially the form attached hereto as Exhibit B upon execution of this Agreement and shall be approved in form by the City Attorney. b. Business automobile liability insurance, or equivalent form, with a combined single limit of not less than $1,000,000 per occurrence. Such insurance shall include coverage for owned, hired and non -owned automobiles. c. Worker's Compensation Insurance. In accordance with the provisions of Section 3300 of the Labor Code, Consultant, if Consultant has any employees, is required to be insured against liability for worker's compensation or to undertake self-insurance. Prior to commencing the performance of the work under this Agreement, Consultant agrees to obtain and maintain any employer's liability insurance with limits not less than $1,000,000 per accident. d. Professional liability (errors and omissions) insurance, with a combined single limit of not less than $1,000,000 per claim. e. The following requirements apply to the insurance to be provided by Consultant pursuant to this section: (i) Consultant shall maintain all insurance required above in full force and effect for the entire period covered by this Agreement. (ii) Certificates of insurance shall be furnished to the City upon execution of this Agreement and shall be approved in form by the City Attorney. (iii) Certificates and policies shall state that the policies shall not be canceled or reduced in coverage or changed in any other material aspect without thirty (30) days prior written notice to the City. f. If Consultant fails or refuses to produce or maintain the insurance required by this section or fails or refuses to furnish the City with required proof that insurance has been procured and is in force and paid for, the City shall have the right, at the City's election, to forthwith terminate this Agreement. Such termination shall not effect Consultant's right to be paid for its time and materials expended prior to notification of termination. Consultant waives the right to receive compensation and agrees to indemnify the City for any work performed prior to approval of insurance by the City. INDEMNIFICATION Consultant agrees to and shall indemnify and hold harmless the City, its officers, agents, employees, consultants, special counsel, and representatives from liability: (l) for personal injury, damages, just compensation, restitution, judicial or equitable relief arising out of claims for personal injury, including health, and claims for property damage, which may arise due to negligent acts, omissions or willful misconduct in the performance, from the direct or indirect operations of the Consultant or its contractors, subcontractors, agents, employees, or other persons acting on their behalf which relates to the services described in section I of this Agreement; and (2) from any claim that personal injury, damages, just compensation, restitution, judicial or equitable relief is due by reason of the terms of or effects arising from negligent acts, omissions or willful misconduct in the performance of this Agreement. The Consultant further agrees to indemnify, hold harmless, and pay all costs for the defense of the City, including fees and costs for special counsel to be selected by the City, regarding any action by a third party asserting that personal injury, damages, just compensation, restitution, judicial or equitable relief due to personal or property rights arises by reason of effects arising from this Agreement. City may make all reasonable decisions with respect to its representation in any legal proceeding. 8. CONFIDENTIALITY If Consultant receives from the City information which due to the nature of such information is reasonably understood to be confidential and/or proprietary, Consultant agrees that it shall not use or disclose such information except in the performance of this Agreement, and further agrees to exercise the same degree of care it uses to protect its own information of like importance, but in no event less than reasonable care. "Confidential Information' shall include all nonpublic information. Confidential information includes not only written information, but also information transferred orally, visually, electronically, or by other means. Confidential information disclosed to either parry by any subsidiary and/or agent of the other parry is covered by this Agreement. The foregoing obligations of non-use and nondisclosure shall not apply to any information that (a) has been disclosed in publicly available sources; (b) is, through no fault of the Consultant disclosed in a publicly available source; (c) is in rightful possession of the Consultant without an obligation of confidentiality; (d) is required to be disclosed by operation of law; or (e) is independently developed by the Consultant without reference to information disclosed by the City. 9. CONFLICT OF INTEREST CLAUSE Consultant covenants that it presently has no interests and shall not have interests, direct or indirect, which would conflict in any manner with performance of services specified under this Agreement. 