Smith and I interviewed Santa Ana Police Officer D. Enriquez #3082, at the Santa Ana Police Officer's Association. Also present in the interview was Attorney Charles Goldwasser. The interview was conducted on the second floor of the Police Officer's Association located at 1600 N. Sycamore. Refer to OCDA report and audio recording for details. Officer Enriquez has been a police officer for approximately 8 !4 years and is currently assigned to Field Operations Patrol Division. On the date of the OIS, he was working and wearing the Santa Aria Police Department uniform with identifying patches. At approximately 1200 horirs, Officer D. Enriquez received a call of an assault with a deadly weapon with shots fired with the suspect having a handgun and shooting at a victim. Officer D. Enriquez responded from the area of 1140 E. McFadden Avenue. Officer D. Enriquez said he was provided with the following description: Male, Hispanic in a white Toyota pick-up truck. Officer D. Enriquez told us he was working the Southeast District driving a black and white police unit when he heard the radio call of an assault with a deadly weapon that had just occurred in the area of 800 S. Cypress or 800 S. Main Street. The call also indicated that the suspect had shot at the victim. The suspect description was given as a Male, Hispanic driving a white pick-up truck. Officer D. Enriquez was assigned the call and he responded from the above location traveling westbound on McFadden. The motor officer stated the vehicle had stopped in the area of Main and Pine. The vehicle was facing northbound on the east side of Main Street. When he arrived a high risk stop was being conducted on the vehicle. Officer D. Enriquez said he ran up to the middle unit aiid assisted with the high risk stop. At this time he heard Officer Garcia say, "He has a gun." (Xficer D. Enriquez stated he had a clear unobstructed view of tl'ie driver using the outside left turn mirror of the truck. Officer D. Enriquez said within moments he saw the driver grab a semi-automatic handgun and placed it to his chin. He continued to hear verbal coinmands saying, "Put the gun down, prit the gun down;' both in English and Spanish. Officer D. Enriquez observed the suspect move his head side to side as he was not complying. Officer D. Enriquez said he saw the suspect pull the trigger and he heard the click. He then observed the suspect bring the gun closer to him and he manipulated the slide and chambers a round. The suspect then places the gun underneath his chin, pulls the trigger and the firearm discharges striking him rinderneath the chin. The suspect then slumps down and immediately heard the engine reeve. The engine then stopped reeving and it appeared the suspect was dead because he was ru'iconscious. Officer D. Enriquez said a total of three officers approached the vehicle from tl'ie right rear of the truck. As they approached the vehicle he heard someone say, "He still has the gun, he still has the gun." Officer D. Enriquez told us the suspect was still moving and they retreated. Officer D. Enriqriez said he assumed the original position on the passenger side of the vehicle. Officer D. Enriquez said while he was in his position he was able to see the suspect moving and he was able to see he was holding a cell phone. He said the driver's door of the vehicle began to open slowly, the suspect then came orit slowly sliding on the seat of the vehicle. Officer D. Enriqriez said he saw the suspect holding the handgun on his left hand. The suspect began to turn counterclockwise and now tlie suspect is facing them. (Xficer D. Enriqriez said they continued to give cori'unands telling the suspect to drop the gun. Officer D. Enriquez said they must have given this command at least 25 to 30 times. At this point the suspect is still holding the gun and facing them. At this time Officer D. Enriquez fired two rounds and his gun jammed. Officer D. Enriqriez said other officers fired at the suspect, he was strucked and goes down. Officer D. Enriquez saw a Sergeant go up to the suspect and to provide lethal coverage ran up. Officer D. Enriqriez said there was no response from the suspect and he took it upon himself to ic3 the guri fro@ the suspeg!:. Smith and-I-intetv-iewed-Santa Ana Police Officer M. Shifflett #3264, at the Santa Ana Police Officer's Association. Also present in the interview was Attorney Charles Goldwasser. The interview was conducted on the second floor of the Police Officer's Association located at 1600 N. Sycamore. Refer to OCDA report and audio recording for details. Officer Shifflett has been a police officer for approximately 7 years and is currently assigned to the Civic Center Directed Patrol. On the date of the OIS, he was working driving unit 859 which is a black and white police vehicle wearing a polo shirt, blue jeans, duty belt with a Santa Ana badge. Officer Shifflett carries his own personal AR 15, Colt 6940 Caliber 556/223. At this time Officer Shifflett was shown a picture of a rifle, which he identified as his rifle. He stated that was the rifle he used and he fired 4 to 5 shots. The riffle is authorized by the Santa Aria Police