I was told Santa Ana Police Department officers were i nvestigati ng a sexual assault crime (20-01709 ) and were i n Foun tain Va lley attempting to int ervi ew the s u spect wh en an Officer Involved Shooting occu rred. 'l'he s uspect was transported to UC I Medical Center but was pronounced deceased at t he hospital . When I arrived at t he Foun t ain Valley Police Department, I was tol d the fol l owing by Officer Nance: At 2256 hours, Santa Ana Police co ntacted Fountain Valley Pol ice Dispatch and i nfor med them three marked Santa Ana police vehicl es and three uniformed poli ce officers were a t tempti ng to contact a sexua l assault suspect, Miguel MERCADO a t At 23 2 2 h ours , Fountain Valley Dispatch was no tified by Santa Ana Police tha t officers were i nvolved in a Officer I n volved Shooting and were reques t ing addi t ional pol ice personnel and emergency services. The following Fountai n Valley Police Officers responded to the scene: sergeant B. Mosher 11273 Corporal M. Avila ./1263 K-9 Officer K. Erskine f/260 Officer N. Nance ./1283 Officer E. Spencer il302 FVPD Officers assisted in control ling the scene and administering aid until Fountain Val l ey Fire lt VE32 and Care Ambulance #255 arrived on scene. Page 3 of 18 0 1/29/20 Officer Report for Incident 20 -02516 Foun t ain Valley Po l ice, Santa Ana Po l i ce, a nd OCDA inves tiga tor s were b ri efed on the i ncident at 0201 hours by Santa Ana Sergeant Achziger it2978 a nd Fountain Valley Sergean t Mosher 11273 . The f oll owing i s a synopsis of the seri es of e vents: At 1 526 hours , SAPD received a complai nt of a sexual ass aul t which occurred i n their j urisdiction. Thro ugh their investiga tio n, they obtai ned a suspect by the name of Miguel MERCADO ( 11-09-88) who resides at - in Fountai n Valley. At 2256 hours , San ta Ana Pol ice Sergeant D. Lima #2373 and Santa Ana Police Officers G. Roe l f s #3 51 4 a nd J . Espadas #3507 arrived a t this address t o interview and arrest MERCADO. At 2321 h ours , one of these offi c e rs r a dio "998" (Office r i nvolved in shooting). At 2 3 2 3 ho urs, Officers radio the s us pect' smother is n ear the suspect and in possession of h is firearm. At 2326 ho urs, Officers radio a Taser was deployed on the mother to gain co nt ro l o f the f irearm in her possess ion. At 2327 hou rs, Of fi cers radio "Code 4 ." I was assign ed as Lead Investigator for this i ncident and worked wi t h OCDA I nvesti gator Craig Brower. We int ervi ewed Sergeant Lima regarding the inciden t. Re f er to Investigator Brower's report for details . De t ective Vega was assigned t o the crime scene inves tigation team with OCDA I nves tiga t or M. Kendrick. Re f e r to his r eport for details . The Orange Count y Crime Lab responded to conduct CSI of the scene and MERCAD O. Refer t o their report for details (#20 -409 2 6). Detecti ve Marquez was assigned to OC.DA Investigator Mercado and interviewed the parents,■ Refer to his report for detai ls. De tecti ve Holmes was assigned to OCDA Inves t i gator Gonzalez. They r esponded to UC! Medical Center where MERCADO was transported a nd pronounced deceased. She obtained medical records (#9 1 07674 ) for MERCADO and was present when Corone r Hartney a rri ved on scene to take custody of MERCADO. Coroner Case #20 -00372-MM. Refer to he r repo rt for d etai ls . Officer Fitzpatrick was assigned t o OCDA Investi gator Melni c k. They r esponded to the Santa Ana Police De p artment for the interview and inventory of Office rs involved i n the shooting. Refer to h is r eport for det a i l s. Off icer Nance accompani e d OCD A I nvestigator Mena to canvass the s u rrounding area for witnesses. Refer to h i s report for det ails . On January 22nd, 2020 , I obtained the Fire De partme n t I nc i d e n t Repo.rt and ePC R report from Juli eann Parente, F.V Fire Management Aide, and i ncluded them with this report. On January 23rd, 2020, I accompanied OCDA investi gator Drower to the Or ange County Coroner's Office fo r the autopsy of MERCADO . Present in the viewing roo m were OCDA I nvestigator Brower, myself and Detecti ve Ho lme s. Pre s ent for the a utopsy we re Dr . Kim, Assistant J . Gonzalez , Specialist N. Le dda, and Fore nsic Scientist C. Maggay with observer N. Moore. I s aw it was de t ermi ned there were seven (7) gunshot entry woun ds t o MERCADO 's body. Roddy #28 9 Page 4 of 18 01/29/20 Officer Report for Incident 20 -02516 Page 5 of 18 Supplem ent On 01 -20 -20 at 2322 hours , FVPD Officers were dispatched to -■ reference Santa Ana PD Off i ce r s i n volved in a shooti ng and they were requesting our assistance. Up on my arrival, I spoke to SAPD Sergeant Azhziger who told me two of his o f ficers were involved in an ors with Mig uel Mercado. During the incident, Mercado presented a handgu n. This handgun was secured by Sergeant Davi d Lima. Sergeant Lima secured the handgun inside his right rear pants pocket. Whil e i t was i nside his poc ket, I noticed the magazine we l l was empty. I r e moved t he ha ndgun from his pocket. I cleared the handgun and found ther e was no round chambered. The handgun was black Heckler & Koch 45 caliber semi-auto handgun (Serial# 25 1 38884). A records check of the handgu n revealed i t was regis t ered to Me rcado. I secured the ha ndgun i n my patrol vehicle. Th e ha ndgun was r e l eased to Orange County Crime Lab Forensic Scientist C. Maggay ( Ca se -#20 -40926), Sergeant Mosher #273 01/29/20 Officer Report for Incident 20-02516 Supp]em e nt This report is associated with the following reports : I , De tective K. Holmes am assigned to the Detective Bureau to investigate sexual assau l ts, cri mes against children and missing persons. On 01/21 /20 at approximately 1207 h our s my direct supervisor, Sergeant Spangler, call ed me a n d t old me I was being called out for an off icer i nvolved shooting involving Santa Ana PD officers in the City of Fountain Valley. The OC District Attorney's I nves t igators arrived a t and briefed with SAPD and FVPD. Sergeant Spangler requested I accompany DA I nvesti gator Carlos GONZALES t o UC I t o rel ieve Offi cer S hook a nd assist in t he i nvestiga tion at the hospital. Officer Shook informed me that he was still with MERCADO a nd was located in the "Dougl ass Building on the 1st floor, bed 17." I rel i eved Officer Shook from his du t ies a nd he returned t o t he Ci ty of Fountain Val l ey. Senior Dep uty Coroner Michelle HAR'l'NEY was already at bed 1 7 wi th MERCADO layi ng dec eased i n a gur ney. HARTNEY provi ded med i cal records f or GONZALES and I to review, documented under MR#9107674. I read that MERCADO was transported from 10304 La Hacienda to UCI t r auma b ed #A at 2338 hours for "trauma tic injur y and cardiac arr.est." He arrived by Care Ambu l ance uni t #255 trans port at 00 16 hours . MERCADO was no n-responsive upo n arrival and was pronounced deceased at 0031 ho u rs by MD after med i cal interventions . Senior Depu ty Coroner HAR'rNEY, Cr ime Scene I nvestigator Andrew HAYES and Sci entist Corey MAGGAY conducted CSI on the body of MERCADO. At approximately 2257 hou rs, FVPD Officers were dispatched to -regardi ng Santa Ana PD Offi cer's i nvol ved in an Officer invol ved shooting and requesting FVPD' s assistanc e. I r emained on the scene to assist with maintaining control of the crime scene. At 0230 h ours, I was assigned to assis t Inves tigator Yency Mena from the Orange County District Attorney Homici d e Onit by canvassing the area for potential wi tnesses t o the incide nt . I nvestigator Mena and I b egan knocki ng on apart men t un i t doors in the a rea of the i ncident to speak to reside nts in followi ng buildi ng s: In total , we a ttempt ed to contac t 24 dif ferent uni ts i n the area. Whi l e s peaking to each resident, Investigator Mena spoke to each party and obta i ned their s t a t ements. Vega was notified by FVPD Sergeant Spangler to respond to our station o n a Detective Call-out . Sergeant Spangler said there was an Officer involved shooting (OIS) involving Santa Ana Police Department Officers which occurred in the City of Founta i n Valley. Upon arriva l, FVPD Detectives and Sergeant Spangler responded to the scene , located at 10304 La Hacienda Ave . #JS . Once at the scene , I was assigned to DA Investigator Mike Kendrick to handle the , "Scene " portion of this investigation.
