HomeMy WebLinkAboutSANTA ANA POLICE OFFICERS ASSOCIATION (POA) (4) AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SANTA ANA AND THE SANTA ANA POLICE OFFICERS ASSOCIATION FOR FISCAL YEARS 1990-91, 1991-92, AND 1992-93 The Memorandum of Understanding between the City of Santa Ana and the Santa Ana Police Officers Association for Fiscal Years 1990-91, 1991-92 , and 1992-93, executed on December 10, 1990, is hereby amended as follows: 1. Section 3 of Article V, "Assignment and Other Special Pay Additives, " is amended to read as follows: "Section 3. Bilingual Pay. Qualified employees who meet the following criteria will be paid a monthly pay differential, above his or her base monthly salary step, as follows: A. Assignment by the Chief of Police or his designee to a position requiring bilingual capability in both English and one of the following languages: Spanish, Samoan, Vietnamese or other language designated by the City Manager; and B. Certified by the Chief Personnel Officer as having satisfactorily demonstrated the required level of conversational proficiency in both languages. C. Street Level Proficiency in Spanish. Effective July 16, 1992, a Police Officer or Police Sergeant who successfully meets the Street Level Proficiency requirements set out in the departmental Spanish training program shall be paid a bilingual pay differential in an amount equal to the product obtained by multiplying the base salary rate being paid to an employee in the rank of Police Officer Step "E" by two and one half percent (2 . 5%) (five [5] salary rate ranges) . 1. Employees receiving "Street Level Proficiency" incentive pay will be required, as a condition of continued eligibility to receive such incentive pay, to successfully complete an eight (8) hour refresher course once every twelve months from the date of initial certification. 2 . "Street Level Proficiency" is part of a pilot program and its success will be evaluated on an ongoing basis for; the next two years. If at any time it is clear to the City Manager that the program is not completely successful in delivering expected results, the program will cease to exist. However, the employees who had successfully completed the coursework and the qualifying examination will receive the bilingual pay for the duration of the current contract period, provided they meet the requirement as set forth in Subsection C, Paragraph 1, above. D. Complex Level Proficiency in Spanish. Effective July 16, 1992 , all employees in the classification of Police Officer who successfully meet the "Complex Level Proficiency" requirements set out in the departmental Spanish training program shall be paid a bilingual pay differential in an amount equal to the product obtained by multiplying the base salary rate then being paid to an employee in the rank of Police Officer, Step "E", by five percent (5. 0%) (ten [10] salary rate ranges) . This differential shall be paid only to those employees in the following classifications: Police Officer (320) , Police Officer (ATL) (639) , Police Officer (CSI Incentive) (325) , Police Officer (CSI + ATL) (638) , Police Officer (SR I incentive) (332) , Police Officer (SR I + ATL) (324) , Police Officer (SR II incentive) (321) , Police Officer (SR II + ATL) (322) , Police Officer (SR II + Patrol) (333) , Police Officer (SR III incentive) (327) , Police Officer (SR III + ATL) (328) , Police Officer (SR III + Patrol) (329) , Police Officer (SR III + ATL + Patrol) (331) , Police Officer (SR II + ATL + Patrol) (326) . E. Police Officers who, on or before July 1, 1992 , have already qualified and are receiving bilingual pay under the current program as outlined in the POA MOU for Fiscal Years 1990-91, 1991-92 , and 1992-93 will not be required to requalify under this new program guidelines. F. All employees in classifications, sworn or nonsworn, represented by this Agreement, other than those specifically described in Subsections C and D above, shall be paid a bilingual pay differential of one hundred fifty dollars ($150. 00) per month.