Department to be used by Officer Shifflett. At approximately 1230 hours, Officer Sifflett responded to a call of shots fired with the subject leaving in a white Toyota vehicle. When he arrived at the location he observed the vehicle stopped on north main. He also observed the subject pointing a gun to his chin. As he was getting his rifle from the trunk of his vehicle he heard a shot coming from the vehicle. Officer Shifflett said he did not know if tlie subject shot at them or if he shot himself. Officer Shifflett took position on a tree that was west of where the vehicle was stopped and observed the subject moving in the vehicle. Officer Shifflett said officers moved forward, but they were called back because the subject was still moving. He observed the subject bring his hand to liis head, but he was not sure if it was a phone or a gun. Officer Shifflett said he had it in a position as if you would be talking on the phone. He said the subject moved his hand and lie was able to see the bottom portion of the phone, but he was not sure if he was talking to someone. Officer Shiflett said 10 to 20 seconds later the door to the truck opened and the driver stepped orit. He said the subject appeared to be hiu'iched over. Officer Shifflett said he was able to see the gun in his left hand as he started to come up towards the officers that were behind him lie started to raise the gun up and at this time he engaged the subject. Officer Shifflet fired 4 to 5 rounds until the subject fell to the ground and he no longer had the gun in his hand pointing towards his partners. Tolosa #2353. The interview was conducted at the Santa Ana Police Department on the third floor of the Investigation Bureau. The following is a synopsis of the interview. Refer to OCDA report and audio recording for details. Officer Tolosa has been a police officer for approximately 19 years and is currently assigned to the patrol division. On the date of the OIS, he was working driving a black and white police vehicle when he heard a radio call of an assault with a deadly weapon. Officer Tolosa said they gave a description of the vehicle via the police radio. The vehicle was described as a white Toyota pick-up truck with a male as the driver. Officer Tolosa said he responded at approximately 1200 hours, from the POA office located in the area of Sycamore and 17th Street. Officer Tolosa said he along with Sergeant Humphreys #2725 and Officer D. Kozakowski #1888 responded to the scene Code 3 (lights and sirens). Officer Tolosa arrived to the area of S. Main Street and Bishop Street along with Sergeant Humphreys and Officer D. Kozakowski. At tis time, Investigator Frazier showed Officer Tolosa a sketch of the scene depicting several police vehicles and asked him if his vehicle was there and he said, "No." Officer Tolosa said he parked behind the initial vehicles. Officer Tolosa said he exited his vehicle and all the positions were being taken by other officers with their guns pointing at the white Toyota pick-up truck. Officer Tolosa said the officers were given commands to the individual to drop the weapon. Officer Tolosa said the door opened and the individual came out with the weapon in his hand and began shifting his body towards the officers. Investigator Frazier asked Officer Tolosa to give as much detail as he could regarding the incident. Officer Tolosa said as he is positioned behind the units he was able to see the individual with the gun. He said as the individual turned towards the officer's gun shots took place. Officer Tolosa said the officers shot the individual when he turned towards them holding the gun he was not dropping as he is being told to do so. Officer Tolosa said the officers told the individual to drop the gun and to come out with his hands up in the air. Officer Tolosa said after the individual was shot they moved up with the shield and they rendered aid. He said the individual still had the gun in his hands as they approached and he remembers someone kicking the gun from his hand. Officer Tolosa said he remained at the scene until he was relieved. Officer Tolosa said he was the person who handcuffed the individual and also rendered aid. At this time the medics were coming up and he assisted with cutting his clothes. He also observed that he had several gun shots, a shot to his elbow with the fragment, a hole on his upper right chest, a shot to his abdomen and a shot underneath his chin area. Officer Tolosa described the weapon as a Smith and Wesson that was underneath the vehicle near the tire. He said this was not a police weapon and he remained on scene because he believed the weapon was loaded. OCDA Investigator Frazier asked Officer Tolosa if he heard any shots coming from the vehicle. He said prior to their arrival they heard via the radio that a shot had been fired, but it was not an officer involved shooting. Officer Tolosa said he could see that his face was covered in blood. Officer Tolosa said the individual was not responding to the officer's commands. He said several o-fficers were yelling to the individaal to drop the gun. He said the officers were there prior to him and they had