On Tuesday, January 21, 2020, at approximately 0012 hours, Orange County District
Attorney (OCDA) Supervising Investigator BRAD TANNER contacted me regarding an officer
involved shooting (OIS) involving the Santa Ana Police Department (SAPD). TANNER requested
that I respond to the Serena Vista Apartment complex, located at
to assist with the investigation.
At approximately 0125 hours, I arrived at the incident location and met with investigators
from the OCDA, and the Fountain Valley Police Department (FVPD), who were also present to
assist in the investigation.
At approximately 0201 hours, SAPD Sergeant CLINT ACHZIGER, #2978, and FVPD Sergeant
BRIAN MOSHER, #273, conducted a briefing of the known circumstances surrounding the incident
for the investigators involved. Following the briefing, TANNER assigned FVPD JULIO VEGA, #275
and I to supervise the processing of the scene by the Orange County Crime Lab (OCCL).
The following personnel from the OCCL were present to complete the processing of the
scene under OCCL FR #20-40926.

SCENE DESCRIPTION
The weather was cool with intermittent rain. The shooting incident occurred at
approximately 2326 hours, on Monday, January 20, 2020, during the hours of darkness, on the
patio, at . The scene
was cordoned off by yellow and red police line tape. Uniformed FVPD personnel were stationed
to prevent access to and preserve evidence within the scene. At approximately 2330 hours, FVPD
Officer ENRIQUE OLIVERA, #313, began a crime scene log for incoming and outgoing personnel.

is described as follows: is a one bedroom, one bath
apartment with a living room and kitchen. There is a patio situated south of the living room and
that is enclosed by an approximately five foot tall, wood fence. The front door faces south and
there is a closet north of the front door. There is an “L” shaped partition in the living room.
Within that, partition was a single size bed. There is a sliding glass door in the southern part of
the living room, which provides access to the patio area. There is a common area courtyard south
of the patio with a patio cover and a barbeque area.
SCENE EXAMINATION
There was a 21ft Taser cartridge, with wire, serial #C31050RCH (Evidence Marker #1), on
the ground in the living room and north of the patio at

headstamped 9mm Hornaday Luger, on the ground in the patio area and south of Evidence
Marker #3. There were two cartridges (Evidence Marker #4), headstamped 9mm Hornaday
Luger, on the ground in the patio area and south of Evidence Marker #3. There was a bullet
(Evidence Marker #5), on the ground, in apparent blood, in the patio area and east of Evidence
Marker #3. There was a bullet (Evidence Marker #6), on the ground in the patio area and east of
Evidence Marker #5. There was a cartridge case (Evidence Marker #7), headstamped 9mm
Hornaday Luger, on the ground in the patio area and east of Evidence Marker #6. There was a
bullet (Evidence Marker #8), on the ground in the patio area and south of Evidence Marker #5.
There was a cartridge case (Evidence Marker #9), headstamped 9mm Hornaday Luger, on the
ground in the patio area and south of Evidence Marker #8. There was a pair of dark colored
pajama pants and a pair of gray underpants with apparent blood (Evidence Marker #10), on the
ground in the patio area and east of Evidence Marker #8. There was an Axon Body Worn Camera,
serial #X81330070 (BWC) (Evidence Marker #11), on the ground and east of Evidence Marker #7.
At approximately 0659 hours, MAGGAY turned off the BWC. There was a cartridge case (Evidence
Marker #12), headstamped 9mm Hornaday Luger, in the dirt and south of the patio wood fence.
There was a bullet (Evidence Marker #13), in the dirt and east of Evidence Marker #12. There
were two cartridge cases (Evidence Marker #14), headstamped 9mm Hornaday Luger, on the
ground in the patio area and west of the potted plant. There was half of a gray Taser blast door
and a yellow Anti Felon Identification tag (AFID) (Evidence Marker #15), on the ground in the
patio area and south of the sliding glass door. There was an apparent bullet entrance hole (Photo
Evidence Marker #A) on the north side of the patio wood fence. There was an apparent bullet

exit hole (Photo Evidence Marker #A1) on the south side of the patio wood fence. There was an
apparent bullet entrance hole (Photo Evidence Marker #B) on the north side of the patio wood
fence. There was an apparent bullet exit hole (Photo Evidence Marker #B1) on the south side of
the patio wood fence. There was apparent blood and medical debris on the ground on and
around the evidence.
There were two loaded magazines inside a black bag, underneath the bed in the “L”
shaped partition area. There was a gun box bearing a serial # 25-138884, and name MIGUEL
MERCADO, on a shelf and west of the single sized bed. There were two loaded magazines in the
gun box. There was black FN Belgium SCAR-H Cal 7.62x51 airsoft, replica assault rifle (serial #
H000529) and magazine, inside a cardboard box in the closet north of the front door. There was
a plastic ammunition box full of .45 caliber cartridges in the same closet. None of those items
was collected as evidence.
There was a Heckler & Koch (H&K), model USP, .45 semi-automatic pistol (serial # 25-
138884), secured in Sergeant MOSHER’s Police Vehicle #403. The firearm was unloaded, on safe,
with no magazine in the magazine well. MAGGAY collected the firearm as evidence.
EVIDENCE COLLECTION
The following items of evidence were collected by OCCL Forensic Scientist, CORRIE
MAGGAY, under the following Evidence Marker (EM) numbers:

Forensic Specialist WALKER took two hundred thirty five (235) digital color photographs
documenting the scene under FR# 20-40926.
At approximately 0830 hours, I conducted a final sweep of the scene in an attempt to
locate any additional evidence. No additional evidence was located. At approximately 0841
hours, I turned control of the scene over to Officer OLIVERA.
