Cpl. L. Rodriguez #2408 Wednesday, 03-11-15, 1640 hours- Interview with Alberto Aleiandro Mendoza Hernandez Pursuant to this investigation, Det. McClaskey and I spoke with Alberto at the Santa Ana Police Department. Earlier, we had responded to an officer-involved shooting (OIS) investigation at 200 S. Main Street, Santa Ana, preceded by an assault with a firearm incident at 815 S. Main, Santa Ana. For details on our portion of tlie investigation at 815 S. Main, refer to Det. McClaskey's supplemental report. The following is a brief summary of our interview with Alberto. Refer to audio recording for details. Alberto explained his involvement in tlffs case. He is the owner of the "Alebrijes Grill" taco truck and usually parks in tlie area of Main and Cubbon Streets. He 'stated that today at approximately 1105 hours, he drove to the "Cangrejo Nice" restaurant at 815 S. Main in order to eat. He la'iew Benito from a previous contact with hin'i. Albeito explained he lias a friend identified as Recently, lias been telling Alberto that Benito lias been bothering lier Alberto said that approxiinately two weeks ago, he drove by a motel in the area of Main and MacAithur Streets, Santa Ana, and saw Benito's wl'iite truck in the parking lot. Alberto called o respond and identify the truck as belong to Benito. When she contumed it was his truck, they knocked on his motel room and spoke with him. A A Today, Benito called him to liim as soon as they saw eacli other. Alberto said Benito had his truck parked in the middle of the parking lot, facing westborind towards Main Street. Alberto parked lffs SUV and walked towards Benito. Benito was standing next to the driver's side door, which was open. As soon as Alberto was within several feet of Benito, Benito retrieved a chrome semi-aritomatic handgun from the interior of the cab. Benito pointed the handgun at Albeito Benito ordered Alberto at gtuipoiiit to get into his truck. Alberto refused becarise he knew Benito wo'i'ild kill him. Benito continued to insist Alberto enter his truck and after continriing to refuse, Benito grabbed l by the arm. Alberto, believing lie would be killed, began to physically struggle witli Benito. During the struggle, a ror'tnd fired from tlie handgun. Albeito was able to eventually pin Benito against a brick wall and then made a run for it. Albeito said Benito kept telling him to let go of lffm. Alberto refused, fearing Benito would slioot him. Alberto then began to tire and decided to run in a zig-zag pattern towards Cypress Street, expecting to be sliot at. Benito never sliot at Albeito but got into his truck and drove northbound on Main Street. Albeito did not ki'iow what happened after Benito left the parking lot. J. Perez #3 120 and I were advised by Sgt. Grace that our assistance was needed in the area of Main and Chestnut regarding an officer involved shooting. Det. J. Perez and I were directed to meet with Sgt. Shin at Main and Chestnut for further direction. Det. J. Perez and I responded to the crime scene together (same vehicle) and checked in with the scribe at 1507 hours. Sgt. Shin advised us that we would be transporting officers back to the police station. At 1517 hours Det. J. Perez and I checked out of the crime scene and transported Ofc. S. Lopez and Ofc. J. Berwanger back to the Santa Ana Police Department. We then returned back to the crime scene however we remained on the exterior and did not enter it. Ofc. R. Tolosa and Ofc. E. Majors exited the crime scene and we transported them back to the Santa Aria Police Department as well. We were notified by Sgt. Serrano requested assistance with an officer involved shooting. 1405 hours I attended briefing led by Sgt. Serrano at the Santa Ana Police Department. The information provideawasthatanassaultwithadead wea nhadoccurredbetweentwo aLesubjects. -The suspect fled and was stopped by officers in the area of 300 S. Main Street, where the officer involved shooting subsequently occurred. Refer to the initial police reports for further details. 