10. NOTICE Any notice, tender, demand, delivery, or other communication pursuant to this Agreement shall be in writing and shall be deemed to be properly given if delivered in person or mailed by first class or certified mail, postage prepaid, or sent by telefacsimile or other telegraphic communication in the manner provided in this Section, to the following persons: To City: Clerk of the City Council City of Santa Ana 20 Civic Center Plaza (M-30) P.O. Thereafter, any communication shall be addressed and transmitted to the new address. If sent by mail, communication shall be effective or deemed to have been given three (3) days after it has been deposited in the United States mail, duly registered or certified, with postage prepaid, and addressed as set forth above. If sent by telefacsimile, communication shall be effective or deemed to have been given twenty-four (24) hours after the time set forth on the transmission report issued by the transmitting facsimile machine, addressed as set forth above. For purposes of calculating these time frames, weekends, federal, state, County or City holidays shall be excluded. It. EXCLUSIVITY AND AMENDMENT This Agreement represents the complete and exclusive statement between the City and Consultant, and supersedes any and all other agreements, oral or written, between the parties. In the event of a conflict between the terms of this Agreement and any attachments hereto, the terms of this Agreement shall prevail. This Agreement may not be modified except by written instrument signed by the City and by an authorized representative of Consultant. The parties agree that any terms or conditions of any proposal or other instrument that are inconsistent with, or in addition to, the terms and conditions hereof, shall not bind or obligate Consultant nor the City. Each party to this Agreement acknowledges that no representations, inducements, promises or agreements, orally or otherwise, have been made by any party, or anyone acting on behalf of any party, which are not embodied herein. 12. ASSIGNMENT Inasmuch as this Agreement is intended to secure the specialized services of Consultant, Consultant may not assign, transfer, delegate, or subcontract any interest herein without the prior written consent of the City and any such assignment, transfer, delegation or subcontract without the City's prior written consent shall be considered null and void. Nothing in this Agreement shall be construed to limit the City's ability to have any of the services which are the subject to this Agreement performed by City personnel or by other consultants retained by City. 13. TERMINATION This Agreement may be terminated by the City upon thirty (30) days written notice of termination. In such event, Consultant shall be entitled to receive and the City shall pay Consultant compensation for all services performed by Consultant prior to receipt of such notice of termination, subject to the following conditions: a. As a condition of such payment, the Executive Director may require Consultant to deliver to the City all work product completed as of such date, and in such case such work product shall be the property of the City unless prohibited by law, and Consultant consents to the City's use thereof for such purposes as the City deems appropriate. b. Payment need not be made for work which fails to meet the standard of performance specified in the Recitals of this Agreement. 14. DISCRIMINATION Consultant shall not discriminate because of race, color, creed, religion, sex, marital status, sexual orientation, age, national origin, ancestry, or disability, as defined and prohibited by applicable law, in the recruitment, selection, training, utilization, promotion, termination or other employment related activities. Consultant affirms that it is an equal opportunity employer and shall comply with all applicable federal, state and local laws and regulations. 15. JURISDICTION - VENUE This Agreement has been executed and delivered in the State of California and the validity, interpretation, performance, and enforcement of any of the clauses of this Agreement shall be determined and governed by the laws of the State of California. Both parties further agree that Orange County, California, shall be the venue for any action or proceeding that may be brought or arise out of, in connection with or by reason of this Agreement. 16. PROFESSIONAL LICENSES Consultant shall, throughout the term of this Agreement, maintain all necessary licenses, permits, approvals, waivers, and exemptions necessary for the provision of the services hereunder and required by the laws and regulations of the United States, the State of California, the City of Santa Ana and all other governmental agencies. Consultant shall notify the City immediately and in writing of its inability to obtain or maintain such permits, licenses, approvals, waivers, and exemptions. Said inability shall be cause for termination of this Agreement. 