This is Yong-son Kim, M.D., dictating on January 23, 2020, case #20-00372-MM;
decedent, MERCADO SEGURA, Miguel.
Note: The description of the gunshot wound related injuries and the gunshot
wounds themselves are not necessarily described in the systemic anatomic review
which is a description of the decedent's body prior to sustaining injuries. All
descriptions of the gunshot wounds and associated injuries are made using the
standard anatomic position at all times.
EXTERNAL EXAMINATION
The body is identified by toe tags and is that of an unembalmed, refrigerated adult
Hispanic male, who appears about the reported age of 31 years. The body weighs
154 pounds, measures 68 inches in height, and appears well built and well
nourished.
External examination reveals the body is without rigor. Livor mortis is fixed and
present over the back. Tattoos are not seen .
EVIDENCE OF OLD INJURIES: There appears to be older abrasive marks in the
form of linear marks, of the dorsal surface of the right wrist, as well as of the right
hand.
There is no clear evidence seen of any other scars on the body.
The head is normocephalic and covered by brown short/shaven straight hair
without balding. Examination of the eyes reveals irides that appear to be brown in
color and sclerae that are clear. There are no petechial hemorrhages of the
conjunctivae of the lids or the sclerae. The earlobes are grossly unremarkable. The
oronasal passages are unobstructed. The teeth are the decedenfs own and in
good condition with present retainers. The face in general is unremarkable with a
mustache. The neck appears supple and unremarkable.
There is no chest deformity or any increased anteroposterior diameter of the chest.
The abdomen is flat and does not appear unusual. The external genitalia are those
of an adult male. The penis is uncircumcised. There is no evidence of any trauma
to the external genitalia . The scrotum shows nodular, wart-like protrudent nodular

lesions that are well circumscribed. The extremities show no evidence of any
edema, needle tracks, deformity, or abnormal mobility .
EVIDENCE OF THERAPEUTIC INTERVENTION: There are bilateral thoracotomy
sites noted of each chest cavity with associated sutured thoracotomy tubes. In
addition, there is an intravenous line of the left inguinal fossa and an intravenous
line of the right antecubital fossa. There are intraosseous needles of both shins.
There are also electrocardiographic monitoring pads of the anterior torso and there
is an endotracheal tube and an endogastric tube in the proper location. An oxygen
sensor has also been applied towards the left index finger.
EVIDENCE OF FRESH TRAUMA: There are abrasion marks around the left
anterior shoulder. In addition, there is a contusion combination with a weak
abrasion of the dorsum of the nose. Abrasions are also noted around the posterior
left upper arm and the posterior right upper arm, which are broader in appearance
compared to the left side. There is a weak abrasion of the upper shin. In addition,
there is a superficial cut which measures 3/16 of an inch in greatest length, with a
surrounding contusion of the palm of the right hand in the area of the thenar
muscles.
DESCRIPTION OF GUNSHOT WOUNDS
GUNSHOT WOUND #1, RIGHT UPPER BACK
ENTRY: The entry site is located at the right upper back, 5 inches right of the
midline and 16-1/2 inches below the top of the head. The wound itself measures
3/16 of an inch in greatest dimension, is of round shape. There is a broad muzzle
imprint of 1 /4-inch in width, which is completely surrounding the entry site. There is
also soot deposited on the muzzle imprint area as well as within the soft tissues. In
addition, there are linear abrasive marks, almost in the shape of a square
surrounding the muzzle imprint. No stippling is noted.
EXIT: The exit site is located at the area of the right inner chest, 3 inches right of
the midline, as well as approximately 17 inches below the top of the head. It is of
round to irregular shape and measures 3/8 of an inch in greatest dimension.
PROJECTILE: There is no projectile recovered.

