WEATHER AND LIGHTING:
The weathe r condition at 1724 hours was fa ir w ith clear skies with a temperature of approximately 77
degrees Fahrenheit. The vv ind s were at 8.1 mph coming from the south southwest. The weather
information was obtained from th e Weather Unde rground website at www.\,vtll1derground.com.
At the time of my atTi val , 1929 hours , the ground was dry and there was ample li ghting provided by the
sun, s treetlights and the lights at the Chevron Gas Station.
SCENE:
The scene was located wi thin the Che vron Gas Station property located at 2650 Not1h Grand A venue.
The business is located on the southwest corner of Grand and Fairhaven A venues. The C hevron Gas
convenience store is located on the south portion of the property with a self-service car wash attached
along the south side of the co n venience store. The entry to the car wash is along the west side and the
exit is on the east side. The entry/exit doors to the convenience store are located on the not1h side. There
are two marked parking s talls located "vest of the convenience store. There are 12 fuel stations north of
the convenience store with a 13 'O I " high roof over the fuel pumps. There is a dri veway along the north
side of the property. There is a driveway on the southeast side and on the not1heast side of the property.
The crime scene was being secured by yellow crime scene tape sec uring the east, and no11h perimeters.
There was a cinder block wall securing the south and west perimeter. There were Santa Ana Police
Officers posted at the north and east perimeter. The shopp ing center parking lot is concrete paved with
marked parking stalls and raised concrete curbs along the west, east, and not1h side of the property.
There were three Santa Ana Police Department marked police vehicles and two civi li an vehicles parked
west of the Chevron Gas convenience sto re . The two c ivilian ve hicles, a black primer Ford Explorer
with California lic ense #and a s ilver Toyota Highlander with California license
were in marked stall s south of th e three Santa Ana Police vehicles. Santa Ana Police unit #641 was
parked facing in a south direction. Santa Ana Police unit #92 1 was parked east of unit #641 fac ing in a
south direction wi th a s li ght ang le to the east. Santa Ana Police unit #927 was parked east of unit #921

Cali fornia licens e was parked ne xt to fuel pump #7 facing in a south direction. There were
c i vi li an vehicles parked next to fuel pumps 11 , 9 , 6 , 8 , and 5.
The firs t two officer in vo lved shootings occurred west of th e convenience store . The third officer
involved shooting occurred east of the convenience store just outside the exit of the se lf-serve car wash.

SUMMARY:
On T hursday, September 28 , 2017, detectives from the Santa Ana Police Department's Gang Unit
re ceived information that the male suspects who have been invol ved in se veral arme d robberies were
staying at the Civ ic Center Inn located at 2720 North Grand Avenue. At approximate ly 171 6 hours ,
three Gang Detectives in an unmarked s il ver Dodge Grand Caravan set up s urveillance in the
area. There were marked po lice vehicles nearby to conduct a stop in case the male suspects were
seen. Timothy ESPINOZA was obse rved standing on the dri ve r side of a black primer Ford Explore r

w ith California li ce nse a t the Chevron Gas Station locate d at 2650 North Grand Avenue. The
ve hicle was parked west of the conven ie nce store.
At approximate ly 1725 hours, Detectives advised ove r the police radio of an officer involved shooting at
the C hevron Gas Station located at 2650 North Grand Avenue. They r equested paramedics to respond
for a male suspect with a g unshot wo und to the ankle. The m a le passe nger, later identified as Thomas
ESPINOZA was detained pending fu rther investi gation.
The Orange County Fire A uthority (OCFDA) was s ummoned to render aid to Timothy ESPINOZA.
Timothy was transported to a local hos pital.
It was learned that Timothy and Thomas ESPINOZA are identical tw ins.
Several Santa Ana Police Office rs res ponded to the sce ne and set up a c rime scene perime ter using
yello w crime scene tape. Sergeant E. Ri va s #2679 arrived to the scene and ass igned himself as the scene
s uperv isor. Detectives from the S a nta Ana Police Department Homicide Unit , O ra nge County District
Attorney's Office Investigators, Orange County Crime Lab C rime Scene Investi g ators were called to the
scene and investigate the incident.
NARRATIVE :
Thursdav: September 28, 2017
1730 hours
I was contacted at home b y De tec ti ve Sergeant J. Rodrig uez #2 836 of the Santa Ana Police De pai1me nt
Homicide Section, w ho adv ised me of an officer inv olved s hooting that had jus t occurred at 2650 North
Grand Avenue. De tecti ve Sergeant Rodriguez re quested I respond and ass ist with the in vestigati o n.
1905 hours
De tective Sergeant Rodrig u ez briefed the assisting detective on the circ ums tances surrounding the
officer invo lve d shootin g . I was ass ig ned to handle the crime scene.
1938 hours
I atTived at the c rime scene and checked in w ith Officer Fradella #35 10 , w ho was maintaining the crime
scene personnel entry log.
2009 hours
Sergeant E . Rivas #2679 prov ided a briefing concerning the officer invo lve d shooting and the status of
the initial investigation by patrol officers. Present were Detectives from the Santa Ana Police
D epartme nt Homicide Unit, Orange County District Attorney Investi gators and Orange County C rime
Lab forens ic perso nnel.
On Thursday, September 28, 20 17, detectives from the Santa Ana Police D epartme n t's Gan g Unit
received informati on that the m a le su spects w ho hav e been invo lved in several armed robberies were
staying a t th e C iv ic Center Inn located at 2 72 0 North Grand A venue. At approximately 1716 hours,
three Gang Detectives in an unmarked silver Dodge Grand Caravan set up surveilla nce in the area.
There were marked police vehicles nearby to conduct a stop in case the male suspects were seen.
Timothy ESPINOZA was observed st anding on the driver side o f a black prime r Ford Explore r w ith
California li cense at the C h evron Gas Station located at 2 650 Not1 h Grand A ve nue. The

