On Wednesday, March 11, 2015, at 1345 hours, I was contacted by Orange County
District Attorney (OCDA) Investigator DOMINGO CABRERA regarding an officer involved
shooting incident involving the Santa Ana Police Department. CABRERA requested I respond to
the Special Assignments Unit office for an initial briefing. Once briefed, I was assigned by OCDA
Supervising Investigator MARK GUTIERREZ to respond to Western Medical Center, Santa Ana
where the suspect had been transported from the scene by paramedics.
At 1435 hours, I arrived at Western Medical Center, Santa Ana Emergency Room (ER). I
was directed by emergency room security to ER room T1. Santa Ana Police Department Patrol
Officer DON KOZAKOWSKI #1888 was present in the room. The deceased suspect was supine
on a gurney in Western Medical Center, Santa Ana ER room T1. Room T1 was a standard, large
sized ER trauma room with a variety of medical care equipment, for the purpose of emergency
and trauma patient care. Santa Ana Police Detective EVA LOPEZ #2456 arrived at ER T1.
Officer KOZAKOWSKI provided me the names of the paramedics who were on scene at
the incident scene:

AT 1545 hours, Orange County Deputy Coroner Investigator ELIZABETH KINNEY arrived
at ER T1 for the Coroner’s investigation.
AT 1555 hours, Orange County Crime Lab Forensic Specialist RACHEL BOOTH arrived at
ER T1 for photographs.
As the investigation at the hospital progressed, I received the name and California
Driver’s License photograph of the suspect in an email from Santa Ana Police Department
Officer FRANCISO GOMEZ. Both ELIZABETH KINNEY and I positively confirmed the DMV
photograph was the deceased on the gurney: BENITO OSORIO, 3/21/1976, CDL:
5’7”, 145 pounds. There was no pre-transfusion blood sample obtained from the decedent.
On initial view, OSORIO was on a wheeled gurney covered by a white blanket. One right
running type shoe, with a pair of socks was on the gurney by the OSORIO’s feet. A silver pair of
handcuffs was on OSORIO’s left wrist. OSORIO was a male Hispanic, with short hair and a slight
mustache. He had a barbed wire, tribal style band tattoo with a heart around his left bicep.
OSORIO had an obvious and gaping open wound to the upper left portion of his forehead. The
wound was a nearly 2” diameter open hole in the upper left portion of OSORIO’s forehead. An
intubation tube was inserted in the mouth and still present. Several electrocardiogram patches
were attached to OSORIO’s chest. I saw an apparent bullet wound to the left side of the

OSORIO’s nose. The apparent bullet wound to the left of OSORIO’s nose appeared to be an
entrance wound. The other wounds I could see on a cursory view of the body prior to KINNEY’S
detailed examination were 3 or 4 apparent bullet wounds to OSORIO’s right elbow. Some of
those wounds appeared to be entrance wounds; some appeared to be exit wounds.
KINNEY’S investigation of the body revealed numerous apparent gunshot wounds on
OSORIO. The gaping 2” hole in OSORIO’s forehead appeared to be path connected to an
apparent gunshot wound under OSORIO’s chin. The hole next to OSORIO’s nose appeared to
have a straight in path. There were no wounds to the back of OSORIO’s head or body. There
was an apparent gunshot wound to the middle of OSORIO’s throat. When KINNEY examined
that wound, she felt a bullet just inside the hole. There was a rectangular shaped open wound
to OSORIO’s upper right chest. After examination by KINNEY, the rectangular shape was due to
a thin middle piece of skin that had pulled apart. When KINNEY manipulated the middle piece
of skin back together, two circular shaped holes, very close together could be seen. There was
an open wound to the right side of OSORIO’s abdomen. There was an apparent bullet entrance
wound just above OSORIO’s right side groin area.
KINNEY collected the shoe and socks from OSORIO and bagged his hands. OSORIO was
secured for removal and transport to the Orange County Coroner’s office in an OC Coroner
white body bag at 1745 hours.
At approximately 1750 hours, I cleared Western Medical Center, Santa Ana (WMC-SA).