COURSE: The gunshot wound track enters the skin at the level of the right upper
back. It then courses into the underlying soft tissues and enters the right posterior
9th intercostal space. The track then courses into the right middle lobe of the lung
and then into the right upper lobe of the lung. It then continues to perforate the
right inner anterior 5th intercostal space and exits the skin at the level of the right
inner chest.
DIRECTION: The direction is back to front, slightly right to left, and overall straight.
ASSOCIATED INJURIES: There is a right hemothorax, which has been mostly
removed by the above-described thoracotomy tubing. The entire right lung is
severely atelectatic. There are perforations of the right upper lobe as well as the
right middle lobe of the lungs. In addition, there is a perforation of the right
posterior 9th intercostal space as well as a perforation of the right parasternal ribs
at the level of the right inner anterior 5th intercostal space.
GUNSHOT WOUND #2, RIGHT LOWER BACK
ENTRY: The entry site is located at the right lower back, is of round shape, and
measures 3/16 of an inch in greatest dimension. There is a circumferential
abrasion ring with a width of 1/16 of an inch. No soot, stippling, or muzzle imprint
are noted. The entry site is located 26-1/2 inches below the top of the head, as
well as 1 inch right of the midline.
EXIT: There is no exit wound.
PROJECTILE: A projectile is recovered from the right inner chest, just to the lateral
aspect of the exit site of gunshot wound #1. The projectile consists of a large
caliber, deformed copper-jacketed projectile. This projectile is about to nearly exit
the skin. The projectile is recovered from approximately 4 inches right of the
midline as well as 17 inches below the top of the head.
COURSE: The gunshot wound track enters the skin at the level of the right lower
back, where it enters the underlying soft tissues. The gunshot wound track then
hits the mesentery and perforates the overlying liver. The gunshot wound track
then continues to perforate the right hemidiaphragm and continues to tear the soft
tissues of the right anterior 7th intercostal space. It then continues underneath the

tissues and fractures the 5th rib with a continuation through the 6th rib and the right
anterior 6th intercostal space. The gunshot wound track then finally ends in the
overlying soft tissues.
DIRECTION: The overall direction is left to right, upwards, and back to front.
ASSOCIATED INJURIES: There is a large perforation of the middle parenchyma
of the liver. In addition, there is a large perforation of the mesenteric area with
surrounding retroperitoneal hemorrhages. There are two perforating injuries of the
right anterior ribs at the level of the right anterior 5th rib, and the right anterior 7th
intercostal space. There is an associated fracture of the right anterior 5th rib as
well. It appears that the defect of the right 7th intercostal space represents a tear of
the soft tissues due to the gunshot wound track.
GUNSHOT WOUND #3, LEFT UPPER BUTTOCK
ENTRY: The entry site is located at the left upper buttock towards the inner left
lower back. It is located 1-1/2 inches left of the midline and 32-1/2 inches below
the top of the head. The gunshot wound is of round shape and measures 3/16 of
an inch in greatest dimension. There is a very faint ring of stippling surrounding the
entry site. No muzzle imprint or soot are noted.
GUNSHOT WOUND '1#4, RIGHT LOWER BUTTOCK
ENTRY: The entry site is located at the right inner upper buttock, approximately 32
inches below the top of the head and 2 inches right of midline. It is of round shape
and measures 3/16 of an inch in diameter. No soot, stippling or muzzle imprint are
noted.
GUNSHOT WOUNDS #5 and #6
ENTRY: The entry sites are located at the right middle buttock. Both are located
approximately 33 inches below the top of the head. They are also located 2 inches
right of the midline (gunshot wound #5), 2-1/2 inches right of the midline (gunshot

wound #6. Both of them are round in shape and show a diameter of 3/16 of an
inch. No soot, stippling or muzzle imprint are noted.
EXIT: There is a large gaping exit which is surrounded by green abdominal
discoloration due to decomposition, which is located 32-1 /2 inches below the top of
the head and 2 inches right of the midline. It measures 1 inch in greatest
dimension.
This exit site most likely represents the exit site for gunshot wounds #3-6.
PROJECTILE: A lead deformed large caliber copper projectile is recovered within
the soft tissue right underneath the exit site for gunshot wound #3-6. It is unclear at
this point exactly which gunshot wound is causing the lodged projectile within the
soft tissues.
COURSE: The gunshot wound track enter the skin around the left inner buttock
and the right inner buttock. They then course into the underlying soft tissues and
enter the pelvic cavity where they perforate multiple areas of the small and large
intestines. The gunshot wound tracks then most likely merge in the underlying soft
tissues and finally exit the skin at the level of the right lower abdomen towards the
pelvic area.
DIRECTION: The projected overall direction of all gunshot wounds is
approximately back to front, and overall nearly straight. Of note, the track of
gunshot wound #3 is slightly deviated towards the right side, and the direction of
gunshot wound tracks of #4, #5, and #6 are slightly from right to left.
ASSOCIATED INJURIES: There are multiple perforations noted of the small
intestines as well as of the large intestines within the area of the pelvic cavity.
There are also associated perforations of the soft tissues of the pelvic cavity at the
posterior aspect. Of note, there is a mild amount of bloody hemorrhages within the
pelvic or abdominal cavity.
GUNSHOT WOUND #7, RIGHT BUTTOCK
ENTRY: The entry site is located at the right outer buttock, approximately 3-1/2
inches right of the midline and 33 inches below the top of the head. The entry site