1430 hours I arrived at the crime scene and entered from the west perimeter at the 100 block of W. Pine. I checked in with Ofc. E. Martinez #3349 who was maintaining a crime scene personnel log. 1513 hours Sgt. Smith #1998 was the scene supervisor and provided a briefing regarding the officer involved shooting. Present were detectives of the Santa Ana Police Department Homicide Unit, Family Crimes Unit, Internal Affairs, and Investigators from the Orange County District Attorney's Shooting Team. At the completion of the briefing, I was assigned to assist OCDA Investigator Vivian Tabb with a canvas of the area. The following is a synopsis of the statements made by the individuals who were contacted during the canvas. Main in the city of Santa Ana. Inv. Tabb and I contacted the owner, who stated he was not present when the incident occurred and he just arrived to the bakery at about 1330 hours. Inv. Tabb and I then contacted who is an employee at the bakery and stated he had seen what happened. said he was inside the bakery when he saw the white truck on the street with the police cars behind it. stated the vehicle was occupied by a single male occupant. The male subject exited the white truck and saw that the male subject had blood on his face. The male subject also had a gun in his hand. When the male subject exited the vehicle he pointed the gun at the officers. said the male subject was holding the gun with both hands. heard 2-3 gunshots. The male subject fell to the ground and the officers went up to see if he was still alive. said he also saw the firefighters arrive at the scene to aid the male subject. Inv. Tabb and I then contacted said he was sitting inside the bakery when the incident occurred. stated he was sitting next to the window on the north side of the bakery. He said the incident happened at about 1230-1240 hours. saw the white truck in the street with the police vehicles behind it. said the white truck had a single male occupant. The male subject got out of the white truck and he was holding a cell phone in his hand. said the male subject put both feet on the ground and then he was shot by the police. said the male subject's hands were by his sides and he was only holding a cell phone. The business located at 316 S. Main Street was vacant. The business located at 320 S. Main Street was a marijuana dispensary. Inv. Tabb and I contacted who was at the front desk. was hesitant to provide her personal information. said she heard sirens and looked outside. There were people taking video and she saw a white truck. said the police started shooting and she heard 7-10 gunshots. There was a camera on the east side of the building that faced north/northeast. said she does not know if the camera is working. showed us the video she had on her monitor and the cameras she showed us did not cover where the incident occurred. The business located at 320 S. Main Street Unit A and Unit B were vacant and appeared to be under construction. At 1630 hours, Inv. Tabb and I responded to 401 S. Main Street and contacted stated the cameras to the business only cover the sidewalk area and they do not show the street. The cameras would not show the location where the incident occurred. said he was inside the business when the incident occurred. saw the police vehicles and he heard 5-6 gunshots but he does not know who shot. He said the police had been on scene for about 30-40 minutes before the gunshots. At 1700 hours, Inv. Tabb and I responded to Acapulco Travel at 222 S. He did not know how many gunshots he heard but he said it lasted about 2-3 seconds. Investigator Tabb and I then contacted who was also at stated she did not see what happened. Present in the conference room were Orange County Crime Lab Lead Forensic Specialist Andrew Hayes, Forensic Specialist Rachel Booth, Orange County District Attorney Investigator Ryan Smith, Detective C. Achziger # 2978, Cpl. Bryan Atkinson #2856, Attorney Chuck Goldwasser Sr., and I. LFS Hayes collected the evidence. For further details refer to Inv. Smith and LFS Hayes supplemental reports. Santa Ana Police Officer Ryan Shiflett #3264 was processed. He was wearing a Santa Ana Police department issued blue polo shirt with a badge printed on the left chest in white, with Santa Ana Police Department patches printed on both sleeves in white, and Santa Ana Police printed in white on the back. Officer Shiflett was wearing blue jeans, and a black duty belt. The following items were on the sam brown belt: -Glock 22 .40 caliber handgun (serial # mounted in holster on hip -3 magazines in a magazine pouch on his duty belt -Taser X-26 Serial -Baton ring -Police radio -Flashlight - - ---2 ha-ndcuff-ease -Key ring -Tournrquet -Knife in right front pants pocket LFS Hayes examined Officer Shiflett's weapon, there was a cartridge in the chamber and 15 cartridges in the magazine. Each magazine in the magazine pouch was fully loaded and each contained 15 cartridges. LFS Hayes took overall photographs of Officer Shiflett. For further details refer to his supplemental report under OCCL FR# 15-43742. 