17. MISCELLANEOUS PROVISIONS a. Each undersigned represents and warrants that its signature hereinbelow has the power, authority and right to bind their respective parties to each of the terms of this Agreement, and shall indemnify City fully, including reasonable costs and attorney's fees, for any injuries or damages to City in the event that such authority or power is not, in fact, held by the signatory or is withdrawn. b. All Exhibits referenced herein and attached hereto shall be incorporated as if fully set forth in the body of this Agreement. Over the past 34 years, he has completed projects on behalf of public works departments, utilities, water districts, cities and counties, federal agencies, transportation authorities, and developers, as well as research work in plant ecology. Dr. St. John specializes in restoration and revegetation programs as well as maintenance and success monitoring of riparian and other native habitats. His work has included wildlife corridors, streambeds and rivers, wetlands, highways, landfills, pipelines, and post -fire sites. This work has been carried out in desert, coastal and mountain areas. He is an expert in native plant species, selection of seed material, verification of specifications, and installation methodologies. His education and experience include a range of disciplines in several native environments, contributing to a perspective on ecosystem function that is unique among scientists and restoration practitioners. His career objective is to move restoration away from landscaping methods and toward methods based on ecological science. During his research career, he broke new ground on several fronts, including a new fundamental mechanism by which mycorrhizal fungi assist in the acquisition of plant nutrients. He is largely responsible for introducing mycorrhizal inoculation and land imprinting into standard restoration methodology in southern California, and has influenced other restorationists toward ecological thinking. He has a Ph.D., Physiological Plant Ecology, University of California, Irvine. Mike McEntee, Principal Biologist - Mr. McEntee has a comprehensive background in biological resources management and CEQA/NEPA compliance. He has assisted with the implementation of mitigation programs for large-scale projects, performed restoration and exotic species removal as well as mitigation monitoring. His experience includes providing biological resource services for projects located in desert environments. He conducts surveys for endangered species following USFWS and CDFG protocols in compliance with the Endangered Species Act. He has conducted nest monitoring for federal - and state- listed species, trapping of brown -headed cowbirds, reconnaissance -level and detailed wildlife surveys, small and large mammal trapping, and investigated environmental impacts to biological resources and habitats. CULTURAL SERVICES Patrick Maxon, RPA, Cultural Resources Department Manager - Mr. Maxon has 13 years of experience in cultural resources management and compliance monitoring involving archaeological, paleontological, prehistoric and historic resources. He is a Registered Professional Archaeologist. He has expertise in compliance with the NEPA, CEQA, National Historic Preservation Act, Archaeological Resources Protection Act, Native American Graves Protection and Repatriations Act, as well as the Clean Water Act. He is a Registered Professional Archaeologist as well as certified by the County of Orange Environmental Management Agency. Mr. Maxon has completed more than 200 cultural resource projects involving research, reconnaissance, testing, data recovery, monitoring, site recording, site protection/preservation, mapping, laboratory analysis, and report production. He has managed a number of projects under review by the U.S. Army Corps of Engineers, requiring permits under Section 404 of the Clean Water Act as well as compliance with Section 106 of the NHPA. These projects involved agency, client, Native American and subcontractor coordination, development of treatment plans and research designs, site testing, data recovery excavation, site protection, reinterment of human remains, laboratory analysis and report production. The project involved preparation of an IS/MND to examine the changes in operations associated with the new West Quarry, which moved operations across Portola Parkway. The existing operation was originally approved by the County of Orange in 1965, with commencement of operations in 1996. The most recent site usage entitlement was also granted by the County of Orange in 1992. The project site now falls within the jurisdiction of the City of Lake Forest. Lead Agency authority for County permits