knowledge that a weapon was involved. He said the individual did not follow the commands and he exited the vehicle with the weapon in his hand. Officer Tolosa stated he did not discharge his own handgun. Refer to OCDA report and audio recording for details. Officer Kozakowski has been a police officer for approximately 28 years and is currently assigned to the patrol division. On the date of the OIS, he was working in a black and white police vehicle wearing the issued police uniform. He was at 1600 N. Sycamore having lunch with Sergeant Humphreys #2725 and Officer Tolosa #2353 while monitoring the police radio when he heard a radio call of a shooting in the Southeast district involving a white truck. He also told us that Officer Berwanger #2001 had located the vehicle. Officer Kozakowski stated he heard the subject had a gun to his head and he shot himself. He also heard that no officers had been involved. Officer Kozakowski stated he along with Sergeant Humphreys and Officer Tolosa responded from 1600 N. Sycamore to the location of the vehicle stop. Officer Kozakowski stated when they arrived he asked Sergeant Humphreys if he had a shield which they located and he assisted Sergeant Humphreys with the shield. He was also told he needed to glove up because the subject was bleeding. Officer Kozakowski said they approached the rear of the veMcle using the shield and they were able to see the subject was still moving. He also heard when the officers were saying he had a gun and to drop the gun. Officer Kozakowski told us the subject was aware that the police was present because the lights were on and they were shouting at him. Officer Kozakowski did not know who fired first, but he heard numerous shots. At this time Officer Tolosa and himself approached the subject and handcuffed him. He said the paramedics arrived within a minute. Lopez has been an police officer for approximately five years and is c'iurently assigned to the Civic Center Patrol Team. On the date of this OIS, he was working in a black and white police vehicle when he lieard a radio call of an assault with a deadly weapon on Cypress Avenue. Ofc. Lopez responded - - from the area of 17th and Flower Streets. There was a lot of radio traffic and he heard that the suspect vehicle had stopped at Main and Pine Streets. Ofc. Lopez heard a motor officer give the license plate of the suspect vehicle. Ofc. Lopez atrived and stopped on Pine Street, -west of Main Street in order to block traffic. Ofc. Ofc. Lopez saw the suspect raise a gray colored object to the right side of his face. It also appeared the suspect's mouth was moving. Ofc. Lopez couldn't tell if the suspect was talking on a cell phone. Ofc. Lopez heard officers yelling at the suspect to "drop tl'ie giu'i" and "don't do it". Moments later, the driver's door of the suspect vehicle opened. The suspect exited and turned his body sorith towards the officers. Ofc. Lopez was unable to see tlie suspecfs hands becarise tlie vehicle's open door was obscuring his view. Ofc. Lopez then heard numerous commands of "drop the grui". He previously worked for the Los Angeles County Sheriff's Department for about Il years. His current assignment is in Patrol and works the day shift from 05:30-18:00. On today's date, 3-11-2015, Officer Gibbons assisted in a vehicle stop of a subject who was a suspect in an assault with a deadly weapon. Nally and made arrangements to have the vehicle towed out of the evidence bay by To and Mo Tow Company. The tow company arrived and towed the Toyota truck to their yard located at 518 N. Poinsettia in Santa Ana. While I was at the crime lab 550 Nally told me the firearms involved in the OIS had been processed and were ready to be released. I took custody of the firearms, 4 handguns and 1 AR type rife. I transported the guns back to the Santa Ana Police Department and delivered them to Cpl. Waldo #2332 CSI Agency:SAPD Narrative: Wednesday, March 11th, 2015. 1300 hours: Detectives in the Santa Ana Police Department Homicide Unit were monitoring the Santa Ana Police Department primary radio frequency. Dispatch broadcast that an officer-involved shooting jyist occurred at Pine Street and Main Street in tlie city of Santa Ana. 1405 hours: Sergeant G. Serrano #2338 conducted a briefing at the Santa Ana Police Depaitment for Homicide Unit detectives. He provided the known details of the incident and investigation. 1430 hours: I arrived at tl'ie scene of the officer-involved shooting. I entered the crime scene throrigh the noithwest perimeter off of Pine Street. I checked in witl'i the crime scene scribe, Officer E. Martinez #3349. 