is of round shape and measures 3/16 of an inch in greatest dimension . No soot,
stippling or muzzle imprint are noted.
EXIT: There is no exit wound.
PROJECTILE: A deformed copper-jacketed lead projectile of large caliber is
discovered within the head of the right femur, just at the junction towards the
femoral neck.
COURSE: The gunshot wound track enters the skin at the area of the right outer
buttock, and then enters the underlying soft tissues. It then perforates the head of
the right femur where it finally ends.
DIRECTION: The overall direction is back to front, and overall straight.
ASSOCIATED INJURIES: There are the usual associated soft tissue hemorrhages
associated with the track.
GUNSHOT WOUND #8, RIGHT LATERAL RIBCAGE
ENTRY: The entry site is located at the right lateral ribcage, 7 inches right of
mid line and 10 inches below the top of the head. It measures 3/4 x 1 inch in
greatest dimension. It appears slightly deformed to slightly triangular in shape. No
soot, stippling or muzzle imprint are noted.
EXIT: The exit site is located at the right lateral ribcage inferior to the entry site. It
is located 7 inches right of the midline, as well as 10 ½ inches below the top of the
head. It measures 1 ½ x 1/2 inches.
PROJECTILE: No projectile is recovered.
COURSE: The gunshot wound track enters the skin at the level of the right lateral
ribcage and exits the area also in close vicinity.
DIRECTION: The direction is overall straight. Of note, it is possible that entry and
exit sites are reversed. There is no clear distinction made possible, given the
findings of the skin.

ASSOCIATED INJURIES: There are the usually expected soft tissue hemorrhage
of mild amount surrounding the area and continuing.
ADDITIONAL GRAZE WOUND: There is a graze in the from a striped shape
abrasion of the area lateral to the near exit site of gunshot wound #2, which is
located just below the right nipple and partially crossing it. No other findings like
muzzle imprint, soot or stippling are noted.
INTERNAL EXAMINATION
NECK: The neck organs are removed en bloc with the tongue. No lesions or
contusions of the lips, gingiva, or oral mucosa are seen . There is no laryngeal
edema. Both hyoid bone and larynx are intact, without evidence of fractures. The
tongue, upon sectioning, shows no trauma. There is no evidence of hemorrhage
seen of the adjacent throat organs, investing fascia, strap muscles, visceral fascia,
or thyroid.
CHEST/ABDOMINAL CAVITY: Both pleural cavities contain minimal clear serous
fluids on the left side and mild amount of bloody fluids in the right chest cavity.
There is otherwise no evidence seen of any other pleural adhesions. The lungs are
atelectatic on the right side and still relatively well expanded on the left side with
mild atelectasis as well. The anterior mediastinum as well as the diaphragm are
symmetrical and free of any trauma or lesions. The neck is straight. The soft
tissues of the thoracic and abdominal walls are well preserved. The subcutaneous
fat of the abdominal wall measures 2.0 cm. The organs of the abdominal cavity
have a normal arrangement and none are absent. There is no evidence of any
peritonitis or any abdominal adhesions. There is a mild amount of abdominal free
fluid collection.
CARDIOVASCULAR SYSTEM: The aorta is elastic and of even caliber throughout
with vessels distributed normally from it. There is no tortuosity or widening of the
thoracic segment. The abdominal aorta as well as the thoracic segment show very
focal areas of mild lipid streaking throughout. There is otherwise no evidence of
any greater plaque formation, calcification, dilatation or aneurysms of the
abdominal segment. The major branches of the aorta show no gross abnormality.

Within the pericardia! sac there is a mild amount of serous fluid of approximately
20 cc. The heart weighs 300 grams and shows a normal configuration. The right
ventricle measures 0.4 cm in thickness, the left ventricle measures 1.0 cm in
thickness, and the interventricular septum measures 1.0 cm in thickness.
The chambers are otherwise normally developed and are without mural
thrombosis. The great vessels enter and leave in a normal fashion. The blood
within the heart and large vessels is still of minimal amount and mostly liquid. The
heart valves are thin, leafy, and competent. The circumferences of the valve rings
are: aortic -6.1 cm, mitral -10.5 cm, pulmonic -6.5 cm, and tricuspid -11.5 cm .
There is no evidence of any endocardial discoloration, myocardial lesions, or any
abnormalities of the apices of the papillary musculature.
The coronary ostia are widely patent. There is a normal pattern of coronary artery
distribution, right dominant pattern. There is hardly any evidence of any coronary
artery disease with an overall wide and patent lumen throughout the major
coronary arteries.
RESPIRATORY SYSTEM: There are scant secretions seen in the lower bronchial
and upper respiratory passages. The mucosa of the trachea is otherwise intact and
pale. The left lung weighs 260 grams. The right lung weighs 260 grams. The lungs
are otherwise subatelectatic on the left side and severely atelectatic on the right
side. They overall appear both dense in consistency. The cut surfaces show mild
to moderate edema throughout with acute generalized congestion . There is no
evidence of any other parenchymal lesions with mild intraparenchymal
hemorrhages which is consistent with the above-mentioned injuries of the right
lungs. The pulmonary vasculature is without thromboembolism.
GASTROINTESTINAL SYSTEM: The esophagus is intact throughout. The
stomach is not distended. It contains 70 cc of pink to brown fluids. No portions of
tablets or capsules can be discerned in the stomach. The mucosa otherwise
shows the usual rugal folds without any additional mucosa! lesions. The small
intestines, large intestines, and pancreas are otherwise grossly unremarkable . Of
note, the pancreas appears slightly paler than usual.
HEPATOBILIARY SYSTEM: The liver weighs 1210 grams and the capsule is
intact. The parenchyma is dark red and brown in color and cuts with firm

