Sagecrest and the subconsultant team will conduct a third-party Peer Review of the IS/MND and associated studies prepared by Michael Baker International. Sagecrest will attend meetings with Planning staff as necessary and at least four (4) public hearings to provide staff support during public meetings as needed, including responding to Planning Commission and City Council inquiries regarding the technical rf2 analysis. Sagecrest's work plan details our approach to developing, managing, and - implementing all actions for the Peer Review as follows: Task 1 - Kick-Off Meeting/Request for Information The Sagecrest project manager will meet with the City project manager to discuss the project and request/receive all project related materials necessary to conduct the IS/MND Peer Review. Task 1 Deliverable(s): Attendance at kick-off meeting Task 2 - Technical Studies Peer Review Upon receipt of the Notice to Proceed (NTP), Sagecrest will review the Fiscal Impact and Economic Benefit Analysis, Air Quality, Greenhouse Gas, and Energy Study, Noise Study, General Biological Habitat Assessment, Jurisdictional Determination and Consistency Analysis Report, and Phase I Environmental Site Assessment prepared by the Applicant's consulting team. The purpose of this review is to ensure the technical studies adequately identify and, if necessary, mitigate all potential impacts from the proposed project in accordance with the City of Santa Ana and CEQA guidelines. Each technical study will be reviewed by specific technical specialists. The peer review deliverable will include mark-up PDF versions of the reports as well as preparation of a brief memorandum of findings that will include a bulleted list of general comments followed by bulleted lists of specific comments for the report, broken down by individual section. Finally, the peer reviews will conclude with a summary that highlights any issues identified in the reports and recommendations for moving forward. No supplemental background research will be completed as part of the peer review. Should additional research or tasks be required, Sagecrest will include appropriate recommendations in the peer review memorandum. Sagecrest assumes up to three rounds of peer review for the technical studies. The following tasks describe the sub-tasks for each technical study under Task 1. City of Santa Ana-CEQA Peer Review Services ano 0 SAGECREST PLANNING+ENVIRONMENTAL Task 2.1 - Peer Review of Air Quality, Greenhouse Gas, and Energy Technical Studies The following scope of work is proposed for the peer review of the air quality, greenhouse gas, and energy study: l. Obtain and review the latest copy of the Air/GHG/Energy technical study, analysis calculation worksheets, and relevant sections from the CEQA document, as applicable. 2. Review the applicable air quality and greenhouse gas standards and thresholds 3'- of significance that apply to the project vicinity. 3. Review the CalEEMod emissions output files to ensure that project emissions were adequately analyzed and identify any changes to default inputs that may require further explanation or support. 4. Review the daily criteria air pollutant emissions calculations and ensure the study properly identifies all applicable construction and operational air quality impacts associated with the project. 5. Review the annual GHG emissions calculations and ensure the study properly identifies all applicable GHG impacts associated with the project. 6. Review any proposed mitigation measures and project design features and ensure the study has adequately applied the appropriate emissions reductions. 7. Review the energy calculations and impact analysis discussion as it pertains to CEQA Guidelines, Appendix F, Energy Conservation requirements. 8. Provide up to three (3) rounds of peer review. The first peer review will address the initial technical study. The subsequent peer reviews will ensure that the first review comments are adequately addressed, if needed. All comments will be summarized in a formal memorandum. Task 2.2 - Peer Review of Noise Technical Study The following scope of work is proposed for the peer review of the noise study: 1. Obtain and review the technical noise study and relevant sections from the CEQA document. 2. Review the applicable noise and vibration standards and regulations that would apply to the project, including City of Santa Ana General Plan and Municipal Code requirements. 3. Confirm that the analysis adequately identifies the location(s) of any noise sensitive receptors in the project area. 4. Review the construction noise and vibration impact analysis methodology, findings and calculations, and application of applicable regulatory standards and thresholds. 6. RK will confirm that the technical study adequately identifies all potential sources of noise generated by the project and provides an adequate assessment of impacts to the surrounding community. 7. Review the appropriateness and effectiveness of any mitigation measures 4 recommended for the project, if necessary. 8. Provide up to three (3) rounds of peer review. The first peer review will address the initial technical study. The subsequent peer reviews will ensure that the first review comments are adequately addressed, if needed. All comments will be summarized in a formal memorandum. Task 2.3 - Peer Review of Transportation/VMT Study The following scope of work is proposed for the peer review of the transportation/VMT Study: 1. Obtain and review the technical transportation/VMT study and relevant sections from the CEQA document. 2. Review the standards and requirements for analyzing VMT impacts pursuant to the City of Santa Ana Traffic Impact Study Guidelines and VMT Thresholds of Significance that would apply to the project. 3. Review the application of the appropriate project VMT screening criteria and consistency with City of Santa Ana standards. 4. Review project trip generation calculations pursuant to ITE Trip Generation standards. 5. Review OCTAM VMT modeling estimates, project VMT impact analysis, and mitigation recommendations, as applicable. 6. This scope of work is focused only on the CEQA requirements for transportation and does not include reviewing the traffic impact study for level of service (LOS) operations and traffic engineering design standards. 7. Provide up to two (2) rounds of peer review. The first peer review will address the initial technical study. The second peer review will ensure that all comments and revisions are adequately addressed. All comments will be summarized in either a formal memorandum letter or comment table format. Task 2.5 - Peer Review of Phase l/Phase II, Soils Report, and WQMP The Sagecrest team will peer review Phase I/Phase 11, Soils Report, and WQMP of the administrative draft of the IS/MND. All comments will be summarized in a formal memorandum. Task 2.6 - Peer Review of Fiscal Impact and Economic Benefit Anafysis Sagecrest has partnered with Keyser Marston Assocaites. Inc. (KMA) to provide a peer review of the Fiscal Impact and Economic Benefit Analysis prepared by Zimmerman Group. KMA will ensure that all methodologies and figures are accurate. Task 2 Deliverable(s): Peer Review Memorandum Task 3 - Attendance at Public Hearings The Sagecrest Project Manager will attend three (3) public hearings and will provide staff support during public meetings, including responding to Planning Commission and City Council inquiries regarding the technical analysis, as needed. This task assumes the public hearings will be conducted in-person. Task 3 Deliverable(s): in-person attendance of public hearings Task 4 - Ongoing Project Management The Sagecrest Project Manager will attend meetings with Planning staff, as necessary. The maximum amount payable, regardless of the number of"disciplinary, actions" or the number of"insureds," shall be $25,000 per"policy period."The "company" shall not be obligated to defend any "disciplinary action," or pay any fine, penalty or award resulting from any "disciplinary action." 2. Pre-Claim Assistance And Prevention Services The "company"will pay, at its sole discretion, all reasonable fees, costs and expenses the "company" incurs in the investigation of a potential "claim" reported by the "insured" in accordance with the Reporting Of Claims And Potential Claims Condition. The reasonable fees, costs and expenses paid under this provision must be incurred prior to the date a "claim" is made. Once a "claim" is made "claim expenses" and "damages" incurred are subject to the terms, conditions and provisions of this policy. 3. FHA, OSHA And ADA Proceedings Reimbursement The "company"will reimburse the "insured" up to a maximum of$25,000 per "policy period" for all reasonable and necessary attorneys' fees, costs and expenses incurred by counsel in responding to regulatory or administrative actions brought directly against the "insured" by a governmental agency under the Fair Housing Act (FHA), Occupational Safety and Health Act (OSHA) or the Americans with Disability Act (ADA), provided that the regulatory or administrative action under FHA, OSHA and ADA is first commenced against the "insured" during the "policy period" and is the result of an "insured's" act, error or omission in the performance of"professional services."
