WEDNESDAY: MARCH 11, 2015-17:45 HOURS
Pursuant to an OIS (Officer Involved Shooting) investigation, District Attorney Investigator C. McShane
and I interviewed witness (spouse of the decedent). Our interview with took place in a
Santa Ana PD interview room. The interview was audio recorded by Investigator McShane. The
following is a summary of our conversation with
and Osorio have been married for approximately 20 years. According to they have no
marital problems. and Osorio get along fine and Osorio is mentally healthy. Neither nor
Osorio have had extramarital relationships. To her knowledge, said there are no financial strains on
the family. and Osorio have two children together. Both Osorio and work. Osorio is a
production manager at a local printing company in Irvine, Ca. works for NWP Service Corporation
in Costa Mesa, Ca.
said Osorio has owned a handgun for six years. Osorio purchased the gun for home protection and
keeps it in their bedroom closet. could not provide further details regarding the gun, but said she
did not see Osorio leave the house with a gun this morning.
Today, went home for her lunch break at approximately 11:30 hours. At approximately 12:30 -
12:45 hours, she received a phone call from Osorio who said, 'Tm sorry. I got in trouble" then hung up.
attempted several return calls to Osorio with no answer. After several attempts to call him back,
Osorio's phone answered, but nobo-dy spoke. could hear-som-eo-rfe- spea-king on th-e open line
saying, "He's still breathing." heard heavy breathing, but nobody responded to her. became
worried and called Osorio's work. His boss said Osorio had left earlier in the day to go home and have
lunch with
I explained to what had transpired today with Osorio. was extremely distraught, but able to
continue the interview. I asked her if she knew Alberto Hernandez and she said she did not. I asked her
if she knew a female by the name of and she said she did. She further explained that
approximately five years ago, she was looking in Osorio's phone and found the name " She
confronted Osorio thinking he was possibly having an affair. Osorio said he was not having an affair and
the issue went away. It was never brouglit up again. She was unaware of any recent activity involving
those names.

WEDNESDAY: MARCH 11, 2015-16:30 HOURS
Pursuant to an OIS (Officer Involved Shooting) investigation, District Attorney Investigator C. McShane
and I interviewed witness egarding his observations during the OIS. Our interview
with took place in a Santa Ana PD interview room. The interview was audio recorded by
Investigator McShane. The following is a srunmary of orir conversation with Fernando.
was driving northbound on Main Street in his white Toyota pickup truck. He was the only
occupant of his vehicle. observed several police cars attempting to stop a white Toyota
Tacoma pickup that was traveling northbound on Main Street three cars in front of
said the driver of the white Toyota Pickup yielded to the police cars and stopped. said the two
vehicles in front of him were able to negotiate traffic and leave the area. however, had to pull
the right and stop for the police activity in front of him.
exited his vehicle and stood in the parking lot on the north/east corner of Chestnut and Main.
He estimated he was 50 feet from the white Toyota Tacoma the police had stopped. aid there
was one sole occupant of the Tacoma, who was later identified as Benito Osorio. From his position,
began filming the incident with his cell phone.
listened to police as they repeatedly yelled at Osorio, "Don't do it" and "Drop the gun."
said Osorio was not listening to the commands made by the police. At one point
heard- an apparent gunshot-from inside of the Tacoma-and believed Osorio had shot himself.
watched as Osorio appeared to slump forward, then back into his seated position. Officers continued
yelling at Osorio to "Drop the gun" and "Don't do it." Officers started to approach the vehicle, but one
officer yelled that Osorio was still moving.
At one point after Osorio shot himself, he exited his vehicle. heard said he heard a second shot
and believed it was Osorio shooting at the police. heard police respond with gunfire, shooting
Osorio. believed he heard police shoot 6-7 times. Osorio fell to the ground at which point
police approached and provided first aid until paramedics arrived.
We concluded our interview with He wanted to say that he was concerned for the officers at
the scene. He believed police made every attempt NOT to shoot Osorio, but based on the fact Osorio
was not complying with police commands, they had little choice. added that the officers were
"very professional" and "did the right thing." provided us with consent to download the video
he made for the purposes of our investigation. The video was retained by DA Investigator McShane.

I was at my work station monitoring the police radio when I heard an officer involved shooting being
broadcasted. I was contacted by Corporal L. Rodriguez #2408 who asked me to assist with the
investigation.

Sergeant G. Serrano #2338 of the Santa Ana Police Department Homicide Unit provided a briefing
regarding the facts surrounding the officer involved shooting. I was tasked to assist with subsequent
investigation and responded to the scene.

I arrived and entered the crime scene located at 300 South Main Street. I checked in with Officer E.
Martinez #3349 who was maintaining a crime scene personnel log.