resistance. The cut surfaces are smooth with a normal lobular arrangement. The
gallbladder is present. It contains 1 O cc of bile without calculi. The gallbladder wall
is thin and pliable. The periportal lymph nodes are not enlarged.
HEMATOPOIETIC SYSTEM: The spleen weighs 120 grams. The capsule is intact.
The parenchyma is dark red and soft. There is no increased follicular pattern.
Lymph nodes throughout the body are small and inconspicuous. The bone and
bone marrow of the ribs appear grossly unremarkable.
URINARY SYSTEM: The left kidney weighs 130 grams and the right kidney
weighs 140 grams. The kidneys are normally situated and the capsules strip
easily, revealing surfaces that are overall smooth and slightly paler than usual. The
perirenal fat is not increased in mass. The corticomedullary demarcations are still
well preserved. The pyramids are unremarkable. The ureters are without
obstruction and pursue their normal course. The urinary bladder is unremarkable .
It contains 200 cc of urine, it is thereby mildly distended.
GENITAL SYSTEM: The prostate gland as well as the testicles are found within
their proper locations and are without any evidence of trauma or lesions.
ENDOCRINE SYSTEM: The thyroid gland, the parathyroid glands and the adrenal
glands are all grossly unremarkable.
MUSCULOSKELETAL SYSTEM: There is no evidence of fractures, joint
deformities, or abnormal mobility in the spine, ribs, or pelvic bones. The muscular
development is consistent with the age.
HEAD AND CENTRAL NERVOUS SYSTEM: There is no evidence of
subcutaneous or subgaleal hemorrhage in the scalp. The external periosteum and
dura mater are stripped, showing no fractures of the calvarium or base of the skull.
There are no tears of the dura mater. There are no epidural, subdural, or
subarachnoid hemorrhages.
The brain weighs 1500 grams. The leptomeninges are thin and transparent. There
is a normal convolutionary pattern. The cerebral hemispheres are symmetrical.
There is no evidence of cerebral atrophy or cerebral swelling. Of note, the brain is
severely pale. Coronal sectioning demonstrates a uniformity of cortical gray

thickness. There is no evidence of any cerebral contusions. The ventricular system
is unremarkable, without dilatation or distortion. The white matter is free of any
softening, discoloration, or hemorrhage. The basal ganglia are intact. Anatomic
landmarks are well preserved. Pons, medulla, and cerebellum are unremarkable.
There is no evidence of uncal or cerebellar herniation. Vessels at the base of the
brain have a normal pattern of distribution. There is no evidence of cerebral
arteriosclerosis or any cerebral aneurysms. The cranial nerves are intact,
symmetrical, and are normal in size, location, and course. The spinal cord is
removed and does not reveal any evidence of any trauma or hemorrhages.

