tlie collection and doctirnentation of tlie evidence at the scene of the officer involved shooting. Refer to
OCSD FR# 15-43742.
Weather and Lighting
The weather condition at the time of my arrival, 1430 horirs, was cloudy with a temperature of
approximately 69 degrees Fahrenheit. The winds were approximately 5mph from the southwest. This
information was obtained from tlie "Accuweather.com" website. The grorind within the scene was dry
-and the lighting was ample which was provided-by e sun.
Scene
300 Soutli Main Street Santa Ana, Ca is noith/south asphalt paved roadway. The city street is delineated
for 4 lanes of traffic with a center median. There are two laiies of travel for northborind veicle trayel
and two lanes of travel for southbound travel. Raised concrete curbs border the east and west roadway
edges. There is a mix of businesses and residential ui'ffts that line both sides if the streets.
The crime scene was identified by yellow police tape securing the east, west, north and south perimeters.
Tliere were Santa Ana Police officers positioned at the nortl'i and south perimeters and at the intersection
of Main Street and Pine Street. The sorith perimeter consisted of yellow crimes scene tape strung across
Main Street between Mill Bakery at 312 S. Main Street and Pomeroy's Muffler at 315 S. Main Street.
The noith perimeter consisted of yellow crime scene tape strung across Main Street from the sorith west
corner to the south east corner of Main Street and Walnut Street. Both tl'ie east and west sidewalks of
Main Street were taped off with yellow crime scene tape.
There were six marked Santa Aria Police Department black and white patrol vehicles located within tlie
perimeter.

was stopped facing south in tlie #2 lane of sorithbound Main Street directly in front of 312 S. Main
Street. The engine of unit 859 was on and the overhead light were activated.

There was one Santa Ana Police Depaitment motorcycle in tl'ie crime scene. Unit #701/City ID#59700
fuither identified by license #33L30 was stopped facing nortli on the east sidewalk of Main Street
between 305 S. Main Street and 311 S. Main Street.
A white 2005 Toyota Tacoma 4 door truck bearing license plate # was stopped facing noith in
the #2 lane of nortlibound Main Street in front of 305 S. Main Street. There were keys in the igi'iition and
the engine was on. The Toyota truck was at rest along the east curb of Main Street fn front of 305 S.
-Main Street. The front driver's door wiiidow was shattered. T-he-front-passenger window was down.-
Tliere were two bullet holes on tlie rear tail gate of the truck. There were five bullet holes and one bullet
strike on the driver's side front and rear door. Tliere was a raised bullet impact mark on the roof of the
ttuck above the driver's seat. I saw blood splatter on the exterior of tlie driver's rear door. Refer to the
crime scene photographs for further details.
There was bloody clothing, a wliite cellular teleplione and a brown wallet on the groruid oritside tl'ie
driver's side of the truck. On the grorind rinder the truck in front of tlie rear driver's side tire, was a
Smith & Wesson model 6909, 9i'nm, semi-aritomatic handgun serial # Tlie gun had blood on
it. Tliere was a bullet on tlie groruid rinder the truck. There was a bullet in tlie bed of the truck. On tlie
grorind and sidewalk, tliere were seven.40 caliber caitridge casings. Six cartridge casings were stai'nped
"Winchester.40 S&W". One cartridge case was stamped "Honardy.40 S&W". There was one live.40
caliber cartridge stamped with "Wincliester .40 S&W". These items were closest to unit #853. There
were five AR15 cartridge casings in a planter along the West side of Main Street. Tlie planter is west of
the west sidewalk of Main Street and nortli of the bakery at 312 S. Main Street. The cartridge casings
were stamped "LCI 1". Tliese items were collected by the Orange County Crime Lab.
A Colt AR15, serial # was inside the trunk of unit 859. The gun was in tlie safe position witli
the bolt forward in a black carrying bag. There were three magazines-inside the carrying bag. There