1650 Hours: Santa Ana Police Officer David Enriquez #3082 was processed. He was wearing a short sleeved blue police uniform with SAPD patches on both sleeves, and a badge and name plate on the frorit. Enriquez wore a black leather duty belt. Each magazine in the magazine pouch was fully loaded and each contained 15 cartridges. LFS Hayes collected the firearm. Officer Enriquez also carried a back-up weapon; Smith and Wesson Airweight model # 442-2 (serial #D loaded with 5 .38 caliber cartridges. LFS Hayes examined Enriquez' back-up weapon which was loaded with 5 unexpended .38 caliber cartridges. LFS Hayes took overall photographs of Officer Enriquez and also swabbed what appeared to be blood from Officer Enriquez' left boot. The boot was not collected. For further details refer to LFS Hayes supplemental report under OCCL FR#15-43742. 1713 Hours: Santa Ana Police Officer William Sweet #1805 was processed. Officer Sweet was ---wea-r-ittg-a-Sanfa-Ana-Pol-ice-E)epartmen-t-issued-poli-ce-uniform-with-S-anta-An-a-Po-lice - patches on both sleeves and a metal Santa Ana Police officer Badge on his left chest. Officer Sweet was wearing a black duty belt with the following items on the duty belt: -Glock 22 .40 caliber handgun (serial # in a duty holster -2 magazines in a magazine pouch -Taser X-26 serial # -Police Radio -Handcuff case -ASP in the left SAP pocket LFS Hayes examined Officer Sweet's duty weapon, there was a cartridge in the chamber and 12 cartridges in the magazine. Each magazine in the magazine pouch was loaded with 14 rounds each. Tlie interview was recorded by Investigator Wiseman. Officer Demarco told us tliat lie is currently employed with the Santa Ana Police Department as a part- time Reserve Police Officer. He liad over tlffrty years of experience as a full-tinie Police Officer and retired at the position of Corninander witli the Santa Ana Police Depaitment. Today, he was working as pait of a two-man patrol rinit with Officer W. Sweet #1805. Their unit designator was "172 Alplia." Officer Demarco was the passenger in the patrol car drivei'i by Officer Sweet. Officer Demarco said that he and Officer Sweet were in the area of 1st Street and Bristol Street heading eastbound when they heard a call of a shooting that had just occurred on Cypress Avemie. Units were dispatched to the call witli a "Code 3" response, and Officer Demarco and Officer Sweet decided to drive toward that area to possibly assist on the call. Officer Demarco said lie and Officer Sweet reached tlie area of 1st Street and Broadway. Officer Demarco then heard a broadcast over the radio by Motor Officer J. Berwanger #2001 in which Officer Berwanger indicated that he had located a vehicle which was a possible match to tl'ie suspect vehicle involved in tlie shooting. Tlie suspect veliicle was described as a possible white Nissan or Toyota. Officer Demarco said he and Officer Sweet drove soutliborind on Broadway and then eastbound on Pine Street towards Officer Berwanger's location. Officer Berwanger broadcast over the radio that tlie vehicle had failed to yield. Officer Berwanger continued to broadcast that he was in the area of Chestnut Avemie and Orange Avemie and the velffcle was a wite Toyota Tacoma pick-up truck. Officer Berwanger tlien broadcast that tlie velffcle was 'atnning noitlibound onto Main Street and radioed to the unit coming sorithborind tliat the vehicle in front of lffm was the suspect vehicle. The ru'iit traveling sorithboruid to which Officer Berwanger was referring was the unit being driven by Officer Sweet and Officer Demarco. Officer Demarco stated tliat Officer Sweet immediately tumed their patrol unit around and activated the overhead lights. They then pulled directly behind the suspect vel'iicle which was stopped in the street. Their rinit was the first unit behind the suspect vehicle. Their unit was also the closest to the east cutab- line of Main Street. Motor Officer Berwanger parked his motorcycle on tlie grass/sidewalk area to the east of them. There were mimerous units quickly on scene and blocking the surrorinding streets as well as setting up behind tl'ie suspect vehicle. The roadway was clear of traffic through Pine Street. Officer Demarco said officers to his left (west of him) began giving verbal cominands to the driver of the suspect vehicle. Officer D. Enriqriez #3082 then shorited that the suspect had a gun to his liead. The officers began giving mu'iieroris verbal con'unands to "drop the gru'i" and "throw the grui orit of the wiiidow." Officer Demarco said he heard a gunshot from witliin the suspect vehicle. It appeared that the suspect began convulsing and flopping aroruid inside of the vehicle. Officer Demarco's view of the interior