FRAZIER Approved By: Date of Report: 06/22/2015 Date: 07/08/2015 Page 1 of 4 CASE NAME: OSORIO, BENITO CLASSIFICATION: OFFICER INVOLVED SHOOTING (FATAL) TYPE: CANVASS AGENCY: SANTA ANA POLICE DEPARTMENT On Wednesday, March 11, 2015, at approximately 1340 hours, Orange County District Attorney Supervising Investigator MARK GUTIERREZ contacted me regarding an officer involved shooting incident involving the Santa Ana Police Department. GUTIERREZ requested I respond to the incident location, in the city of Santa Ana, and assist with the investigation. At 1424 hours, I arrived at the incident location and met with investigators from the Orange County District Attorney’s Office and from the Santa Ana Police Department who were present to assist in the investigation. At 1513 hours, Santa Ana Police Sergeant JEFF SMITH conducted a briefing of the known circumstances surrounding the incident for the personnel involved in the investigation. Following the briefing, Orange County District Attorney Supervising Investigator MARK GUTIERREZ assigned Santa Ana Police Detective JIM GARCIA, a certified Spanish language interpreter, and I to conduct canvass interviews of potential witnesses that live in the area. During our initial canvass, GARCIA and I conducted audio digital recorded interviews of the following individuals: told us in Spanish that he was in the rear of his residence, in the restroom, when he heard sirens. looked out his living room window that faced Main Street, and saw a white pick- ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT S.A. 15-005 Investigator: S. FRAZIER Approved By: Date of Report: 06/22/2015 Date: 07/08/2015 Page 2 of 4 up truck stopped in front of his house, and numerous police vehicles stopped behind the truck. saw a subject in the truck, but was unable to identify if it was a male or female. heard the officers yelling to the subject, “Don’t move, don’t move.” After about 5 seconds, went back to the rear of his house and then heard approximately 5 to 8 shots. A minute or so later, heard knocking on his front door and police officers asking if he was ok. did not witness the shooting incident, since he went into the back room of his residence. was at the laundromat at Main Street and Ritchey Street from approximately 1130 to 1400 hours. When she returned home, she came into her house via the back alley and noticed the police activity on Main Street. did not witness the shooting incident. was in her kitchen when she heard someone yelling approximately 20 times to “get out of the car” in both English and Spanish. then heard approximately 5 to 6 gunshots. After waiting a couple of minutes, exited her home and went to the wooden fence in her yard that faced Main Street, and looked to see what was happening. saw a subject on a stretcher being taken away by paramedics and numerous police officers and vehicles. did not witness the shooting incident, since her home is to the rear facing an alley. was with in the kitchen of their home when she heard yelling. heard a single gunshot and approximately 1 minute later heard approximately 10 more gunshots in rapid succession. Both and heard the yelling continue before the first shot, and before the second round of gunfire. waited a couple of minutes, exited her home and went S.A. 15-005 Investigator: S. FRAZIER Approved By: Date of Report: 06/22/2015 Date: 07/08/2015 Page 3 of 4 to a fence to see what had occurred. observed a subject on a stretcher being treated by paramedics, and number police vehicles present. No response at the time of our canvass. left her home at approximately 1100 hours, to pick up her children from Edinger Elementary School, and did not return until approximately 1400 hours. did not witness the shooting incident. was in the alley just east of her home at Pine Street when she heard sirens. heard approximately 6 rapid gunshots, so she ran into her home through the back entrance and up the stairs. went to the window overlooking Main Street and saw a male subject lying in the street and the paramedics were putting him on a stretcher, and taking him from the location. observed numerous police officers and police vehicles at the scene, but did not witness the shooting incident. was in her kitchen towards the rear of the apartment, facing south toward Chestnut Street. heard sirens and looked out the kitchen window and saw several officers arriving on Main Street, just south of Chestnut. also observed a large group of spectators forming at the corner and officers telling them to get back. took some trash out of the rear of her apartment and decided to look through a fence facing Main Street. saw several officers, walking with their guns drawn, in a northward direction and she immediately heard numerous gunshots. ran back S.A. 15-005 Investigator: S. FRAZIER Approved By: Date of Report: 06/22/2015 Date: 07/08/2015 Page 4 of 4 into her apartment to check on her roommate’s son, who was asleep just above the area the shooting took place. was in his room looking down at the police activity. went back to the rear of the apartment and stayed there. was asleep in his bed when he heard 5 or more gunshots on Main Street. did not hear anything prior to the shooting incident. looked out his window and saw several police vehicles and police officers. mother came into the room and told him to get away from the window. did not witness the shooting incident. was at work when the incident occurred and did not witness the incident. was home with her young son when she heard sirens in front of her residence. heard male voices yelling, but could not understand what was being said, so she grabbed her son and went to the kitchen at the rear of the residence. heard one gunshot but did not witness the shooting incident. as home but did not see or hear anything. is an employee of a marijuana clinic and stated she and some clients were inside the building, when she heard a quick siren and what she describes as fireworks. thought some jars fell off the shelf because it was so loud. never left the building and did not witness the shooting. relayed to us that she was the only one in the clinic willing to speak to us.
