TOTH #366 Approved By: Date of Report: 01/18/2021 Date: 01/22/2021 Page 1 of 4 CASE NAME: CLASSIFICATION: CUSTODIAL RELATED DEATH TYPE: OFFICER PROCESSING AGENCY: SANTA ANA POLICE DEPARTMENT On Wednesday, November 4, 2020, at approximately 0300 hours, Orange County District Attorney (OCDA) Supervising Investigator STAN BERRY contacted me regarding the custodial related death of , involving the Santa Ana Police Department (SAPD). BERRY requested I respond to the Santa Ana Police Department to assist with the investigation. At approximately 0547 hours, SAPD Sergeant JASON GARCIA conducted a briefing of the known circumstances surrounding the incident. At the conclusion of the briefing, OCDA Supervising Investigator BRAD TANNER assigned SAPD Detective FRANK GOMEZ and me to conduct processing of the involved SAPD Correctional officers. At approximately 0730 hours, I witnessed Orange County Crime Lab (OCCL) Forensic Specialist BRETT DORETTI process and photograph the involved SAPD Correctional Officers at the SAPD Facility. Others present at the processing were as follows: • FRANK GOMEZ Detective (SAPD) • SAUL ESQUIVEL Detective (SAPD) • JAVIER ACEVES Detective (SAPD) • DAVID GOLDWASSER Law Offices of Charles Goldwasser APC ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT SA 20-027 Investigator: T. TOTH #366 Approved By: Date of Report: 01/18/2021 Date: 01/22/2021 Page 2 of 4 The involved correctional officers were processed in the following order: SAPD Correctional Officer CELESTE FERNANDEZ #3142 FERNANDEZ was wearing a long sleeve dark blue uniform shirt with Santa Ana Police patches on both shoulders. A metal Santa Ana Police Correctional Officer badge was pinned above the left shirt pocket and a metal nametag “C. GINNIS” was pinned over the right shirt pocket. It should be noted that until recently, FERNANDEZ had the last name of GINNIS. Over her uniform shirt, FERNANDEZ was wearing a dark blue uniform jacket with Santa Ana Police patches on both shoulders. FERNANDEZ was also wearing dark blue uniform pants and black boots. No visible damage was observed to FERNANDEZ’ uniform and she reported no injuries. FERNANDEZ wore a Sam Browne duty belt with the following equipment attached to it: • Radio holder with radio • Flashlight holder with flashlight • Handcuff case with one (1) pair of handcuffs • Glove case with gloves • Pepper Spray holder with pepper spray • Key holder with keys DORETTI did not collect any items from FERNANDEZ. SAPD Correctional Officer MARY VALENZUELA #2748 VALENZUELA was wearing a long sleeve dark blue uniform shirt with Santa Ana Police patches on both shoulders. A metal Santa Ana Police Correctional Officer badge was pinned above the left shirt pocket and a metal nametag “M. VALENZUELA” was pinned over the right shirt pocket. VELNZUELA was also wearing dark blue uniform pants and black boots. No visible damage was observed to VALENZUELA’s uniform and she reported no injuries. SA 20-027 Investigator: T. TOTH #366 Approved By: Date of Report: 01/18/2021 Date: 01/22/2021 Page 3 of 4 VALENZUELA wore a Sam Browne duty belt with the following equipment attached to it: • Radio holder with radio • Flashlight holder with flashlight • Handcuff case with one (1) pair of handcuffs • Pepper Spray holder with pepper spray • Glove case with gloves • Handcuff Key • Key holder DORETTI did not collect any items from VALENZUELA. DORETTI took a total of twenty-three (23) digital color photographs during the officer processing. SA 20-027 Investigator: T.