of the vehicle was obstructed, however, due to his position and tlie window tinting of the vehicle. The engine of the vehicle began revving, but the vehicle did not move. Officer Demarco started to approacli the front passenger's side of the suspect vehicle, but tlien retreated backward a'fter officers shorited that the suspect was moving around again. They also indicated that the suspect was moving lffs hands by his face aiid appeared to be pritting a cell phone to his liead. Officer Demarco stated tliat the suspect then came orit of tlie vel'iicle. Officers began ordering the srispect to drop tlie gun. Officer Demarco corild not see the srispect, however. He could only see the top of the suspect's head above the vehicle. Officer Demarco assisted in clearing the vehicle. Medics who liad been staging nearby were tlien called in to render aid to the suspect. Officer Demarco assisted in pritting up criine scene tape. He was subseqriently ordered to stay with Officer Sweet as Officer Sweet had fired rorinds at the suspect. Santa Ana Blvd. in Santa Ana. The examining pathologist was Dr. others present in the room were Forensic Scientist Forensic Specialist J and the Forensic Assistant was District Attorney Investigator and I viewed the autopsy through a glass window in an adjoining room. The examination began at about 0905 hours, when the coroner's staff removed the decedent Benito Osorio from the white coroner body bag that was on the examination table. I noted that Osorio had multiple gunshot wounds on his body and head. I also noted that Osorio had medical devices such as EKG stickers, a tube in his mouth, a large needle on his upper right chest, and a plastic 1.V. device on his lower leg below the leff knee. Forensic Scientist J collected fingernail scrapings from Osorio's fingernails. Forensic Specialist took photographs of the body. noted that Osorio had multiple gunshot wounds to his body and head. Dr. dvised that it appeared a self-inflicted gunshot wound had entered under the chin and exited the forehead but was not immediately lethal. She noted a second gunshot wound entered the brid e of his nose and trav lled down o a erneck/upperchest area and lodging there. noted a gunshot wound to Osorio's right chest area with stippling. The bullet fragment was recovered from his upper right back. She noted this was a lethal wound as it disrupted the carotid artery. She noted a second lethal gunshot wound entered the right abdomen which disrupted some major blood vessels which she advised was also a lethal wound. noted an additional gunshot wound which entered the lower abdomen area and ended in the lower right buttocks area where the bullet was recovered. Dr. Davenport noted 4 entry holes including stippling to Osorio's right arm/elbow. She removed a bullet and jacket fragments from his elbow and noted only 1 exit wound. Santa Ana Police Dispatch broadcast that an officer involved shooting just occurred in the area of Pine Street and Main Street in tlie City of Santa Ana. 1405 hours: Sergeant Serrano #2338 of the Santa Ana Police Depaitment Homicide Unit conducted briefing for the detectives. Sergeant Serrano provided tlie known facts of the incident. At this time, Sergeant Serrano assigned me as the case agent along witl'i my paitner C. Achziger #2978. 1430 hours: Detective Achziger and I arrived at the scene of the officer involved sliooting. We entered the -perimeter-and-checked-in-with (-fficer E; Maitinez-#334');-who was-the scribe-at th 1513 hours: Present in the briefing were investigators from the Orange County District Attorney's Office, Santa Aria Police Depaitment detectives, Santa Ana Police Depaitment Internal Affairs Inspectors and Orange County Sheriff's Crime Laboratory personnel. Santa Ana Police Sergeant J. Smith #1998 provided the briefing on the incident and tlie initial investigation conducted by patrol officers. Sergeant Smith indicated the incident occurred behind tl'ie parking lot of the "Mariscos EI Cangrejo" located at 819 S. Main Street. The reporting party indicated two Hispanic males were involved in a fist figlit and one of the males had a liandgun. They also reported that shots were fired during the fight and the suspect fled the area in a wl'ffte Toyota Tacoma. Tlie vehicle was located by the responding officers. I spoke with Sgt. Shin and he asked me to canvass the businesses on the west side of Main St. starting at Murray's Hardware store located at 210 S. Main St. --IcontactedemployeePayan, M -HardwareS-tore. He-told-mehedidnot-see the shooting because he asked customers and employees to get inside the store