C TY MANAGER RECOMMENDED ACTION CLERK OF COUNCIL USE ONLY: APPROVED ^ As Recommended ^ As Amended ^ Ordinance on 15t Reading ^ Ordinance on 2"`' Reading ^ Implementing Resolution ^ Set Public Hearing For_ CONTINUED TO FILE NUMBER Authorize the City Manager and the Clerk of the Council to execute the attached agreement with Adlerhorst International, Inc. subject to non- substantive changes approved by the City Manager and City Attorney, to provide police service dog training services in an annual amount not to exceed $50,000. DISCUSSION Adlerhorst International, Inc. has been the City's exclusive provider and trainer of police service dogs since 1982. Adlerhorst International, Inc. is a nationally recognized company known for its experience and expertise in the selection, testing, and training of police service dogs. The Police Department currently has six police service dogs that were purchased from and trained by Adlerhorst. Staff recommends the execution of this agreement for consistency and efficiency in the operations of the canine unit. FISCAL IMPACT Funds are available in the Police Department's Animal Services fund account (no. 011-339-6291). APPROVED AS TO FUNDS AND ACCOUNTS: ICJ Paul M. Services Agency 25E-1 FIRST AMENDMENT TO CONSULTANT AGREEMENT THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered into on September 8, 2009, by and between Adlerhorst International, Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into Consultant Agreement A-2008-257, dated September 2, 2008 (hereinafter "said Agreement") by which Consultant has provided police canine training services. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend the term of said Agreement for an additional one year period, and to increase the compensation to pay for services during the extended term. Wherefore, in consideration of the mutual and respective covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2.a., COMPENSATION, shall be amended to add increased compensation not to exceed $50,000.00 to pay for services during the extended term. 2. Section 3, TERM, shall be amended to extend the term of said Agreement through September 30, 2010. 3. Except as amended hereinabove, all terms and conditions of said Agreement shall remain in full force and effect. // // // // // // 25E-3 IN WITNESS WHEREOF, City and Consultant have executed this First Amendment to Consultant Agreement on the date and year first written above.