vehicle was par ked west of the conve nience s to re. Thomas ESPINOZA was on the passenger side of the
ve hicle.
At approximately 1725 hours, Detectives advised over the police radio of an officer involved shooting at
the Chevron Gas Station located at 2650 North Grand Avenue. They requested paramedics to respond
for a male suspect vvith a gunshot wound to the ankle. The male passenger, later identified as Thomas
ESPINOZA was d e tained pending further investigation.
Sergeant Ri v as advised us of the public safety statement pro v ided by Detective Corporal M. Lenm1on
#3 174. Corporal Lemmon advised that he had fired one gunshot at Thomas ESPINOZA. He added that
Detective N. Lopez #3296 fired one gunshot from an AR-15 at Thomas ESPINOZA. Thomas
ESPINOZA was taken into custody w ithout further incident. Detective D. Fernandez #3303 had fired
one gunshot at Timothy ESPINOZA. Sergeant Rivas added that Detective Lopez placed the AR-15 rifle,
he discharged, on the front passenge r seat of Santa Ana Police Department patrol vehicle #92 1.
Timothy ESPINOZA sustained a g unshot wound to his right foot and transported to Orange County
Global Medical Center for treatment. Thomas ESPINOZA vvas transp011 e d to the Santa Ana Po lice
Departme nt for further investigation.
Sergeant Rivas concluded the briefing and I was paired with Orange County District Attorney
Investigator M. Kendrick.
At the conclusion of the briefing, I walked the scene located within the Chevron Gas Station property at
2650 North Grand A ve nue. M e mbers of the Orange County Crime Lab began to document, photograph
and collect evid e nce.
The officer involv ed shooting occtm-ed along the west and east portion of th e Chevron Gas convenience
store. The convenience store is located on the south end of the property . Along the west side of the
convenience store, I observed three marked police vehicles, from west to east, identified a s 641, 92 1,
and 927. The vehicles emer gency lights were on. Parked in front of police ve hicle #921 was a black
prime r Ford Explorer w ith California li cense There was a .223 caliber cm1ridge case, bullet
and jacket fragments, a .40 cali ber cartridge case, several credit cards, hotel key cards, a knife,
methamphetamine pipe. keys and a California identification card w ith # belonging to
on the west s ide of the convenience store.
On the east side of the convenience store , I observed an address book, a wall et containing Timothy
ESPINOZA'S Cali fornia Ide ntification Card, a blue bandana, a b lack li ghter, a b lack ny lon fir st aid kit,
a pair of black sneakers, one white sock, one white sock with apparent blood, one .45 caliber ca11ridge
case, a striped orange/blue shirt and a gray/yellow pouch. The pouch contained a hy podermic syringe,
which contained approximate ly 30 units of a dark liquid substance.
Parked next to fuel pump #7 was a Santa Ana Police D epartme nt unmarke d police v ehicle , d escribed as
a si lver 2017 Dodge Grand Caravan with Cali forn ia license The van was facing south and
had a black s hi rt draped over the left s id e view minor.
2053 hours
SAPD Forensic Specialist M . Briano #3 173, Investigator M. Kendrick, C hevron Gas Incide nt Manager
and [ wal ked to the con venie nce store office. downloaded surveillance footage
of this inc ident. He do w nl oaded footage from cameras 7, 10 , 11, 12, a nd 16 onto a USB thumb drive,
which FS Briano provided.

FS Briano made a copy of the surveil lance footage and lat er booked the USB thumb drive into SAPD
Evidence (SAPD Evidence Item #2). Refer to Briano's supp lemental repo11 for further details .
The copy of the footage was later provided to In vest igator M. Kendrick.
2257 hours
Santa Ana Police Depa11ment vehicle #92 I was inspected. I observed a Daniel Defense model DDM4
with se ria l #DDM405714 l rifle resting on the front passenger seat. In our presence, Corporal Estrada
cleared the rifle. The rifle contained one cartridge in the chamber and 25 cartridges in the magazine.
There was a Remington 870 Tactical 12 gauge shotgun with serial #AB638 I 25M, which was fo und in a
locked shotg un rack. There was a clear green plastic cylindrical canister, which contained a green leafy
substance at the base of the rifl e/shotgun rack between the front passe nger and dri ver's seats. A Stanley

with serial #FW12579 a nd three ammunition pouches were loc ated . There were seven 40 mm projectiles
in two of the pouches and eight 40 mm projectiles in the third pouch.
Santa Ana Police Department vehicle #927 was inspected and there was no rifle or shotgun in the metal
rack.
The trunk was inspected. A Colt ARIS M16A I 5.56 mm cali ber rifl e w ith serial #1285956, a Colt AR I S
Ml6Al 5.56 mm caliber rifle w ith serial #1801390 in a nylon case, a Co lt AR I S M16Al 5.56 mm
caliber rifle with serial #5276763 and a Remington 870 Police Magnum shotgun with serial #A3355 12M
were located.

The unmarked Santa Ana Police D epartment s il ve r Dodge Grand Caravan (Lease #CR73073) was
inspected. A Danie l Defense model DDM4 rifle with serial #ODM4057328 , a Daniel Defense model
DDM4 rifle wit h seria l #DOM4057075 , and a tactical vest were observed behind the front passenger
seat.
In the rear cargo area, I observed a metal ram (breaching tool), ballistic shield, 2 he lme ts , a mi rror, and a
nylon case containing a Lewis Machine & Tool Company 40 mm launcher with se ri al #FW 12528.
Fifteen 40mm projectiles were also observed in the cargo area.