fearing something might occur. He stated while he was inside he heard something hit the building. He eventually checked to make sure it was safe to come out and he checked the building. stated he saw what appeared to be a bullet hole on an aluminum frame of the front window of the store just north of the front door. I looked at the hole and it appeared to be an entry and no exit was located. There are no cameras on the exterior of this business. Yellow police tape was placed around the possible bullet hole location. It should be noted that does not remember if the hole was already there or not. I advised Sgt. Shin about the bullet hole and he instructed me to tell Forensic Specialist Clyde. Clyde then took photographs of the hole in the aluminum frame. I also checked with staff and customers at the Botanica Santa Isabel located at 220 S. Main St. This business has on exterior camera that points downward in a northeast direction toward the sidewalk and not in the direction of the shooting. No one at the location stated they observed the incident. I then checked with the staff and customers of Acapulco Travel located at 222 S. Main St. They did not see the incident and stated they did not have any exterior cameras. I was also advised that the interior cameras only record the interior of the business. I stopped my canvassing because the other business' on the west side of the street between Pine and Chestnut were already contacted by another officer per Sgt. Cypress/Main Street in the city of Santa Ana, CA. After the commission of the aforementioned crime, the suspect, later identified as Benito Osorio, http://ir3/IR2.Web/Report.aspx?action=edit report&reportid=550000000000... 8/3/2015 Santa Aria PD 2015-06456: Supplemental Report by #2770 Page 3 of 5 fled the scene in his white 2005 Toyota Tacoma, bearing the California license plate assigned number and later became involved in an Officer Involved Shooting (OIS) which occurred in the area of 200 S. Main Street. During investigation into this OIS, SAPD Patrol Division Sergeant R. Shin #2386 was identified as a witness to the incident. At approximately 1848 hours, QC DA Investigator D. Fulcher and I conducted an interview with Sergeant Shin. This interview was conducted within an interview room located within the SAPD Investigations Bureau and audio-recorded by DA Inv. Fulcher. Subsequent to the interview, DA Inv. Fulcher retained custody of said recording. Below is a synopsis of the interview conducted with Sergeant Shin. For complete details in regard to Sergeant Shin's statements, please see DA Inv. Fulcher's report and the above indicated recording. At the beginning of the interview DA Inv. Fulcher and I identified ourselves and obtained the complete identification inforination from Sergeant Shin, inclusive of his badge number, modat/call-sign, law enforcement history, assignment and all factors relevant to our investigation at the time of the OIS. It should be noted that all statements provided by Sergeant Shin were made of his free will and in no way under duress in any form or fashion. As we began to discuss the OIS and all actions conducted/observed by Sergeant Shin prior to it, he told us the following: At approximately 1300 hours, prior to the incident being investigated, Sergeant Shin was in the area of MacArthur Boulevard and MacArthur Place, conducting his normal work duties. While there, he overheard the SAPD Dispatch Division broadcast a Shooting In -P-ogresscal.l. Upon-he-ar-ing-thec-a-l-l-,-Serge-ant-8h-in-r-espended-tothe-ineident,t-r-avelling- west on MacArthur Boulevard and continuing northbound on Main Street. During his travels, Sergeant Shin received additional information indicative of the approximate location of the shooting call, 800 - 814 S. Cypress Street, the fact that one (1) round had been fired, the description of the suspect vehicle, a white pick-up truck, and the vehicles path of travel: Westbound on Main Street. As Sergeant Shin neared the area of the call, he overheard SAPD Traffic Division Officer J. Berwanger #2001 broadcast that he found the vehicle. While still travelling northbound on Main Street, in the area of McFadden Avenue, Sergeant Shin received additional information indicative of the fact that several SAPD units had stopped the suspect vehicle and were facing in a northbound direction. From his vantage point, he could also see several SAPD Patrol Division vehicles stopped in the northbound lanes of travel, with their lights activated, in the above area. Requests were also being broadcast in regard to the necessity for traffic control for the