1513 hours: District Attorney Investigator M. Gutierrez presided over the briefing. Present for the briefing were iiwestigators from the Orange County District Attorney's Office, Santa Ana Police Department detectives, Santa Ana Police Department Inteinal Affairs inspectors, and Orange County Sherif'f's Crime Laboratory personnel. Saiita Aria Police Department Sergeant J. Smitl'i #1998 provided a briefing on the incident and tlie initial investigation conducted by patrol officers. Sgt. Sn'ffth indicated that the incident originated in the parking lot behind the "Mariscos El Cangrejo" restaurant located at 819 S Main Street. Calling parties repoited that two males were involved in an altercation iii tlie parking lot and one male was armed with a gun. They also reported that shots had been fired and a white Toyota Tacoma pick-up truck fled from tl'ie scene. The Toyota Tacoma was subsequentl'ylocatedLyrespondingofficetsandan officer-involved shooting occurred at 300 S. Main Street. The victiin Alberto Mendoza reported that he became involved in an arguinent with the suspect Benito Osorio. The argument escalated to a fight in which Osorio fired a single shot at Mendoza. The suspect possibly picked up a casing or the victim's cell phone and fled from the scene in the white Toyota Tacoma. 1535 hours: I left tlie scene and checked out with the scene scribe Officer Martinez. 1545 hours: Corporal L. Rodriguez #2408, Detective G. Moroyoqrii #2727, and I went to 819 S. Main Street where the initial shooting occurred in which the suspect Benito Osorio fired a shot at the victim Albeito Mendoza. The altercation between the suspect and victim occurred in the rear parking lot of the business complex of 815 S. Main Street and the Mariscos El Cangrejo "Nice" restaurant at 819 S. Main Street. The building at 815 S. Main Street was comprised of a two-story multi-unit business complex building that extended east from the east side of Main Street. This business complex building contained various small businesses such as beauty salons and tax preparers. Directly sorith of the building at 815 S. Main Street and the Mariscos EI Cangrejo "Nice" restaurant at 819 S. Main Street. The alleyway opened into an asphalt-concrete parking lot located east of botli buildings. The parking lot was bordered on tlie northwest side by the east side of the business complex building at 815 S. Main Street. The parking lot was bordered on the sorithwest side by a single story residence at 819 'A S. Main Street, behind the Mariscos EI Cangrejo "Nice" restarirant. Beige brick retaining walls, approximately six feet in lieight, ran along the nortli and south sides of the parking lot. A green wroright-iron rolling gate bordered the east side of the parking lot. A driveway on the east side of the parking lot at the gate led directly onto 800 S. Cypress Avenue. The parking lot consisted of seventeen parking stalls on the noitl'i side of the parking lot delineated by wite painted lines on the asphalt. Tliere were no marked parking stalls on the soutli side of the parking lot. There were vehicles parked in the first seven parking stalls (as counted east from the west side of the parking lot). The remainder of the parking stalls was empty. A red 1999 Ford F-150 pick-up truck, be!iiig California license plate #5 was parked in the seventh parking stall (as corinted east from the west side of the parking lot). There were no additional vehicles located east of the Ford F-150 in the parking lot. A red 2000 Chevrolet Impala four door sedan, bearing California license plate # was parked facing sorith along the east curb-line of 800 S. Cypress Avenue directly east of tlie parking lot. The parking lot was cordoned off witli yellow crime scene tape across the west and east sides of the parking lot. Officer S. Lii'n #2984, Forensic Specialist M. Maiocco #2364, and Lead Forensic Specialist M. Waldo #2332 were present at the scene. They advised me that the altercation between the suspect and victim occrured in the parking lot directly east of the red 1999 Ford F-150 pick-up. The victim subseqriently fled eastborind through the parking lot and soright cover behind the red 2000 Chevrolet Impala parked on Cypress. I also saw a body, on a gurney, decedent was later identified as Benito Osorio. Officer D. Kozakowski #1888 and DA INV. Linn covered with a blanket from head to toe. The Officer Kozakowski notified me that he rode in the ambulance with Osorio. They arrived at the hospital at approximately 1321 hours and Osorio was pronounced dead by Trauma Surgeon H at 1324 hours. Trauma Clinician was also in the room and she said the coroner was called by medical staff at approximately 1334 hours. also later said Osorio was pronounced dead shortly after he arrived and blood was not drawn from his body. 1545 hours: Deputy E. Kiru'iey arrived at the above time and Forensic Specialist Booth arrived shortly after. Kiru'iey began her examination of the body after several photographs were taken. Osorio was completely nude with what appeared to be a torn pair of gray boxer briefs underneath him. Osorio had a tribal tattoo with a heart on his upper left arm. A black, Nike, tennis shoe with a white sock shoved inside it was on the gurney next to Osorio's left leg. Kiru'iey collected the items, placed them in a paper bag and took custody of the property. Osorio had medical apparatuses on his face, ripper and lower torso. Kinney observed approximately 15 perforating gunshot wounds throughout his head and body. Osorio had a three perforating wounds on his head. One was underneath his chin, the second was on the left side of the bridge of his nose and the third was on the left side of his forehead. He