transferred to the City of Lake Forest at the time of incorporation. The application for a new operations permit (to replace County approval) and an amendment to the reclamation plan were intended to supercede the previous entitlements, but without conceding any pre-existing vesting or rights under SMARA. Environmental Impact Statement (EIS)/Environmental Impact Report (EIR) for Operations and Maintenance Manual for San Diego Creek In -Line Basins County of Orange, Resources & Development Management Department A joint EIS/EIR for the Special Area Management Plan (SAMP)lMaster Streambed Alteration Agreement (MSAA) for the San Diego Creek Watershed was prepared by the U.S. Army Corps of Engineers (USAGE), Los Angeles District, and the California Department of Fish and Game (CDFG). The San Diego Creek Watershed is located in central Orange County and covers approximately 112 square miles. This watershed encompassed portions of unincorporated Orange County and the Cities of Irvine, Tustin, Santa Ana, and Lake Forest. Upon approval of the EIS/EIR, the USACE and CDFG will establish an alternate, systematic, programmatic permitting process for applicants who perform effective pre - application coordination with the USACE and CDFG, develop projects that comply with the permitting guidelines, and propose effective mitigation for unavoidable impacts. In addition, the California Regional Water Quality Control Board (RWQCB), Santa Ana Region, may utilize this joint EIS/EIR for a Section 401 Certification for a programmatic permit using the Notice of Intent process. The majority of this portion of Planning Area 9 was in an unincorporated portion of Orange County, within the City of Irvine sphere of influence. The project site, which consisted of approximately 677 acres, was proposed to be separated into a new planning area, to be designated as Planning Area 40. The project included a General Plan Amendment changing land currently designated for Agricultural use to Research and Industrial uses, and adding development intensity. The Zone Change under consideration changed land currently zoned Development Reserve and Conservation Open Space Reserve to General Industrial and Medical and Science designations. The project also included the extension of the Jeffrey Open Space Spine on land designated for Recreation. The project site was bounded by Interstate 5, Jeffrey Road, Trabuco Road, and the closed EI Toro Marine Corps Air Station. The environmental documentation for the proposed actions, including the Initial Study and Program EIR, as well as technical reports for air quality, noise, and water quality was prepared. Technical studies submitted by TIC on traffic, soils, hydrology, cultural resources, biology, Level 1 Environmental Assessment, growth management phasing plan, fiscal analysis, and a eucalyptus windrow study, was evaluated and incorporated into the environmental documents. The project also included management of the public participation and outreach efforts for the City. City of Irvine Annexation No. 17 General Plan Amendment, Zone Change/Pre-Zoning EIR - For the Millennium Plan Phase 11 Biological Resources Survey City of Irvine This project entailed the evaluation of biological resources pertaining to the annexation and development of the EI Toro MCAS by the City. The proposed activities are based on the City of Irvine's Millennium Plan — Phase II, which would convert the entire MCAS EI Toro site (approximately 4,738 acres), into a planned mixed-use community. The Millennium Plan includes a reduction in the overall development density (compared to the County plan) and the provision of a wildlife corridor along the southern boundary of the site. In reviewing the City of Irvine's Millennium Plan, a general biological reconnaissance survey of the entire site was conducted, as well as an evaluation of the Millennium Plan's proposed wildlife corridor, and review of biological issues addressed in the previous Draft Annexation EIR (EIR 563). Professional Program Management Services-CEQA Regulatory Approval/Permitting, Paleontology Discoveries Services, Cultural & Natural Resource Management Services Orange County Great Park Corporation Once a formidable military base in Orange County, the former Marine Corps Air Station, EI Toro, located in Irvine, will be transformed into the 1,347 -acre Orange County Great Park. The Great Park will be a multi -use metropolitan park, developed on the land that was a gift to the City of Irvine from Lennar Corporation. Chambers Group, is participating as part of the overall Program Management team of Bovis Lend Lease to provide expertise with the natural resources, cultural resources and permitting activities associated with the Great Park. As part of the Program Management duties, Chambers has developed Paleontological, Cultural Resource and Natural Resource Protocol Plans. Chambers reviewed prior Environmental