Scene Supervisor Sergeant J. Smith #1998 provided a briefing on the circumstances surrounding the
officer involved shooting. I was then assigned to canvass the interior perimeter for witness along witli
Investigator C. McShane from the Orange Corinty District Attorney's Office, Special Assignments Unit.

At the time of the incident in qriestion, was with his girlfriend, walking her to her vehicle in the
area of 300 S. Sycamore. saw police activity on Main Street through an east/west alley between
Sycamore and Main. walked eastbound through the alley to Main St. in order to get a closer look
at what was going on. Based on description, I believed he was in the east/west alley, north of
the Mill Bakery.
When got closer to Main Street, he observed a white Toyota pickup stopped in the northborind
lanes of Main Street facing north with several police cars behind it. could see a subject (later
identified as Osorio) in the driver's seat of tl'ie Toyota truck. Osorio appeared confused and was looking
arorind. The police officers behind the Toyota had their guns pointed at the truck. Officers were yelling
commands to Osorio saying, "Don't do it." heard a single gunshot, but was unsure from where it
came. took cover behind a parked van near the alley lie was in.
looked towards the Toyota from his position of cover and observed a police officer next to him
with a rifle pointed towards the truck. Officers were still yelling commands at Osorio, but he was not
complying. moved back towards Sycamore and continued to watch the incident. He observed
Osorio exit his vehicle with a gun in his hand. From his partially obscured view, heard four
gunshots. He was r'insure of who fired the shots.

Narrative:
On 03/11/15, Alberto Mendoza-Hernandez was the victim of an Attempted Murder which
occurred in the area of 800 S. Cypress/Main Street in the city of Santa Ana, CA. After the
commission of the aforementioned crime, the suspect, later identified as Benito Osorio,
fled the scene in his white 2005 Toyota Tacoma, bearing the California license plate
assigned number and later became involved in an Officer Involved Shooting
(OIS) which occurred in the area of 200 S. Main Street. During investigation into this
OIS, SAPD Patrol Division Officer S. Diaz#3 147 was identified as a witness officer to
the incident.
At approximately 1810 hours, QC DA Investigator D. Fulcher and I conducted an
interview with Officer Diaz. This interview was conducted within an interview room
located within the SAPD Investigations Bureau and audio-recorded by DA Inv. Fulcher.
Subsequent to the interview, DA Inv. Fulcher retained custody of said recording. Below
is a synopsis of the interview conducted with Officer Diaz. For complete details in regard
to Officer Diaz's statements, please see DA Inv. Fulcher's report and the above indicated

recording.
At the beginning of the interview DA Inv. Fulcher and I identified ourselves and obtained
the complete identification information from Officer Diaz, inclusive of his badge number,
modat/call-sign, law enforcement history, assigru'nent and all factors relevant to our
investigation at the time of the OIS. It should be noted that all statements provided by
Officer Diaz were made of his free will and in no way under duress in any form or
fashion. As we began to discuss the OIS and all actions conducted/observed by Officer
Diaz prior to it, he told us the following:
Officer Diaz told us that during his work shift he heard a police radio broadcast of a
Shooting In Progress which occurred in the area of 800 S. Cypress Street. The cornrnents
of the call further indicated that two males were involved in the incident, one of them
armed with a handgun, with a suspect vehicle, being described as a white pick-up, which
fled the scene. By this description, I understood Officer Diaz to be speaking of the
suspect vehicle as noted above. As Officer Diaz proceeded toward the location of the call
from his present location in the area of 1st Street and Tustin Avenue. Officer Diaz
then heard SAPD Traffic Division Officer J. Berwanger #2001 notify SAPD Dispatch
that he was following the suspect vehicle and had it stopped in the northbound
lanes/direction of Main Street at Chestnut Street. Upon hearing this, Officer Diaz
responded to this secondary location and found himself behind several other SAPD units
which had also responded and were in the process of conducting a Felony Car Stop on the
suspect vehicle.
After exiting his patrol vehicle, seeking cover behind the units present, Officer Diaz was
advised that the subject in the aforementioned vehicle was indeed armed. Officer Diaz
then withdrew his duty weapon and sought cover while Officer D. Garcia
#323 I communicated with the driver of the suspect vehicle. These commands were
consistent with telling the occupant of the pick-up, "Don't do it." As Officer Garcia
continued to give the suspect commands, in both the English and Spanish languages,
Officer Diaz noted SAPD Directed Patrol Officer M. Shifflett #3264, armed with a
rifle, to be maintaining cover behind a tree located to the east of the activity and in the
parking lot situated north of The Mills Bakery: 312 S. Main Street. Realizing that there
were sufficient officers conducting the stop of the suspect vehicle, Officer Diaz re-
holstered his duty weapon and positioned himself directly behind officer Shifflett, thus
gaining a better position of suspect visibility. From this vantage point, furthermore,
Officer Diaz had a clear line of sight of the suspect who was seated in the above indicated
pick-up and alone. The driver's side window of this vehicle, furthermore, was down at
this time. By this suspect position designation, I believed Officer Diaz to be speaking of
Benito Osorio in referencing the suspect involved in the OIS.
While Officer Diaz maintained this position, he heard the sound of one gunshot which
emanated from within the suspect vehicle. After this shot was fired, Officer Diaz heard
other officers continue with their command statements directed at Osorio. As he

