FIRST AMENDMENT TO AGREEMENT

THIS FIRST AMENDMENT TO AGREEMENT is entered into on December 12, 2008,
by and between Platinum Pool & Spa, a sole proprietorship ("Consultant") and the City of Santa
Ana, a charter city and municipal corporation organized and existing under the Constitution and
laws of the State of California ("City").
RECITALS:
A. The parties entered into that certain Agreement N-2008-095, dated July 1, 2008, (hereinafter
"said Agreement") by which Consultant has provided fountain maintenance and repair
services.
B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the
Scope of Services and increase compensation to pay for the additional services provided.
WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all
the terms and conditions of said Agreement, except [hose amended in this First Amendment to
Agreement, the parties agree as follows:
1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the
following:
"Consultant shall perform maintenance and repair services for the fountain(s) at the Santa
Ana Regional Transportation Center and the 2"" Street Mall, as set forth in Exhibit A to said
Agreement. Consultant may provide additional repair services for the described fountains.

parties agree that such additional services shall include Consultant's repair of the
recirculation pump for the fountain at the 2"d Street Mall, at a cost of $489."
2. Section 2, COMPENSATION, shall be amended to increase compensation by $2,000, to pay
for the additional services, as set forth in Section 1, above. The total amount available for
services pursuant to said Agreement shall not exceed $7,000.00 during the term of said
Agreement.
3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in
full force and effect.