Documentation, prepared before the actual development of the Orange County Great Park was initiated with the updated Master Plan for the development. This was done to see if the Environmental Impact Report/Environmental Impact Statement (EIR/EIS) was still compatible with the new Master Plan and to provide a determination of what supplemental studies might be required in order to be able to use the existing EIR with modification or supplemental studies.This Great Park will provide extensive natural areas as well as recreational and designated areas for cultural use. The revitalized area will breathe new life into Orange County and the natural community. It is anticipated that the park will be designed in three unique areas: fields, canyon and habitat. The designated fields will recognize the agricultural and military history as well as include sports and recreation activities. The canyon will feature a two and one-half mile long canyon, transforming the current flat and featureless terrain into hills, terraces and a lake for various uses and activities. Serrano Creek Community Park Habitat Mitigation Project City of Lake Forest As -needed Maintenance Monitoring. Chambers Group will provide expert guidance and recommendations for ongoing maintenance activities and remedial measures and will conduct (as - needed) monitoring of habitat mitigation and maintenance activities to ensure compliance with relevant conditions of the applicable regulatory permits and adherence to the existing Habitat Management Plan for the Serrano Creek Community Park Project. This project included the construction of the Viejo Substation on a 12.5 -acre site adjacent to SR 241 in the City of Lake Forest, the addition of a new 3.1 - mile 66 kV line between the Chiquita and Viejo Substations, the replacement of 20 double -circuit tubular steel poles with 13 H -frame structures, and the replacement of three 220 kV lattice towers to relocate 0.3 miles of 220 kV line into the Viejo Substation. The proposed project will improve reliability and meet projected electrical load requirements in the south Orange County area. The project route traversed hillside residential areas south of SR 241 (Foothill Transportation Corridor) through the communities of Mission Viejo and Lake Forest. Adjacent land uses primarily included residences and parks. The proposed Viejo Substation site was located adjacent to a business park just north of SR 241. The proposed Viejo Substation was also located within a large culturally sensitive area north of EI Toro Road which encompassed several specific resource sites. Irvine Guideway Demonstration Project EIR Parsons Brinkerhoff Quade & Douglas, Inc. Chambers Group prepared the Biological Resources and Cultural Resources sections of the Guideway Demonstration Project EIR for the City, as a subconsultant to Parsons Brinckerhoff,. Chambers Group conducted literature reviews, record searches, and a reconnaissance -level biological survey of the project area to characterize the general environmental conditions and assess potential impacts on biological and cultural resources in the project area. Initial Study/Mitigated Negative Declaration for Conditional Use Permit 39150 for Irvine Hand Car Wash City of Irvine The project site is located at 18011 Culver Drive, in the southwest corner of Culver Drive and Michelson Street. The applicant, J.M. Burnstine Company, requested approval of Conditional Use Permit 39150 - CPU to allow modification of an existing full service car wash center. The proposed components include a lube shop, customer lounge and other minor modifications. An Initial Study/Mitigated Negative Declaration, in accordance with CEQA Section 21000 and the City of Irvine CEQA Procedures, was prepared for Conditional Use Permit 39150. Peer Review for Harvard Square Project City of Irvine Chambers Group conducted a peer review for the City, of applicant -prepared studies including geotechnical, cultural/paleontological, Phase I site assessment, and noise studies. The technical studies were prepared for proposed Zane Change 40619-ZC, Tentative Tract 40620 -TT, Master Plan 40622 -MP, and Park Plan 40625 -PP (Parklane Homes). Chambers Group 9 Certified Disabled Veteran Business Enterprise • Small Business Enterprise 11 CITY OF SANTA ANA ENVIRONMENTAL CONSULTANTING SERVICES QUALIFICATIONS Archaeological Data Recovery Excavations - Zone 4 and Zone D Booster Pumping Stations Project Irvine Ranch Water District Archaeological data recovery excavations were conducted within the Bonita/Coyote Canyon drainage about 2.5 miles southeast of the Newport Back Bay in Orange County for the Irvine Water District's construction of booster pumping stations as part of compliance with Appendix K of CEQA and its implementing guidelines. Ten data recovery units were excavated midden between May 30 and June 10, 1991. The data were analyzed in the context of previous test excavations