Adopt a resolution authorizing the submittal of a grant application in
the amount of $75,000 to the California State Parks Habitat Conservation
Fund Program for the Santiago Creek Butterfly and Bird Habitat Project.

DISCUSSION
The Habitat Conservation Fund Program was established under the
California Wildlife Protection Act of 1990 and provides grant funds for
the enhancement, restoration and interpretation of riparian habitats
throughout the State. Approximately $2 million will be available this
funding cycle. The grant application requires a 50-percent match of non-
State money, which is available in the Ci ty' spark acquisition and
development fund. Applications are due on October 1, 2008.
The Parks, Recreation and Community Services Agency proposes to submit an
application for the Santiago Creek Butterfly and Bird Habi tat. The
habitat will be located at the southern edge of Fisher Park adjacent to
the Santiago Creek bed. The project is an effort to create and maintain
a thriving natural habitat that will attract rare and endangered
butterfly and bird species. The project scope includes the removal of
non-native vegetation, elimination of invasive species, and planting of
native plants and flowers.
FISCAL IMPACT
There is no fiscal impact associated with this action.

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA APPROVING
THE APPLICATION FOR GRANT FUNDS
UNDER THE HABITAT CONSERVATION FUND PROGRAM
FOR THE SANTIAGO CREEK BUTTERFLY
AND BIRD HABITAT PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines and
declares as follows:
A. The people of the State of California have enacted the California Wildlife Protection
Act of 1990, which provides funds to the State of California for grants to local agencies to acquire,
enhance, restore or develop facilities for public recreation and fish and wildlife habitat protection
purposes; and
B. The State Department of Parks and Recreation has been delegated the
responsibility for the administration of the Habitat Conservation Fund (HCF) Program, setting up
necessary procedures governing Project Application under the HCF Program; and
C. Said procedures established by the State Department of Parks and Recreation
require the applicant City to certify by resolution the approval of Application(s) before submission
of said Application(s) to the State; and
D. The City will enter into a Contract with the State of California to complete the
Project(s);
Section 2. The City Council approves the filing of an Application for the Habitat
Conservation Fund Program in the amount of $75,000; and
Section 3. The City Council certifies that:
1. The City has or will have available, prior to commencement of any
work on the Project included in this Application, the required match and
sufficient funds to complete the Project; and
2. The City will have sufficient funds to operate and maintain the
Project(s), and
3. The City shall prepare, with full public participation, a management
plan for lands that have been acquired with HCF funds, which plan

shall reasonably reduce possible conflicts with neighboring land use
and landowners, including agriculturists, and
4. The City has reviewed, understands, and agrees to the General
Provisions contained in the Contract shown in the Procedural Guide;
and
Section 4. The City Council delegates authority to the City Manager or the Executive
Director of the Parks, Recreation and Community Services Agency to conduct all negotiations,
execute and submit all documents, including, but not limited to applications, agreements,
amendments, payment requests and so on, which may be necessary for the completion of the
Project.
Section 5. The City Council agrees to comply with all applicable federal, state and local
laws, ordinances, rules, regulations and guidelines.