were no magazines in the weapon. Orange County Crime Lab persoru'iel counted the rorinds in each
magazine. Tlie round corint for eacli magazine was 25, 22 and 28. No rounds were iii the chamber of the
AR15.
Summary
On 03/1 1/15, Santa Aria Police Officers were dispatched to reference a shooting tliat had
just occrirred. Responding officers located a velffcle matching the description in the area of Main Street
and Pine Street. The vehicle stopped on the 300 block of Sorith Main Street. Shortly after, officers
advised cotninunications that aii officer involved shooting had occrirred.
Narrative
Wednesday March 10, 2015 1300 hours
I was at my work station when I heard a radio broadcast of an officer involved shooting.
1405 hours
Sergeant G. Serrano #2338 conducted a briefing at the Santa Ana Police Depaitment for Homicide Unit
Detectives. He provided tlie la'iown details of the incident and investigation. I was assigned to liandle the
crinie scene. All detectives left the police station and responded to the scene.
1430 hours
I arrived at the scene of the officer involved shooting. I entered tlie crime scene through Pine Street and
Sycamore Street. I checked in with the crime scene scribe, Officer E. Martinez #3349.
1513 hours
District Attorney Investigator M. Gutierrez presided over the briefing. Present for the briefing were
ii'ivestigators from the Orange County District Attorney's Office, Santa Aria Police Depaitment
detectives, Santa Ana Police Department Internal Affairs inspectors, and Orange County Sherif:f's Criine
Laboratory personnel. Santa Ana Police Sergeant J. Smith #1998 provided a briefing of tlie incident and
tlie initial investigation conducted by patrol officers.
Sergeant J. Smith related that at 1250 horirs, a female called the Santa Ana Police Department to report
one shot fired and two males fighting at in Santa Ana. At 1251 hours, Officer S. Diaz
#3147, Officer M. Gibbons #2990 ai'id Officer E. Majors #2666 were dispatched to the call. A second
female named called and described the suspect vehicle as a white Toyota pickup truck. At 1255
hours, Ofc J. Berwanger #2001 observed a white Toyota pichip truck license # northbound
Main Street at Bishop Street. Sergeant J. Smith said the vehicle came to stop at Main Street and Pine
Street becarise of stopped traffic. At 1256 hoirs, officers advised the driver of tlie tiauck was armed with
a gun and pointii'ig it at his cl'ffn. At 1300 hours, officers advised an officer involved shooting took place.
Sergeant J. Smith was not at the scene and did not obtain a safety statement from any of the officers.
Sergeant J. Smith related tliat five officers fired rounds in the incident. He identified the officers as;
Officer N. Quijas #2958, Officer D. Enriqriez, Officer D. Garcia #3231, Officer R. Sifflett #3264 aiid
Officer W. Sweet #1805.
At the conclusion of the briefing I was paired with Investigator D. Cabrera and Investigator M. Kendrick

from the Orange Coru'ity District Attorney's Office. I conducted a walk-throrigh of the crime scene and
made observations listed in tlie "scene" heading.
Orange County Sheriffs Crime Laboratory personnel began collecting and removing items of evidence
within tlie crime scene. Refer to tlieir forensic reports for a list and description of items collected.
2000 hours
To & Mo Towing Company towed the Toyota Truck to the Orange Corinty Sheriff's Crime Laboratory
for evidence storage. Ofc A. Cardenal #3229 followed the tow truck witli the Toyota truck from the
scene.
2010 hours
The Orange County District Attorney's Office Investigators released the scene to the Santa Ana Police
Department. I left tlie scene and returned to the Santa Ana Police Department.

On 03/11/15, at approximately 1259 hours, I responded to Main St./Pine St. to asSiSt the Santa Ana Police
Department with an officer involved shooting. I arrived on scene and assisted in containing a perimeter at tlie
above mentioned location.
I transported two Santa Ana Police Officers from tlie scene back to Santa Aria Police Department. I then returned
to help contain the perimeter at the above mentioned location.
Nothing fuitlier by this officer.

On Wednesday, March 11, 2015, at approximately 1318 hours, I was working as a uniformed School
Resource Officer assigned to Saddleback High School [2802 South Flower Streetl. At the request of
' SASPD Sergeant B. Harris, I responded to the intersection of South Main Street and East Pine Street for
an outside agency assist call reference a SAPD officer involved shooting.
I arrived at 1323 hours and was instructed to give one of the involved SA_PD Officers a ride to the
station. I completed the task and returned to the scene at approximately 1355 hours. I remained on scene
assisting with traffic and crowd control till approximately 2046 hours. At that time I was relieved by an
SAPD Officer.