had another perforating wound at the base of his neck. He had another wound on the right side of his chest in the shape of a rectangle. Once Kiru'iey manipulated the skin, it appeared to be two bullet holes side by side. Given the circumstances of the call, we begin to travel in the direction of the call for service. The call was updated and the suspect was said to have fled with the firearm in a white truck. Several nearby officers located the truck and a traffic stop was initiated at the intersection of Pine/Main. An officer involved sliooting occuned while we were en route to assist. Cypress in an effort to locate tlie initial victim. As we turned south on Cypress from Bishop, I observed several people with their arms waving over their head in what appeared to be an attempt to get our attention. As I exited our vehicle, I observed two subjects come up to me; one was later identified as Albeito Mendoza and the other as was very animated, yelling frantically and pointing towards Alberto, saying, "He was just shot at!" When I looked at Alberto I could see lie was overwlielmed. He was moving around rapidly and breathing lieavy. His eyes were wide and lie was going from being doubled over to standing strait rip. I iminediately asceitained if Alberto had actually been liit witli any bullets and determined l'ie liad not. I asked him to show me where this altercation occurred and he showed me to the parking lot/alley just soutli of the apartment complex at 814 S. Cypress. This alley way is an east/west alley way whicli runs from Cypress to Main Street. Towards the east end which opens onto Cypress there is parking available for vehicles on the noitli side, presumably overflow parking for the apartments. On the west poition of tlie alley are businesses on the north side and a restaurant on the soutli side. An additional alley way intersects to form a "T." This delineates tlie restaurant on the west witl'i the residences on tlie east. According to Alberto, it was in this alley where liis altercation with the suspect took place. However, tlie altercation was fluid and led to the eastern portion of the alley way as well. After speaking with Albeito, I learned he liad been involved in a physical altercation witli a suspect wl'iom lie identified as Benito Osorio. This physical altercation resulted in Osorio using a lian described as be' a silver in color semi-automatic ssib a.45 caliber to shoot one time at Alberto. Osorio then fled the scene in a wliite Toyota Tacoma. For more information, refer to the detective's supplemental repoit under the same case nui'nber. During an area search, I came upon again. I asked her if slie knew either the victim or tlie suspect and she told me she did. I asked her who she knew and she said, "Him." As she did tliis, she pointed to Alberto wlio was standing next to my police unit with Cpl. Mendoza #2934. I asked lier how slie knew him and she told me he was her friend of two years. She further explained to me slie liad met him because lie owns the nearby taco truck. I arrived at approximately 1306 hours and assiste6 with traffic and crowd control. Dispatch redirected me to the 800 block of South Cypress Street to aSsiSt with the original 245 scene. When I was relieved, I responded to Cypress Street and arrived at approximately 1309 hours. Officers Sontag and Greaver were already on scene interviewing witnesses. I assisted officer Greaver with crime scene tape then located witness who was standing on the west sidewalk in front of 814 S. Cypress Street. Just before I began to interview Corporal J. Mendoza arrived on scene to assist. I briefly spoke with Corporal J. Mendoza then focused my attentions on I then it'iterviewed wl'io told me the following information. said she is the located at 814 S. Cypress Street in the City of Santa Aria and she resides in escorted me to her unit wlffch is located at the southwest corner of her complex. I entered the unit and lead me into her kitchen. physically stood in front of her gas range with her back facing the south wall of her kitclien. I could see there were two south facing windows in her kitchen that overlooked the business parking lot of 815 S. Main Street where the assault with a cleadly weapon occurred. aid as she was cooking a meal for her family when she heard one gunshot coming from this parking lot. hen physically turned around and pointed to the window that was directly behind her. As was looking outside she pointed at the victim who was standirig in the parking lot and speaking with officer Sontag. stated, "I saw him run towards Cypress Street then he turned around and started to run towards Main Street. said the expression on the victims face was that of extreme fear. then physically moved herself over to the second window in the kitchen which gave a little better view of the parking lot. said she could her tlie victim scream, "Help Me, Help Me." said from this window she could see two unknown males in bright orange tee-shirts exit a truck and wailk over to the victim. said she never saw who fired a gun nor did she see the vehicle involved. said :';ihe exited her apartment and walked out to Cypress Street where she saw the victim pacing back and forth in the parking lot. said the victim was speaking to someone on his cellular phone and he seemed scared. I asked wliy she believed she heard a gun shot and she replied, "There was a sliooting in my apartment complex before, so I could tell the noise was a gun shot." Sergeant Smith arrived moments later and took over for Corporal Mendoza as scene supervisor. I was then contacted by Corporal L. Rodriguez #2408 who asked me to assist with the investigation. 