This Amendment shall be administered by 14 County of Orange Social Services Agency, hereinafter referred to as °ADMINISTRATOR.' 15 16 WITNESSETH: 17 18 WHEREAS, the Workforce Investment Act of 1998 (WIA) Title I, chapter 3, Section 121 (c) 19 requires local W1B's to enter into an MOU with local partners regarding the operation of the One-~ 20 delivery system; and 21 22 WHEREAS, the Chief Elected Official and the Santa Ana WIB desire to extend the term of fhe N for an additional twenty months; and 23 24 WHEREAS, ADMINISTRATOR agrees to such extension; and 25 26 WHEREAS, the parties agree to continue to establish through Phis MOU the framework in wl 27 One-Stop services will be provided and foster the One-Stop partner commitments, entered into for 28 purpose of creating a primary, singular delivery system under fhe WIA; a 1 ~ II NOW, THEREFORE, IT IS MUTALLYAGREED AS FOLLOWS: 1. Paragraph 3 of the MOU is hereby amended to read as follows: 3 "3, DURATION 4 This amendment to the MOU shall commence on January 1, 2009 and terminate on 5 30, 2010 or earlier if terminated by the repeal of the WIA of 1998. 6 This amendment to the MOU is of no force or effect until signed by the autho 7 representatives of the parties, and approved by the Chief Elected Official or his/her designee. 8 amendment to the MOU, once signed, becomes part of the WIA Plan. 9 This amendment maybe extended by written agreement between the parties provided agreement is signed by both parties, prior to the termination date of the amendment, and cor 10 the following: 11 A statement of intent to continue all provisions of the MOU; 12 Revised effective and termination dates; 13 Revised attachments as appropriate; 14 Dated signatures of the ADMINISTRATOR of the partner agency and the 15 Elected Official of the WIB." 16 2. Paragraph 7 of the MOU is hereby amended to read as follows: 17 ~~ "T. CONFIDENTIALITY: 18 The WIB agrees that when any individual applies for or receives services from and fhrou 19 the partner agency through the One-Stop Center, all information regarding such application for 20 receipt of services shall be confidential information subject to the provisions of 34 CFR 361.38. 21 22 The parties agree to honor the confidentiality provisions as described in the local WIA P1, 23 including modifications thereto, and incorporated into the MOU by reference. Paragraph 14 of the MOU is hereby amended to read as follows: "14. ACCESSIBILITY ASSURANCES AND CERTIFICATIONS: The parties agree to abide by all applicable non-discrimination federal and state laws. WIB and the One-Stop partners will ensure that policies and procedures established by the WIB the One-Stop partners are in compliance with the Americans with Disabilities Act (ADA). The Santa Ana WORK Center will assure its services and premises are accessible persons with disabilities under the requirements of the Americans with Disabilities Act." 4. HEALY CLERK Of fN+T C6UNCIL 4 I L~ ~ ~ ~ ~~ 2 3 6 7 10! 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Attachment "A" One-Stop Partner Commitment Parties: The parties to the Memorandum of Understanding (MOU) and Amendment to the MOU are the Mayor and City Council of the City of Santa Ana, the Santa Ana Workforce Investment Board (WIB), the County of Orange Social Services Agency and other agencies (identified in the "One Stop Partner Commitment', Attachment A" to the MOU) functioning as "One-Stop Partners" within the Santa Ana One-Stop System (hereinafter referred to as the Santa Ana WORK Center). In addition to accepting the provisions contained in the MOU and the Amendment to the MOU, the County of Orange Social Services Agency commits to the following: Agency services to be provided on-site at the Santa Ana WORK Center: Welfare Programs including but not limited fo CaIWORKs FuN-time equivalents (FTEs) of agency staff assigned to Santa Ana WORK Center Hours/days per week agency staff assigned to Santa Ana WORK Center: Monday-Friday 8:00 to 5:00 p.m. PERFORMANCE GOALS Customer Service A!I on-site, One-Stop partners shall commit fo the following goats for the WORK Center: 1 To conform to a uniform policy of customer service; 2 To develop customer service principles all One-Stop Partners must implement; 3 To implement an on-going system for measuring customer service levels; and 4 To participate in a task force empowered to oversee, measure and respond to customer service data. Quantifiable Service Outcomes Develop a uniform policy of customer service for the WORK Center. Measure customer service levels of users at the WORK Center and meet with partners to implement change as appropriate. The obligations of the county of Orange Social Services Agency under this MOU and Amendment are contingent upon the State budget; receipt of funds from and/or obligation of funds by the Federal government to the State and from the State to the County; and inclusion of sufficient funds for the services hereunder in the budget approved by the County's board of Supervisors for each fiscal year this MOU remains in effect. In the event that such funding is terminated or reduced, the Social Services Agency may immediately terminate this MOU or reduce the Agency's services. The decision ix4R~, 1 of the Social Services Agency shall be binding on the City of Santa Ana. The Social Services Agency shall provide the City of Santa Ana written notification of such determination.