On 01/21/2020 at 0104 hours Deputy Coroner P. Hoag received a call from UCI Medical Center ER RN, Izzy
Hiebert, who was reporting a multiple gunshot wound death. The decedent was brought in from Fountain Valley
with 12 gunshot wounds. He was in full arrest and they took over CPR from paramedics. He was intubated, given
blood, bilateral chest tubes, and ACLS drugs but there was no change and he was pronounced dead in the ER. FVPD
is in the ER.
On 1/21/20 at 0111 hours Deputy Hoag spoke with FVPD Officer, Shook, and he told him SAPD was conducting an
arrest in Fountain Valley and officers shot the decedent. He didn't know much more information and detectives were
enroute to the hospital. Hoag gave him the case number and a call back number.
On 1/21/20 at 0116 hours Deputy Hoag called SAPD and spoke with W/C Alvarez who told him SAPD officers
were involved in the shooting but it happened in Fountain Valley so FVPD was handling the call. He had already
spoke with OCDA. Brad Tanner, and he was aware of the death and the OIS.
On 1/21/20 at 0123 hours Deputy Hoag received a call from OCDA, Brian Tanner, and he told him he and his
investigators were just arriving at FVPD for a brieling. He had already called Criminalist, Corrie Maggay, and she
will be responding to the hospital in approx. 1 hour. He will send an investigator to the hospital after the brieling.
On 01/21/2020 at 0148 hours, Deputy Hoag received a call from Andrew Hayes with the OCCL who stated
Criminalisl C. Maggay is on her way to the lab and they will leave together. He estimates a 30 minute eta. Hoag
asked that he call us when they arc leaving the crime lab so that we may drive to the hospital as well; he agreed.
On 01/21/2020 at 0215 hours, this case was assigned to me by Coroner Watch Commander E. Arellano. Deputy
Hoag advised me that the OCCL Criminalist and ID Tech were enroute to the hospital. FVPD had the decedent's
name but it was unavailable al the time of my response to the hospital at 0233 hours.
I arrived at the hospital at 0245 hours and met with FVPD Oflicer Shook, FVPD Detective Kim Holmes and OCDA
Carlos Gonzales. Shortly after arrival, Orange County Crime Lab Criminalist Corrie Maggay and ID Technician
Andrew Hayes arrived.
A group brieling was held by OCDA Gonzales. Based on the preliminary investigation, subject to change, the
decedent Jived with his parents at 10304 La Hacienda Avenue #J5 in Fountain Valley. Earlier this evening Santa
Ana Police Ofliccrs responded to the address to attempt to serve a warrant on the decedent. Officers made contact
with the decedent and at some point, an officer involved shooting ensued and as a result, the decedent was shot
multiple times, possibly by two officers. The decedent's parents were present and witnessed the event; both arc
currently al Fountain Valley Police Department being interviewed. Both parents arc Spanish speaking only and have
also been notified of the death by detectives who arc interviewing them. The decedent was identified as
MERCADO-SEGURA, Miguel (11/09/1988). Orange County District Auorncy's Office and Fountain Valley Police
department will allcnd the autopsy.
For the purpose of identification, I contacted Coroner Watch Commander Arellano and requested she run the
decedent for a DMV photo with the name and date of birth provided by OCDA Gonzales. Arellano sent the result 10
my cell phone. I proceeded to Observation Room # 17 where I identified the decedent via visual comparison to his
DMV driver's license. I observed the decedent nude and laying supine on a gurney. Medical intervention included
an endotracheal tube, EKG/AED pads on the upper chest, bilateral chest tubes, right antecubital fossa intravenous
line left central line, bilateral tibia intraosseous lines and left forefinger pulse oximeter. On the floor next to the
gurney was a paper bag with the decedent's clothing. I took several digital photos alongside ID Tech Hayes.
Criminalist Maggay examined the decedent's hands and was unable to take any swabs or fingernail scrapings due to
his hands being too bloody. Maggay said ii was not necessary to bag the decedent's hands. Several gunshot wounds
were observed below his right breast, right side just under his arm pit, lower right groin above his pubic area, right
side upper hack, lower middle back and 5 grouped shots on his right bullock. I proceeded to the body examination
and palpated no trauma to his head. The sclera were clear and firm to the touch. I observed no oral trauma inside or
out and rigor mortis was forming in his neck. There was no other trauma visible or palpated. I placed an

identification tag on his foot. A representative from Traditional Mortuary placed the decedent inside of a zippered
body bag. I then placed a second identification tag on the outside zipper and placed a coroner seal at 0428 hours. I
then directed the Traditional Mortuary representative to transport the decedent to lhc Coroner's Office.
Criminalist Maggay removed collected the decedent's clothing and booked it into Sheriffs evidence.
On 01/21/2020 at 0837 hours, Coroner Investigator S. Rodriquez received a call from DA Investigator Craig
Brower. He confirmed he had notified the decedent's parents of the death but did not have any further information
regarding the decedent. He stated they were provided a card with the coroner's phone number and case number. He
said we arc good to conduct a standard interview with the parents but they arc Spanish-speaking only.
On 01/21/2020 at 1831 hours, Coroner Walch Commander E. Arellano called the decedent's father,
who confirmed the decedent was never married and did not have any children. Arellano explained coroner
procedures and he stated he understood. Arellano immediately called OCDA Inv. S. Berry and notified him that the
next of kin arc in fact the parents.
Based on the totality of the investigation, this case was mannered Homicide.