incident. While monitoring further SAPD radio transmissions, Sergeant Shin overheard unknown officers relay information in regard to the suspect of the call. These transmissions indicated that the suspect was armed and had placed a firearm to his chin. Based on the aforementioned information, Sergeant Shin believed that Q Osorio may be contemplating suicide. Additional information relayed by officers : %_J Iindicated that one shot had been fired by someone other than a police officer. Sergeant :, Shin then believed that Osorio had indeed shot himself. ', { After receiving word of Osorio's self-inflicted gunshot wound, Sergeant Shin arrived on I scene; finding himself in a position approximately ten (10) to fifteen (15) yards south of 1 Iseveral SAPD Patrol Division units who were conducting a High Risk / Felony Car Stop. y From this vantage point, Sergeant Shin saw several SAPD Uniformed Officers standing ' next to their respective SAJ'D Patrol Division vehicles. These officers, furthermore were I positioned horizontally across Main Street with their duty firearms drawn and pointed at I the suspect vehicle. Sergeant Shin was also able to identi'fy the suspect vehicle as a white Toyota pick-up truck. By this vehicle description, I believed Sergeant Shin to be speaking of Osorio's aforementioned 2005 Toyota Tacoma. Sergeant Shin also heard several on-scene officers giving commands to Osorio. These coinmands were inclusive ,of orders such as "Don't do it!" and "Put your hands up!" I :Once onscene, Sergeant Shin assumed therole of Field Supervisorand began tosurvey ! the area for officer/public safety and logistics considerations. While doing so,however,: !: he viewed Osorio's vehicle and, although he could not see clearly inside, discerned that .q I there appeared to be one occupant, based on the silhouette. As the officers engaged in the Q- vehicle stop discussed aid rendering measures for Osorio, due to his self inflicted injury, these discussions ceased upon the advisement that he (Osorio) was still alive and moving j about within his vehicle. Upon hearing this discussion, Sergeant Shin directed the on-I seene officers to-continue their4i-alogue-with Osorio and-ha-ve-h-irn-exit-the veh-icle_and_ surrender. Now approximately one (l) to two (2) yards behind the line of officers mentioned above, Sergeant Shin saw Osorio exit the driver's door of his vehicle. As he advised the other SAPD personnel of this fact, Sergeant Shin saw that Osorio appeared to be in a dazed state and/or in pain. In Sergeant Shin's observation, Osorio also appeared to be disoriented and was bleeding/bloodied about his face, hands and clothing. When asked if he heard Osorio saying anything to the officers in front of him at this time, Sergeant Shin said that he did not. After fully exiting his vehicle, Osorio faced the SAPD officers in front of Sergeant Shin. At this time, officers again issued commands directing Osorio to raise his hands. As Sergeant Shin focused his attention on Osorio's hands, he saw that Osorio was in possession of a silver semi-automatic handgun with wooden grips, which he held in his right hand. This weapon, furthermore, was pointed in a southeasterly direction as Osorio leaned against his vehicle, in a semi-crouching position, with his arm bent at an approximately ninety (90) degree angle. Upon the conclusion of the shooting, Sergeant Shin took control of the scene and began ! to direct SAJ'D personnel in regard to cordoning off the area in order to preserve the } scene and locating/identifying witnesses. He also obtained Public Safety Statements in ' regard to the incident and, in doing so, learned that there were five (5)shooting officers tinvolved. He identified these officers as Officer D. Enriquez #3082, Officer N. Quijas t !#2958, Officer D. Garcia #3231, and Officer W. Sweet #1805, and Officer R. Shifflett #3264. At this point of our interview, Sergeant Shin provided a summary of the Public Safety Statements/Information given by each shooting officer. After obtaining the above statements, Sergeant Shin continued to coordinate other logistical matters. In this vein, he also coordinated the escorting of all five (5) officers 1 involved in the shooting to the SAPD Station. It should be noted that all statements provided by Officer Berwanger were made of his free will and in no way under duress in any form or fashion. As we began to discuss the OIS and all actions conducted/observed by Officer Berwanger prior to it, he told us the following: At approximately 1240 hours, Officer Berwanger was proceeding northbound on Main Street from St. Andrew