14:05 Sergeant G. Serrano #2338 of the Santa Ana Police Department Homicide Unit provided a briefing germane to the officer involved shooting. I was tasked to assist with canvassing the neighborhood for witnesses. 14:30 I arrived and entered the crime scene located at 300 South Main Street. I checked in with Officer E. Grace that assistance was needed with an officer involved shooting (OIS) and to contact Crimes Against Person's Sgt. Serrano. At about 1405 hours, Sgt. Serrano provided a briefing about the OIS (date, approximate time, and location). At 1418 hours I contacted photo/video specialist Jeff Carlson #2120 and requested his assistance at the OIS scene for possible evidence collection of video. At about 1434 hours, I arrived at 300 S. Main St. from Pine/Sycamore and checked in with the scribe. At about 1513 hours, Sgt. Smith #1998 provided a briefing of the events that led up to the OIS. At 1529 hours the briefing was terminated and I was assigned with District Attorney Investigator Eric Wiseman to conduct wttness canvasstng. Investigator Wiseman and I began our canvassing at the story building is located on the east side of Main St. contacted the following people in the building and were is a synopsis of the interviews. 1535 hours; apartment complex at 301 S. Main St. This green 2 with the numbers "301" on a brown door. We recorded by Investigator Wiseman. The following said he was on the balcony when heard the police saying in English and Spanish to put the gun down followed by police officers positioniiig themselves around the vehicle. He heard a gunshot from iside of the white pickup followed by shots from officers. After the shots were fired, he saw officers providing lifesaving measures. said he did not record the incident, didii't see the gun and didn't see the door of the pickup open. 1545 hours, was inside of her apartment and sees from the window onto Main St. She heard "put down the gun" and police officers outside of their cars. She walks onto tlie balcony and again hears officers say to put it down. said she hears officers then say that "he's got it to his head" followed by a gunshot and assumed he shot himself. While the subject is inside of his vehicle, he picks up his arm and police shot him wliile inside of his vehicle. She sees officers open up the vehicle door and begin to treat him. said she took photographs on her cellphone as tlie officers were treating him. She agreed to email them to Investigator Wiseman. There was no answer at tlie door to apartments 1558 hours; said she was not home at the time of the incident. 1600 hours:, said she heard about 5 gunshots while looking out of the north window. She said she heard one gunshot then saw an officer putting up police tape as well as an officer putting on a vest. About 3 minutes later she heard 4-5 gru'ishots but didn't see anything else as she ran back into her residence. 1610 liours; was inside of her apartment when she lieard sirens and saw police units southbound on Main St. She saw officers had their guns draw while standing by their doors. Sl"ie heard yelling but didn't know what was said. She then ran to residence and heard 1 gunshot. She then heard about 6 more gunshots when she then saw a guy on the ground with the ambulance working on him. heard I gunshot then seconds later heard 3 more gunshots. Investigator Wiseman and I tlien made contact at Pomeroy's Muffler Shop at 315 S. Main St. and contacted three employees. The following is a synopsis of the recorded interviews. 1631 hours; said he was working at Pomeroy's muffler shop and was in and out of the shop as the events transpired. said he heard screaming something similar to "hands up." He then heard ] gunshot while he was inside of tlie garage. He then heard 7-8 more gunsliots while he was inside of the garage. When he ralked outside, he saw a person on the ground. 1636 hours; said-he was- working at- Pomei-oy's i'nuffler -shop-when he heard one gunshot while inside of the garage. He walked outside then heard 1 gunshot followed by 4-5 more gunshots. 1640 hours; said he was working at Pomeroy's muffler shop and heard an unknown number of gunshots while inside of the garage. When he went outside, he saw a person on the ground next to a white pickup. Investigator Wiseman and I then made contact with a business where we contacted two employees. The following is a synopsis 1656 liours; at 220 S. Main st., Botanica Santa Isabel, of the recorded interview. was working beliind the cash register and didn't see or hear anything that occurred outside. He is the owner of the business and didn't see or hear anything outside as he was inside of his office.
