r~IRST AMENDMENT TO AGREEMENT
UNDER THE WORKFORCE INVESTMENT ACT
N-2009-070-001
THIS FIRST AMENDMENT TO AGREEMENT is entered into on July
1, 2009, by and between Enthusiast, Inc., hereinafter referred to as "Consultant", and the
City of Santa Ana, a charter city and municipal corporation duly organized and existing
under the Constitution and laws of the State of California, hereinafter referred to as
"City".
RECITALS:
A. The parties entered into that certain Agreement Under the Workforce Investment Act,
(N-2009-070) dated June 1, 2009 (hereinafter "said Agreement") by which
Consultant has provided web site and e-newsletter development and hosting services.
B. In accordance with the terms and conditions of said Agreement, the "Term" of said
Agreement may be extended by a writing executed by the Deputy City Manager for
Development Services and the City Attorney.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Agreement, the parties agree as follows:
1. Section 1, TIME PERIOD OF AGREEMENT, shall be amended to extend the term
through December 31, 2009.
2. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to
Agreement on the date and year first written above.