conducted at the same site for the San Joaquin Hills Transportation Corridor project. The purpose of the excavations was to obtain a representative scientific sample of cultural material from that part of the site to be directly impacted by the construction. A comprehensive report was prepared of the data analysis, including several detailed appendices. Biological Resource Analysis of Environmental Health and Safety Services Building Site University of California at Irvine University of California, Irvine (UCI) planned to build an Environmental Health and Safety Services facility on approximately 3 acres of undeveloped land in the west campus area. Chambers Group conducted a biological survey to characterize the general vegetation and wildlife resources at the site, evaluate the site's potential to support sensitive plant and animal species, assess potential impacts of development on these resources, and verify the applicability of the Long Range Development Plan EIR mitigation measures to reduce or eliminate significant impacts of the project. Ford Road Archaeological Test Program and Construction Monitoring Sverdrup Corporation An archaeological test program was conducted for five sites in the New Ford Road right-of-way in Irvine, Orange County, California. Shovel test probes were used to assess site boundaries and units were used to sample site contents and assess integrity. The five sites were evaluated for NRHP eligibility as part of the Section 106 process. The Corps of Engineers was the lead agency because a Section 404 permit was required for road construction. A data recovery plan for mitigation of the two eligible sites to be impacted by road construction was prepared and approved by the Corps, State Historic Preservation Officer, and the Advisory Council on Historic Preservation. Monitoring of construction was also performed under this contract. Data Recovery at CA -ORA -106 and CA -ORA -482, Ford Road Project Sverdrup Corporation Data recovery excavations were conducted at ORA -106 and ORA -482 on Bonita Mesa in Irvine. Work was limited to the portions of the sites being impacted by road construction. A magnetometer program was performed at ORA -106 to locate fire -affected rock features. Seven features were located and excavated. A total of 104 systematically and judgmentally placed 1m by 1m excavation units were completed at ORA -105, and 15 systematically placed units were excavated at ORA -482. Research goals included determination of functional site type, reconstruction of activities, and obtaining evidence for resource intensification, including fire management. In addition to lithic and faunal analyses, obsidian hydration and sourcing, macrobotanical analysis, and organic residue analysis were performed. This was done to supplement previous studies and for inclusion in an EIR for the University's Long Range Development Plan. Detailed surveys were conducted of all biological resources, including sensitive plants and bird species. The study included a detailed burrowing owl survey, surveys for the California gnatcatcher and cactus wren, and a rare plant survey for Dudleya multicaulis, which is known to occur on the campus. The sensitive bird surveys determined the locations of these species throughout the campus. Special emphasis was placed on the locations of cactus wrens and California gnatcatchers in the Biological Reserve. The locations of paired birds were documented. Various campus experts were also consulted for data and expertise on the biological resources present on campus. The study included preparation of a detailed mitigation program. Permit Acquisition Assistance (404, 1601, and Certification of 401 Analyses) and Wetlands Determination for Haul Road Crossing Irvine Ranch Water District and Serrano Irrigation District This project entailed strategizing with the Irvine Ranch Water District and the Serrano Irrigation District regarding the acquisition of Corps of Engineers 404, California Department of Fish and Game 1601, and Regional Water Quality Certification 401 permits for the proposed construction of a bridge crossing Santiago Canyon Road at Limestone Canyon in Orange County. Jurisdictional wetlands were determined by identifying hydrophytic vegetation, hydric soil, and wetlands hydrology. Biological Resource Analysis for Campus House II Building Site University of California at Irvine UCI planned to build a support services facility called "University House II" on approximately 5 acres of undeveloped land. A biological survey was conducted to characterize the general vegetation and wildlife resources at the site, evaluate the site's potential to support sensitive plant species, assess potential impacts of development on these resources, and verify the applicability of the Long Range Development Plan EIR mitigation measures to reduce or eliminate significant impacts of the project. Biological Resources Services for