Place, having completed a collision investigation in the area. At this time he was driving his Santa Ana Police Department (SAPD) issued motorcycle. Upon reaching the area of Edinger Avenue and Main Street, he overheard the SAJ'D Dispatch Division broadcast a call of shots being fired in the area of 819 S. Cypress Street. Officer Berwanger then heard a second radio call of shots being fired in the aforementioned area on Cypress Street. As he continued northbound on Main Steet, now reaching the area of 1000 S. Main Street, Officer Berwanger received additional information in regard to the shooting call; specifically noting that the incident involved firearm(s) and a suspect vehicle (a white Toyota) which was last seen in area of Cypress Street proceeding toward Main Street. Given the above information, Officer Berwanger proceeded eastbound on Bishop Street toward Cypress Street. As he did so, Officer Berwanger saw a white Toyota pick-up truck proceeding northbound on Cypress Street at a high rate of speed: Approximately fifty (50) to sixty (60) mph. Believing that the aforementioned pick-up truck was the suspect vehicle involved in the above indicated shooting, Officer Berwanger followed it, activating his Law Enforcement Vehicle Emergency Lights as he did so. Based on Officer Berwanger's account, I believe Osorio's vehicle, as mentioned above, to be the vehicle of which Officer Berwanter ke. As he continued to follow the Osorio's vehicle, Officer Berwanger advised SAJ'D Dispatch Division of his identity and observation(s). Officer Berwanger noted Osorio's vehicle to have travelled north on Cypress Street, east on Chestnut Street, south on Orange Avenue, and west on Myrtle Street, stopping at Cypress Street. During it's travels through the city, Osorio's vehicle reached excessively high speeds. Once the vehicle stopped, however, Officer Berwanger was of the believe that the driver, later identified as Osorio, was preparing to exit his truck and engage him (Officer Berwanger) in a gun battle. With this in mind, Officer Berwanger prepared to dismount his motorcycle and engage Osorio. After a short period of time, however, Osorio's vehicle proceeded westbound on Myrtle Street toward Main Street. At this time the vehicle was travelling at a much lower rate of speed, allowing Officer Berwanger to obtain and broadcast the license plate number of Osorio's vehicle. As he followed Osorio's vehicle once again, Officer Berwanger activated both his Law Enforcement Emergency Vehicle Lights and Siren. Once Osorio's vehicle reached Main Street, it travelled northbound approaching vehicle traffic. Once Osorio's vehicle came to a stop, having reached the rear end of traffic congestion, Officer Berwanger positioned his motorcycle on the east sidewalk of Main Street just south of Osorio's truck. Once there, he noted that there were four (4) SAPD Patrol Division units/vehicles positioning themselves in a line to his left. At this time all of the police vehicles were facing northbound in the direction of Osorio's vehicle, which remained stationary while the rest of the civilian vehicle traffic proceeded out of the area. As the aforementioned SAPD Patrol Division personnel arrived, Officer Berwanger dismounted his motorcycle and could see that Osorio remained inside of his vehicle, moving his head about to and fro. While he could not see clearly into the vehicle, due to window tint, he was sure of the vehicle's occupancy and his (Osorio's) movements due to the shadow(s) being cast. As he did so, he heard the other officers on scene begin to shout, "He's got a gun!" Upon hearing this advisement, Officer Berwanger repositioned himself alongside the passenger side of one of the above indicated SAPD Patrol Division vehicles. This vehicle had been driven by SAPD Reserve Officer E. Demarco #9093. While there, Officer Berwanger heard continual commands/request, as issued by other officers on scene, directing Osorio to "put the gun down" and "don't do it." These commands continued for approximately fifteen (15) seconds. After a short period of time, Officer Berwanger heard one of the other officers on scene state that Osorio had placed his firearm to his chin. At this time, Officer Berwanger saw Osorio place an unknown object to his head. Officer Berwanger then heard the sound of one (1) gunshot which he did not believe had emanated from one of the police officers' pistols. Officer Berwanger then saw Qsorio's head dro and heard the sound of his -engine "revving." Based on his observations, Officer Berwanger believed Osorio had taken his life at this time. As the incident