Sheldon, #339 Approved By: Date of Report: 11/09/20 Date: 11/17/20 Page 1 of 4 CASE NAME: ) CLASSIFICATION: CUSTODIAL RELATED DEATH TYPE: HOSPITAL SCENE AGENCY: SANTA ANA POLICE DEPARTMENT On Wednesday, November 4, 2020, at approximately 0300 hours, Orange County District Attorney (OCDA) Supervising Investigator STAN BERRY contacted me regarding the custodial related death of , involving the Santa Ana Police Department (SAPD). BERRY requested I respond to the Santa Ana Police Department to assist with the investigation. At approximately 0435 hours, I arrived at SAPD and met with investigators from the OCDA, SAPD, and the Orange County Crime Lab (OCCL), who were present to assist in the investigation. At approximately 0547 hours, SAPD Sergeant JASON GARCIA conducted a briefing of the known circumstances surrounding the incident. At the conclusion of the briefing, OCDA Supervising Investigator BRAD TANNER assigned SAPD Investigator JIM GARCIA and me to process the hospital scene. TANNER requested GARCIA and I respond to the Orange County Global Medical Center (OCGMC) Emergency Room, where was located. SCENE The hospital scene was located in Orange County Global Medical Center (OCGMC) Emergency Room (ER), bed 7. This portion of the ER consists of a large area with five (5) beds. Sheldon, #339 Approved By: Date of Report: 11/09/20 Date: 11/17/20 Page 2 of 4 Three (3) beds were along the north wall and two (2) beds were along the south wall. The beds along the north wall were separated by blue partitions hung from the ceiling. The two beds along the south wall were separated by a small office. The beds were identified by a small placard hanging from the ceiling that displayed a number. Bed 7 was identified by a small placard hanging from the ceiling that displayed the numeral “7”. An additional placard was affixed to the wall at the head of the bed that displayed the numeral “7”. SAPD officers J. CASTELLANOS, #3080, and J. MARTINEZ, #3702, were stationed outside of the partition securing the scene and controlling access to the area. At approximately 0738 hours, the following personnel and I entered the room and began processing the scene: • TRISHA MARTINEZ Deputy Coroner, Orange County Coroner’s Office • ALISON BABCOCK Deputy Coroner, Orange County Coroner’s Office • HILARY PEPLOWSKI Forensic Specialist, Orange County Crime Lab • JIM GARCIA Investigator, Santa Ana Police Department • MICHELLE MACCHIAROLI Inspector, Santa Ana Police Department Upon entering the area, I saw a single hospital bed. was lying supine on the bed, which was positioned perpendicular to the north wall. head was toward the north wall and he was covered by a white hospital blanket. Upon removal of the hospital blanket, I saw was dressed in a white t-shirt, tan jail pants and white boxers. The t-shirt had been cut down the middle and had small apparent blood spots on the left side. was lying on top of a green disposable sheet and a dark grey blanket. Upon removal of the clothing, I made the following observations of body: SA 20-027 Investigator: B. Sheldon, #339 Approved By: Date of Report: 11/09/20 Date: 11/17/20 Page 3 of 4 • Intubation tube in the mouth held in place with a harness • Pulse oximeter attached to the right index finger • White hospital bracelet and green jail ID bracelet attached to the left wrist • One automatic external defibrillator (AED) pad affixed to left side • One automatic external defibrillator (AED) pad affixed the upper left chest • Multiple cardiac monitoring leads attached to the upper chest and both sides of the abdomen • Intraosseous in the right upper shin • Red marks above the left eye and on the chin • Bruising on the right side • Slight petechial hemorrhage in the eyes • Circular bruises in the center of the chest • Multiple tattoos on the head and neck • Multiple tattoos on the upper chest • Multiple tattoos covering both arms and hands • Multiple tattoos on the back • Tattoos on both shins OCCL Forensic Specialist HILARY PEPLOWSKI photographed the hospital scene. PEPLOWSKI took twenty-nine (29) color digital photographs under OCCL FR number 20-53528. PEPLOWSKI collected and booked the following pieces of evidence: • One white t-shirt cut open with apparent blood stains • One pair of tan jail pants • One pair of white boxers OCCO Deputy Coroner BABCOCK processed body under OCCO case number 20- 05756-BK. BABCOCK bagged ’ hands to preserve potential evidence. BABCOCK placed a SA 20-027 Investigator: B. Sheldon, #339 Approved By: Date of Report: 11/09/20 Date: 11/17/20 Page 4 of 4 coroner’s tag on right big toe at 0807 hours. ’ body was placed into a white body bag and BABCOCK sealed it at approximately 0809 hours. At approximately 0819 hours , from Traditional Funeral Services, took possession of body for transport to the Orange County Coroner’s Office, located at 1071 West Santa Ana Boulevard, Santa Ana. I released the scene to SAPD Officer MARTINEZ at approximately 0820 hours.