Tesoro High School Expansion Culbertson, Adams & Associates Project involved biological resources services in support of infrastrucure expansions at Tesoro High School, located in Rancho Santa Margarita, Orange County. Specifically, the two sites at the high school include a parking lot and ball field expansion. Following the biological reconnaissance -level survey conducted for the parking lot expansion, a letter report was prepared addressing potential project impacts to the coastal California gnatcatcher. The biological reconnaissance -level survey for the ball field expansion included vegetation mapping and a sensitive species habitat assessment. The results of the survey were summarized in a detailed biological technical report of findings. Cultural Resources Services at CA -ORA -196 at Michelson and San Diego Creek Irvine Ranch Water District Previous work performed at CA -ORA -196 was reviewed and evaluated to delineate the boundaries in order to avoid impact to the site during construction of a 7 -acre demonstration garden complex and associated facilities. All past work completed at the site was reviewed and a series of shovel test pits were conducted to more precisely define the northwestern, western, and southern boundaries. The biological sensitivity of alternative sites for a reservoir tank, access road, and pipeline to enhance a reclaimed water system in the Turtle Rock area of Irvine was evaluated. This information was used to select a final site. Although no direct impacts on the California gnatcatcher or sensitive plant species were noted, indirect impacts on the gnatcatcher were predicted if construction occurred during the breeding season. The final report presented mitigation measures to reduce these impacts to levels that would not be significant. Biological Services at South Regional Landfill Operations, San Juan Capistrano Orange County Integrated Waste Management Department. The project involves restoration monitoring, IWMD and Technical Staff coordination, project/cost control, performance monitoring, development/update of restoration plans, nursery coordination, and expert restoration advice for biological services provided at the Prima Deschecha Landfill. Archaeological Monitoring for the Carbon and Michelson Berm Project, San Joaquin Marsh Irvine Ranch Water District This project consisted of constructing a berm along two streets surrounding the San Joaquin Marsh ecological preserve. Construction activities for this project that had the potential to affect cultural resources were monitored. The project also involved the copying of a known archaeological site and the removal of brush on another. Construction crews were guided around the sensitive areas and no impacts to cultural resources resulted from the project. OTHER PROGRAM EIR EXPERIENCE Program EIR for Proposed Geothermal Development of State Lands within the Geysers Area California State Lands Commission This EIR addressed worst-case scenario impacts of potential leasing and geothermal development of lands within The Geyser-Calistoga Known Geothermal Resource Area. The total project area consisted of three sites covering approximately 6,230 acres, and included portions of Lake, Mendocino, and Sonoma Counties. Potential impacts associated with development -related activities were addressed, such as surface and shallow exploration and exploratory drilling, as well as impacts resulting from full- scale geothermal development, including production wells, pipelines, power plants, system operation, and maintenance and abandonment. The principal areas of analysis included systems safety, land use, geology and physiography, surface water and groundwater hydrology, biological and cultural resources, transportation, air quality, acoustical environment, socioeconomic and public services, and aesthetics. The document also addressed the project's cumulative effects in relation to other developments in The Geyser Steam Field and forecasted remaining steam resource development. GIS analysis was used to help identify the most environmentally sensitive alternatives and create a suitability model for the project. Scenarios were established to evaluate 6,000 acres of land according to seismic safety, land use, geology, surface and groundwater hydrology, biological and cultural resources, transportation, air quality, acoustical environment, and aesthetics. Site suitability was analyzed with the GIS to identify the most sensitive alternatives. Supplement to Program EIR for City of Brea Downtown Brea Master Plan City of Brea This project entailed preparation of the Draft and Final Supplement to the Program EIR, which evaluated the environmental issues resulting from the development of the Downtown Brea Master Plan Project Area, consisting of 59 acres. Since Master Plan Program EIR approval, conditions had changed relating to the disposition of some of the potentially historic resources.