continued to unfold, Officer Berwanger saw Osorio continue his movements while still in his vehicle and believed him (Osorio) to be alive. He also heard other officers on scene indicate that Osorio was still armed with a fiream. Given this inforination, Officer Berwanger again perceived Osorio to be a "threat". While his vision was obscured, due to his position being to the right rear of the suspect vehicle and approximately twelve (12) feet away from it, Officer Berwanger knew that Osorio was preparing to exit his vehicle, having been advised of this fact by other officers on scene. At this time he again heard continual commands given to Osorio as provided by other officers on scene. After the door to Osorio's vehicle opened, having been advised of this by other officers on scene, Officer Berwanger heard approximately eight (8) gunshots fired over a period of approximately two (2) seconds. Viewing Osorio from beneath his (Osorio's) vehicle, Officer Berwanger saw him fall to his knees and ultimately to the ground in a prone position. When asked for his mindset in regard to the possible outcome of the incident had the officers on scene not fired, Officer Berwanger stated opined that Osorio would have fired upon the officers in an attempt to engage them in a gun battle had this not occutred. McShane and I interviewed SAPD Sergeant D. Humphrey. Our interview with Humphrey took place in a Santa Ana PD interview room. The interview was audio recorded by Investigator McShane. The following is a summary of our conversation with Sergeant Humphrey. Sergeant Humphrey provided his extensive law enforcement training and experience he has acquired over 23 years as a Police Officer/Deputy Sheriff. Humphrey is a Sergeant in Field Operations, assigned to dayshift patrol. At the time of the incident in question, Sergeant Humphrey was working uniformed patrol. He was at the SA Police Officer's Association building when he heard radio traffic regarding the incident involving Osorio. He heard SAJ'D Motor Officer Berwanger broadcast that he located Osorio and was following him. Sergeant Humphrey heard that Osorio was stopped and headed to the area to assist. When Sergeant Humphrey arrived, several SAPD units were on scene. Sergeant Humphrey parked his marked police car northbound on Main Street, south of First Street in the #3 lane, behind several SAPD units. Osorio was seated in his vehicle. Sergeant Hutnphrey remembered hearing Osorio was armed with a gun. Sergeant Humphrey retrieved a ballistic shield from a unit trunk and set it up to provide cover for officers. He positioned himself next to Officer N. Quijas, who was directing her attention towards Osorio's vehicle. Sergeant Humphrey was able to get a view of Osorio inside l'iis vehicle and believed he saw blood on Osorio's face and mouth as well as swelling to the face. Sergeant Humphrey did not see or hear Osorio shoot himself, but suspected that is what had occurred. Osorio appeared to be alive, but was not obeying officer's commands to "drop the gun." Osorio exited his vehicle holding a handgun in his right hand. Officers yelled several commands at Osorio to drop the gun, but he did not. Osorio began to tum in a west to southwest position towards the officers. Osorio was holding the gun and it was canted downward. Sergeant Humphrey believed Osorio could have shot at police officers and that was perhaps what he intended to do. Several officers shot Osorio and he (Osorio) fell to the ground. Using the ballistic shield, Sergeant Humphrey and other officers approached Osorio. The gun Osorio was holding was kicked away from him by one of the officers. Officers handcuffed Osorio and provided first aid until paramedics arrived. Sergeant Humphrey assisted the scene supervisor (not identified), who obtained safety statements from the involved officers. Sergeant Humphrey did not fire his weapon because he was holding the shield and knew several officers already had their guns out. Narrative: On 3-11-15 at approximately 1257 hours I responded to the area of 1st St. and Main St. to assist with traffic control reference a vehicle stop that officers were attempting to make in the area of Main St. and Pine St. I arrived on scene at approximately 1302 hours and placed crime scene tape shutting down the intersection of Walnut St. and Main St. At approximately 1355 hours I entered the crime scene and contacted Sgt. Shin reference a question regarding the outer perimeter. I exited the crime scene at approximately 1356 hours. I remained at the intersection of Main St. and Walnut St. until 1630 hours when I was relieved by Ofc.