On Wednesday, March 11, 2015, at approximately 1544 hours, I was working as a uniformed police
sergeant. At the request of Sergeant B. Harris #49043, I responded to the intersection of South Main
' Street and East Pine Street to relieve Sgt. Harris from an outside agency assistance call reference a
SAPD officer involved shooting to supervise SASPD personnel in coordination with SAPD personnel.
I arrived at on scene assisting with traffic and crowd control until 2046 hours. At that time I was relieved
by an SAPD personnel. I rendered no further assistance at this time.

Wednesday, 03/18/15, 0800 hours:
On the above date and time, I went to the Orange Corinty Sheriffs Department Crime Lab located at
320 N. Flower in the City of Santa Ana to process the vehicle involved in the Officer Involved Shooting.
The following is a synopsis. For a full detail refer to Investigator McShane's report under Special
Assigiunent # 15-005.
A Search Warrant was authored by Detective C. Achziger #2978 and approved by the Honorable Judge
G. Apkarian on March 12, 2015.
Upon arrival, I met with Orange Corinty District Attorney Investigator McShane. Also present in the
processing of the vehicle were Orange County Crime Lab Lead Forensic Specialist's Aide Sahagun,
Jeannie Tran and Forensic Scientist Jennifer Jarrett.
The vehicle being processed is a white 2005 Toyota Tacoma Cal. Lic: registered to Benito
Osorio. The vehicle had evidence seals attaclied to the doors. I was able to observe the vehicle had
several bullet holes on the front driver's door and on the le:[t rear passenger door. I observed a brillet
hole on the roof top of the vehicle, on the door frame and an impact mark on the frame near the
windshield. I observed two bullet holes on the left side of the tailgate with one of the bullets exiting
through the wheel well. The left front mirror had an impact mark. OCCL personnel recovered a bullet
core from the le:[t front frame area. I also observed a box of Blazer arnmo was removed from tlie interior
of the vehicle along with a black Samsung cell phone which was later booked into the Santa Ana Police
Department evidence locker.
At approximately 1300 hours the processing of the veicle was concluded. For fiuther details refer to

On 03-11-2015 at approximately 1318 hours, I responded to 305 S. Main Street for crime scene
- --- -- - investigation-regarding an-officer-involve-d shoo-tin-g.
Upon arrivaI, I contacted Sergeant Shin who requested photographs of the scene and evidence. I
took overan, midrange, and close-up photographs. Subject John Doe was transported to Western
Medical Center Santa Ana priot to my arrival on scene.
At approximately 1510 hours, I responded to At the request of LFS
Waldo, I took overall, midrange, and close-up photographs of the scene and evidence. I left the
scene at approximately 1620 hours.

The photographs were uploaded into DIMS in the Forensic Services Section.

Narrative:
On 03/i 1/2015, at approximately 1310 hours, I arrived in the area of Chestnut and Main Street to assist
with the Officer involved shooting.
Upon arrival I assisted with securing the scene. I asked several people standing in the north east corner
of Ches.tnut Ave. and Main Street to back up, so we can secure the crime scene.
During that time. Sergeaiit Shinn asked me to look for witness. I located witness on the southeast
corner of the intersection. She was identified by her CA driver license.
told me she was inside the restaurant, "Lucky Guy Burgers," when she saw several Santa Aria
Police Units with their lights and sirens traveling northbound on Main St. She said she decided to go
outsidei and take a look.
While standing on the soritheast corner of Chestnut and Main St. She noticed that the police had stopped
a white truck. She did not have a clear view of the white truck, however she heard the police yelling at
the driver of the truck. She heard the police officers saying "Put the gun down, don't do it." She said she
heard the police officers yell that about 3 times.
She said the police officers gave tlie subject, "more then enough chances." said she tliought to
herself, "What the heck is this guy doing, put the gun down."
She said she then saw a officer with a long gun, walk northbound along the west sidewalk of Main St.
While she was looking bt that officer walking, she lieard about 6-8 gun shots. said she did not have
a clear view of the critne scene, only heard the officer yelling at the subject to "put the gun down" and
"don't do it" several times.
I staye.d in the crime scene assisting with crowd control and traffic control until about 1625 hours, when
I was relieved by Officer J. Valdez #3243.
