INSURANCE NOT ON FILE <br /> WORE( MAY NOT PROCEED �-2023-97�-®�! <br /> CITY CLERK . <br /> DATE: DEC S B 2025 <br /> AMENDMENT TO AGREEMENT FOR THE DETENTION IN THE SANTA ANA CITY JAIL <br /> a; D W OF PERSONS TAKEN INTO CUSTODY BY <br /> Kp,gne-khWitk(A16(Dx) THE FOUNTAIN VALLEY POLICE DEPARTMENT <br /> THIS FIRST AMENDMENT to the above-referenced agreement is entered into on this 18th day of <br /> September,2025, by and between the City of Fountain Valley,a municipal corporation duly organized <br /> and existing under the Constitution and laws of the State of California(hereinafter"Agency"), and the <br /> City of Santa Ana, a charter city and municipal corporation duly organized and existing under the <br /> Constitution and laws of the State of California(hereinafter "City"). <br /> RECITALS <br /> A. The parties entered into an Agreement No. N-2023-170 dated July 1,2023 ("Agreement")by <br /> which City agreed to house detainees held in custody by the Fountain Valley Police <br /> Department for violation of California Penal Code §647(f),relating to being under the <br /> influence of alcohol, drugs or other controlled substance(hereinafter"§ 647(f)detainees"). <br /> The Agreement runs through June 30, 2026 and is current and in effect. <br /> K The parties now seek to amend the Agreement to include the housing of detainees charged <br /> under Penal Code §647(f)with citable misdemeanor warrants, with certain exceptions. <br /> The Parties therefore agree: <br /> I. Section 2,Scope of Services, is hereby amended to read as follows: <br /> City agrees to provide for the housekeeping, safekeeping and subsistence of§647(f) detainees of <br /> Agency, including those with citable misdemeanor warrants in accordance with this Agreement. <br /> This provision excludes detainees with citable warrants involving violence,a firearm, or resisting <br /> arrest. <br /> 2.