continued to monitor the Osorio's actions, Officer Diaz saw that he (Osorio) was speaking
on a cellular phone while seated in his vehicle. While he could not discern what Osorio
was saying, Officer Diaz was certain that he (Osorio) was indeed speaking with some
one. Osorio also appeared to have blood covering his face/head at this time; a condition
the cause of which Officer Diaz attributed to a self-inflicted gunshot wound.
After a short while, Officer Diaz saw Osorio open the driver's door of his vehicle and
slowly step/fall out. At this time, with the aforementioned cellular phone still held to his
ear, Osorio began to turn and face the officers positioned behind his vehicle. As he did
so, Officer Diaz saw that Osorio had a semi-automatic, stainless steel firearm in his left
hand. Upon identifying the item in Osorio's hand as a pistol, Officer Diaz yelled, "Gun!"
At this point Osorio began to raise the weapon he held, pointing it in the direction of the
officers positioned to the south of his location. These officers, furthermore were
positionedapproximatelyten(10)feetbehindthesuspectvehicle. TheOfficerInvolved
Shooting then occurred. Officer Diaz stated that he heard approximately four shots fired
by the above indicated officers, after which several officers advanced upon Osorio and
took him into custody.
When asked to identify the persons shooting during the OIS, be they officers or Osorio,
Officer Diaz stated that he was only certain that Officer Shifflett had done so. Officer
Diaz also denied shooting and indicated that his reasons for not shooting was due to his
weapon being holstered and his primary duty at the time being that of an Inforination
Relay Officer.
Had the OIS not occurred, Officer Diaz believed that Osorio would have shot the officers
present, possibly killing one or more of them.
As we concluded our interview with Officer Diaz, he described the location wherein the
OIS occurred as a highly populated area with heavy pedestrian traffic. He also stated that
due to Osorio's actions he was in fear for his life, that of the other officers involved and
the safety of the public.
We concluded our interview with Officer Diaz at approximately 1843 hours.

At approximately 1250 hours Detective Corporal Silva (#2668) and I were asked to assist with
the Officer-Involved-Shooting incident by transporting involved officers to the police station.
We drove to the scene, located at 200 S. Main Street, and waited until Officer Santiago (#3147)
approached and got into our unmarked police vehicle. We drove Officer Santiago to the Santa
Ana Police Station and dropped him off. Detective Corporal Silva and I then resumed our
normal detective duties.

sergeant, At the request of Sergeant B. Harris #49043, I responded to the intersection of South Main
Street and East Pine Street to relieve Sgt. Harris from an outside agency assistance call reference a
SAPD officer involved shooting to supervise SASPD persoi'u'iel in coordination with SAPD personnel,

On Wednesday, March 11, 2015, at approximately 1318 hours, I was working as a uniformed School
Resource Officer assigned to Saddleback High School [2802 South Flower Streetl. At the request of
SASPD Sergeant B. Hatris, I responded to the intersection of South Main Street and East Pine Street for
an outside agency assiSt call reference a SAPD officer involved shooting.
I arrived at 1323 hours and was instructed to give one of the involved SAPD Officers a ride to the
station. I completed the task and returned to the scene at approximately 1355 hours. I remained on scene
l-= assisting with traffic and crowd control till approximately 2046 hours. At that time I was relieved by an
SAPD Officer.

NOTE: If the storage authority listed on below is CVC 22651 (o) or CVC 22651 (p), a release must be obtained from
the Santa Ana Police Department before the vehicle can be removed from the towing company. There is a fee for this
release and the release must be obtained between 8:00 a.m. and 4:30 p.m., Monday thru Friday at the Santa Ana
Police Department.
To obtain a release the vehicle should be cu istered and the istered owner must resent valid
identification (drivers license with photo, California I. D. with photo, or passport with photo). If the registered owner has
valid 1.D. but no valid license, he/she must bring an agent with a valid drivers license.
